Alabama Law Bans Transporting, Housing Undocumented Immigrants

WASHINGTON -- Alabama Gov. Robert Bentley (R) signed an immigration bill into law on Thursday that will prohibit transporting or housing undocumented immigrants and require immigrants to carry papers, an even tougher spin-off of Arizona's SB 1070.

The Alabama immigration law, which is set to go into effect on Sept. 1, follows Arizona's lead in requiring police to ask for legal documents if they reasonably suspect someone is in the country illegally.

But the Alabama law goes one step further than SB 1070, which was passed last year and then challenged by the federal government. The Alabama law requires schools to check the citizenship of their students -- even though undocumented children are allowed, under law, to attend K-12 schools -- and penalizes businesses if they do not check immigration status. It also forbids drivers from transporting undocumented immigrants, even though Alabama does not allow people without proper papers to get driver's licenses and transport themselves.

Civil rights groups and Latino advocacy organizations say the law is outrageous, and are planning a series of lawsuits and boycotts to block it from going into effect.

The Southern Poverty Law Center, the National Immigration Law Center, and the American Civil Liberties Union announced on Thursday they will challenge the law in court.

"Its proponents have called it 'Arizona with a twist.' Well, it is twisted," said Mary Bauer, legal director for Southern Poverty Law Center, on a conference call. "The law is mean-spirited, racist, unconsitutional and costly."

Southern Poverty Center is located in Montgomery, Ala., putting the organization in the middle of the controversial new law. Bauer said the law was likely to have a high economic cost for the state, between lawsuits and potential boycotts.

Arizona had spent $1.5 million defending its immigration law, SB 1070, as of February, and industry groups estimate that boycotts have cost the state hundreds of millions of dollars.

"This law will set back years of progress Alabama has made on civil rights and prove economically devastating for Alabama,†Bauer said. “This is why the Southern Poverty Law Center and other civil rights groups will challenge this racist and harmful unconstitutional law in court.â€

Groups such as National Council of La Raza, NAACP and the Leadership Conference on Civil and Human Rights are looking to use a grassroots movement and economic pressure to block the law.

"I think because of the extreme nature of the Alabama position, it is encouraging more of the grassroots activism that we saw come into play in Arizona," said Wade Henderson, president and CEO of The Leadership Conference on Civil and Human Rights. "And I think the impact of those actions is likely to be the same, the state will have to modify its law."

So what is your point? Is it 1950? Is George Wallace (deceased) the Governor? The KKK was against ALL immigration, not just illegal. They also happened to be against catholics, jews, northerners and did you forget blacks? How do you feel about the present day extremist organizations like La Raza? these laws are about race including cases of false arrest and imprisonment and a good example is Arizona, a woman in Guadalupe, AZ is looking forward to a check cut by the county for $30,000. This, due to her false arrest and imprisonment at the hands of Sheriff Joe Arpaio's employees in beige. You may recall the name Elaine Sanchez from a March 2009 feature by Village Voice Media Executive Editor Michael Lacey, "Are Your Papers in Order?" That piece told the story of the Sanchez family, and how they'd been targeted for harassment by the Maricopa County Sheriff's Office, which provides police services to the little town of Guadalupe AZ.

I mean, really. My opinion of God has gone down so much because creating so many babies in Mexico just doesn't make any sense.

Did you know that there is no legal way for an uneducated Mexican person to come to the US and then become a citizen?

So your great-grandfathers did have it easier -- all they had to do was get on a boat and fill out some papers and they were in.

Every state should do this. I still don't understand what all the chatter is about and why some people feel this is so wrong. We have laws against illegal immigration. For all the people that say these are nice, intelligent, hard working people then they shoud have no problem coming here the legal way. Since they don't come here legally that makes them not so nice, intelligent or hard working and certainly not moral.

You're somewhat correct. It is incredibly racist for this administration to turn a blind eye to illegal aliens streaming across our southern border, while strictly enforcing immigration policy for those attempting to properly immigrate from countries abroad. Selective enforcement and preferential treatment are the hall marks of racism. Good of you to call Obama's white house out on it.

Incorrect. Perfect English and paying taxes, as well as coming in legally, would not set you on a path to citizenship. In fact, the U.S. immigration system does not care about the first two conditions at all. In fact, the best bet is to marry a U.S. citizen.

