Planned Parenthood Defunding Law To Proceed In Indiana

Planned Parenthood

First Posted: 05/11/11 03:24 PM ET Updated: 07/11/11 06:12 AM ET

WASHINGTON -- A federal judge ruled on Wednesday that a new bill that cuts off government funding to Planned Parenthood stands. Planned Parenthood of Indiana had filed a temporary restraining order against the legislation, which bars Medicaid recipients from using that money to pay for services at the family planning provider.

Indiana House Bill 1210 is the first bill in U.S. history to prohibit the use of Medicaid at Planned Parenthood clinics. Roger Evans, the chief litigator for the family planning provider said the law violates federal Medicaid rules as well as the Constitution and should immediately be struck down in court.

“A very essence of something being a constitutional right is that the states cannot punish you for doing it,” Evans told HuffPost. “The problem here is that Indiana is penalizing Planned Parenthood for providing women with access to abortion services -- an obviously constitutional realm of conduct.”

Judge Tanya Walton Pratt of Indianapolis denied Planned Parenthood’s request to temporarily hold off on enforcing the bill, which means that it remains in effect as of Tuesday afternoon. Gov. Mitch Daniels said he has ordered the Family and Social Services Administration to ensure that Medicaid recipients “receive prompt notice” of health care and family planning options, although it's unclear how many alternative providers offer the same family planning services as Planned Parenthood and whether they will accept new Medicaid clients. A majority of Planned Parenthood’s clinics are in poor, rural and medically-underserved areas where affordable options are limited.

PPIN president Betty Cockrum said Planned Parenthood would continue to see Medicaid patients for as long as possible by covering their medical costs out of its Women’s Health Fund, but she is “deeply disappointed” by the judge’s ruling.

“The court’s ruling today means that 9,300 Medicaid patients at our 28 locations have lost services from their preferred provider,” she said.

Despite having denied Planned Parenthood a temporary restraining order, the court must still rule on the request for an injunction against the legislation. That hearing is scheduled for June 6.

When it really hit them that they open the doors for more miniorties to be born, that it will make the white race the miniorties instead of the majority watch how fast they will want to change the laws back to have planned parenthood back.

Right now all they can see in their minds is that PP is helping the miniorties plan on when and how many children they want to have. What they fail to realize that when blacks was having a lot of children went back from slavery for when they were force to bare children for the slave owners. When slavery ended it was necessary to have a large family for the chores on their own land as well as the white land owners, but as more blacks start acquiring their own lands, they found the need to have large family no longer a need and they stress the important of giving their children a better education and way of life.

So blacks stop having a lot of children and was happy with one or two children which decrease the blacks population so much that they are become a part of the miniorty level instead of increasing to the majority and the mixing of all the races are making the white race a huge part of the miniorty and have lost that status of majority.

Wait until the people figure out what a big mess they are making in defunding PP and the whinning will increase.

Your post points out how much revisionist history has overtaken our classrooms! The only part of your post that has any resemblence to reality is that black families were encouraged to have large families to work on the farms. But here's another fact: this is how WHITE families got through the early days as well. Everyone had large families, black and white alike.

Otherwise, that's where your facts end. Since there were no welfare programs or "safety nets", families became smaller to live within their means...blacks and whites both!

It wasn't until welfare became a staple of American life where families grew larger and larger in order to collect more money from the state. Since then, it's just a dependence or way of life.

As to the abortion figures, again, the numbers are a direct result of measurement of income. Thus, abortion for whites is considerably down, while abortions for blacks and hispanics has risen. This is partly due to the fact that state funding of families thru medicaid and welfare and whatnot has been slashed, for example, some states put a 2 year limit on welfare...with less "income", these women are more and more going for the abortion.

The real hypocrisy here is that nothing is being introduced into the schools to TEACH people how to be productive, responsible members of society. Instead, the girls are simply given access to free abortions.

PP makes it very easy to donate!
You can do it online, you can make a small monthly donation that will continue and you can walk into any PP outlet and give funds.
I like to write my check monthly and in the note section, I give in the name of a different opponent of PP, it give me a bit of joy to know that I'm helping them offer the wonderful and varied services they do in the name of someone who wants them destroyed.

Try it... it's very enjoyable!

This is so ridiculous. If you are against Planned Parenthood, you are against cancer screenings, STD screenings, birth control, and so many other services that ONE DAY you will need yourself. One day, you will lose your job and subsequently, your healthcare. What will you do then?

Don't let woman plan their families and don't help them care for their unwanted children, and don’t help those children get an education so they won't make the same mistakes their mothers made, and don't focus on the economy to stimulate job growth for these poor, uneducated, pregnant women to scrape by a living to support, what is now, the 2nd or 3rd generation of unwanted, uneducated, sick, poor children. Keep the cycle going! We need more 40 year old Taco Bell workers to make our value meals quicker! God bless America!

Congratulations on being born kids! “Tell them what they've won, Chuck!”... A TERRIBLE LIFE!

States rights under the Constitution turns on the idea of states, ideally, are empowerd to to avoid federal overreach. 'Federal Overreach' is not the situation here. This PP issue, along with a few recent others, like union bashing, is a matter of a handful of holy roller tea partiers, who've managed to get elected, advancing their own private conservative agenda.

Whole different animal, as they do not represent ' We,he People's' individual rights and desires on these particular issues. That's why these only recently state adopted 'provisional statements' do not have the force of law as the majority of voters still want the Federal government to step in when needed. This judge made a bad call.

..."In 2009-2010 thirty eight states have introduced resolutions to reaffirm the principles of sovereignty under the Constitution and the 10th Amendment; Nine states have passed the resolutions. These non-binding resolutions, often called “state sovereignty resolutions” do not carry the force of law. Instead, they are intended to be a statement to demand that the federal government halt its practices of assuming powers and imposing mandates upon the states for purposes not enumerated by the Constitution..."

My contempt for Daniels is complete, total and likely to grow through time. Not much he can do about it either - his attack on women is his personal crime of the soul, and the smirk on his face tells the world that he revels in it. How repulsive is that?

Yes, it is a sad day. It's also a sad day for the Constitution.

As for being a Republican, that's easily fixed. Stop being one until they actually represent you.
