DREAM Act Loses Republican Cosponsor Richard Lugar

WASHINGTON -- Senate Democrats reintroduced the DREAM Act on Wednesday without the co-sponsorship of Sen. Richard Lugar (R-Ind.), who had previously been one of the bill's strongest backers.

The legislation would allow some undocumented young people to become U.S. citizens and has been introduced repeatedly over the years with Lugar and Sen. Dick Durbin (D-Ill.) as the cosponsors. The most recent vote on the DREAM Act was in December, when it fell five votes short of bypassing a filibuster. Lugar was one of just three Republicans to vote for the measure.

In a statement, Lugar spokesman Mark Helmke blamed Democrats for turning immigration into a partisan issue.

"President Obama's appearance in Texas framed immigration as a divisive election issue instead of attempting a legitimate debate on comprehensive reform," wrote Helmke. "Ridiculing Republicans was clearly a partisan push that effectively stops a productive discussion about comprehensive immigration reform and the DREAM Act before the 2012 election."

In his Tuesday speech at the Mexico-U.S. border, Obama pointed the finger at Republicans for moving the goal posts on immigration reform. The president argued that his administration has gone out of its way to accommodate their requests.

"Maybe they'll say we need a moat. Or alligators in the moat," Obama joked, referring to the GOP. "They'll never be satisfied. And I understand that. That's politics."

Helmke said Lugar's staff told Democrats that the Indiana senator supported the initiative, but he wanted them to work on getting more Republican support. Lugar's spokesman claims that not only did Democrats not do that, but they set up a press conference to announce the reintroduction of the DREAM Act before the Lugar had made his final decision not to cosponsor. Democrats, however, said that it was clear for months that Indiana Republican wasn't going to cosponsor the bill at this time.

"They did little to reach out to other Republicans as it became more apparent that the Obama Administration and the Dems wanted this as a partisan wedge issue," Helmke explained. "So this is not about passing good legislation to help people, but win elections. ... The Dems will not let there be a clean up or down vote on this issue, which is too bad for all the young people effected."

He added that the senator "continues to support what the DREAM Act could do."

Max Gleischman, a spokesman for Durbin, disputed Helmke's statements.

"Senator Reid has already allowed an up or down for on the DREAM Act -- less than six months ago, in December of last year," Gleischman told The Huffington Post. "Senator Lugar voted for that bill, so the notion that it’s Democrats who won’t allow a clean vote on the bill just isn't credible. Durbin has personally reached out to many Republican members on the DREAM Act, including a call to a leading Republican just yesterday. The problem isn't a lack of outreach by Democrats; it's a lack of political courage by Republicans."

Gleischman added that Lugar has been a "great partner" on the bill for more than six years, and hopefully he will still vote for the legislation when it comes up for a vote.

Lugar is facing a potentially tough reelection battle: The Tea Party is pointing to him as one of their main targets to get out of office in 2012. Jumping on-board with Democrats to push immigration reform may not have played well with conservative activists in Indiana.

A Senate Democratic aide said Lugar's decision not to cosponsor this time around wasn't entirely surprising, arguing that he was captive to a changing Republican Party.

"The last time the DREAM Act came up -- in 2007 -- 12 Republicans voted for the bill," said the aide. "When Republicans last controlled the Senate, the DREAM Act passed the Senate as part of a comprehensive immigration reform bill, and it was reported by the Judiciary Committee on a 16-3 vote. And when the DREAM Act was first introduced, in 2001, it was sponsored by a Republican. The DREAM Act hasn’t changed significantly in the last 10 years, but the Republican Party has. So I don’t blame Senator Lugar for his decision not to cosponsor. It reflects the direction of Republicans on immigration."

Interestingly, Lugar sent out a press release on Dec. 18 -- after the DREAM Act failed in the Senate -- saying that he was going to "work to pass this legislation in the next Congress." (Visitors to Lugar's website used to be able to access this statement at the first link on his DREAM Act page, but that link is now broken.)

The DREAM Act's shot at passage is slim. Even if it gets through the Senate, it will face a Republican-controlled House.

Carlos Saavedra, national coordinator of the United We Dream network, a national immigrant youth-led organization, said he was "very disappointed" in Lugar's decision not to cosponsor the legislation this time.