Every country sets conditions for immigration, usually with the intention of improving their nation.

You are asking this highly technological nation to attempt to improve itself by allowing an invasion of the US by Mexico's poorest, least educated and skilled underclass, with no experience of democracy or high technology or US culture.

Hence, the US is not improved at all, but is slowly descending into third world status, certainly you can see that in the City of Los Angeles.

Like SB1070 the part of the new law “requiring police to ask for legal documents if they reasonably suspect someone is in the country illegally†will be blocked and challenged all the way to the Supreme Court. There is no way a law enforcement agency can present a case of how to profile the immigration status of a US person just by observation or a mandate for all US Citizens to carry papers all the time.

A judge awarded $94,000 in fees and other costs to lawyers representing a handful of Latinos in a lawsuit that alleges racial profiling in Maricopa County Sheriff Joe Arpaio's immigration patrols.
The lawyers argued that Arpaio's office should pay the costs of reopening depositions in the case after it was discovered in earlier testimony that the police agency had destroyed records sought in the lawsuit. They say they wouldn't have had to reopen the depositions had they had gotten the records earlier.
U.S. District Judge Murray Snow issued a ruling awarding $70,000 to a California law firm, $2,000 to the American Civil Liberties Union and an additional $22,000 for court reporter and videographer services.
Today, Maricopa County pays a yearly premium of $1.2 million for outside insurance with a $5 million deductible. For any lawsuit that costs $5 million or less, the county foots the entire bill. It’s the best policy the county can buy because of Arpaio’s terrible track record.

This is nothing new, immigration has been enforced for mant years without profiling - and cases upheld on appeal.

All 6 cases aginst SB1070 have been dismissed for failing to make any case aginst it for racism, profiling, violation of rights etc...

Since March, 2009, the United States Department of Justice Civil Rights Division has been investigating Arpaio amid accusations of discrimination and unconstitutional searches and seizures. The investigation has been conducted under the authority of Title VI of the Civil Rights Act of 1964, which forbids discrimination related to programs that receive federal funds. On July 7, 2009, Arpaio held a press conference, and announced that he would not cooperate with the investigation, either by providing documents, or permitting interviews with personnel. On September 2, 2010, the Department of Justice filed suit against Arpaio, to compel his cooperation with the investigation. A spokeswoman for the Justice Department stated that it was unprecedented for an agency to refuse to cooperate with a Title VI investigation, and that this is the first time the Justice Department has sued to compel access to documents and facilities In February 2010 Judge John Leonardo of Pima County Superior Court found that Arpaio "misused the power of his office to target members of the (Board of Supervisors) for criminal investigation." Now on to the figure mentioned in the Dickerson piece of 2,150 “prison condition†lawsuits since 2004. If you don't have ID ~ how do you board a plane?
I have to show ID when I purchase a plane ticket, show that ID 4-6 times before I can get on my flight and again when I pick up my luggage. Not to mention I need a passport to get into any other country and need that passport to get out of Mexico.
So are Illegals exempt from all this?

They can detain any person of interest, citizen or not, until they establish I.D. All SB 1070 and similar bills do is allow them to ask you if you're supposed to even be in the U.S. after they have already arrested you on some other charge. The whole Nazi papers please argument is a complete fallacy, with no basis in the law.

Check a few travel agency websites. This is so serious that many of them have travel advisories for their clients who travel to AZ.

Your ID has to do with it. If you're in AZ and have an encounter with the police, let's say a broken taillight on your rental car, the police can ask you for proof of citizenship.

Assuming you were born in the U.S., what will you carry? The law specifically excludes driver's licenses from most states. Your birth certificate together with your driver's license might help if you haven't changed your last name due to marriage or other reason in which case carrying those papers might help prove that you're a citizen.

So if you don't have acceptable proof ON YOUR PERSON when they ask you for them, the police can put you in their car and take you to jail. Once you're in jail, they will follow some procedure to check your citizenship status. Hope it's not late on a Friday afternoon cuz most state offices are closed for the weekends.

And that's why people are riled up. I'm not defending the illegals, I'm speaking up for my own right to travel freely to all 50 states without being at risk if I don't keep my passport upon my person at all times.