"I think it would have made a big difference for him to say, 'Yes, I support you, even in this new time around,'" said Saavedra.

He added that the latest development puts more of a burden on Democrats and Obama, whom United We Dream would like to see grant undocumented young people administrative relief through an executive order.

You cannot lose what you never had. The republicans have been using these distraction tactics forever. They make it look like they are working with you, and stab you in the back at the last moment.

America's laws keep getting accused of being inhumane, profiling and xenophobic. Yet the piece of legislation that is demanded most by Hispanic activists is on it's surface completely biased.
To begin with, it benefits no citizen or legal visitor to this country. It is intended strictly to benefit unregistered foreign nationals and their children. And they have the nerve to call it the "Dream Act".
Does that mean the American Dream is strictly for foreigners who ignore our laws?
If they were ever serious about getting this act passed they would have to make it benefit citizens, too.
Lugar was smart to take his name off of it. The more citizens hear of a plan to benefit foreigners when Americans can't even afford to go to college, the less they are likely to agree with it.

we need more teachers and schools to teach the poor illegals...we need more drug rehab centers to help the addicts clean up from the drugs the illegals brought here that have ruined the lives of the citizens that once had the jobs that now the drug bringing poor illegals now have not to mention we need homeless programs for the drugged out citizens that once had homes that the illegals now own with their children that were born here that get welfare and help with the drug inport from their illegal parents country and friends country..on and on and on....we have to make more schools and jails because my illegal friend is in jail for committing crimes in this country but this is the country of Mexico and they want it back and become a great citizen and hire only their friends because this is really their country and how dare anyone refuse me from getting an education ...who cares if you are hooked on cocaine that is the only way we can get extra money to but a SUV because they don't pay me enough money to buy all of this good stuff that these people once had before we came and took everything away..i don't have to follow no stinking rules from nobody..who are you but nothing anyway.i am going to protest lay down in the street and fight for my rights my parents had me in this country.

I love the attitude of some, that it's racist that some of us don't want 30 million illegal border busters here, sucking down our benefits and jobs.

Yes, how dare we be upset that millions of Americans can't find jobs; yet millions of illegals have jobs. How dare we be upset that American families are struggling while anchor baby families are getting food stamps, welfare, medicaid and housing.

You can't say one word about how this country his too many people and not enough jobs and resources because it's somehow "racist".

Guess what? I don't want 30 million Canadians, French or Australians invading us either.

Canadians share a border with us as well, yet they are not invading us en masse. Why? Because they've worked to make their country every bit as good as ours? What's Mexico's excuse?

These people have bought the Marxist mythology hook, line, and sinker. They will never understand sovereignty or ownership. That's at the root of why they also hate the top 49% who are paying the way for the bottom 51%. A decent person would at least express gratitude for such financial assistance, but they respond with contempt. It makes no sense. I wouldn't mind being taxed nearly as much, if the bureaucratic pickpockets expressed some sort of appreciation. That's all the payment I expect when I give to charity.

Unfortunately, many Republicans' opposition will continue to be an obstacle in the passing of this piece of legislation, and the rhetoric they use is just as damaging to public perception the DREAM Act. For instance, can't anyone explain to them that the DREAM Act does NOT constitute amnesty? It seems our very own representatives need to brush up on some basic political terminology as well as the premises behind the bill proposal. For instance, Congressman Lamar Smith has been quoted as saying that "[t]he DREAM Act doesn’t solve our illegally immigration problem, it exacerbates it. Amnesty will encourage millions more parents to bring their children to the U.S. illegally."

The Dream Act is just the first step in a piecemeal amnesty. The Dream Act that was defeated in December, if you look closely had virtually no enforcement provisions and no cut off time or end date, in effect, a rolling amnesty. And sneakiest of all was a waiver that could be used at the discretion of Homeland Security which allowed the requirements to be waived "in the public interest". "WAIVER- With respect to any benefit under this section and sections 7 through 16 of this Act, the Secretary of Homeland Security may waive the ground of inadmissibility under paragraph (1), (4), or (6) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)) and the ground of deportability under paragraph (1) of section 237(a) of that Act (8 U.S.C. 1227(a)) for humanitarian purposes or family unity or when it is otherwise in the public interest.
