Osama Bin Laden Criminal Charges

NEW YORK — Federal authorities used DNA from "multiple family members" and facial recognition technology to identify the body of Osama bin Laden, according to court papers filed Friday that formally dropped terrorism charges against the slain al-Qaida leader.

The papers detail the CIA's painstaking efforts to make sure the man killed May 2 during a Navy SEALs raid of his compound in Pakistan was indeed bin Laden.

After the raid, U.S. forces collected DNA from bin Laden's body and took it to a base in Afghanistan, said a statement signed by a top U.S. counterterrorism official, Deputy Assistant Attorney General George Z. Toscas.

CIA personnel there compared it "with a comprehensive DNA profile derived from DNA collected from multiple members of bin Laden's family," the statement said. "These tests confirmed that the sample (from the raid) genetically matched the derived comprehensive DNA profile for Osama bin Laden."

It added: "The possibility of a mistaken identification is approximately one in 11.8 quadrillion."

The CIA used the facial recognition technology to compare old photos of bin Laden to photos of his body, the papers said, and concluded "with high confidence that the deceased individual was bin Laden."

The document also makes a passing reference to a "significant quantity" of terrorist network material recovered at the hideout, including "correspondence between Osama bin Laden and other senior al-Qaida leaders that concerns a range of al-Qaida issues."

The papers filed in federal court in Manhattan officially ended a case that began with hopes of seeing bin Laden brought to justice in a civilian court.

A grand jury voted to indict the al-Qaida leader in June 1998 on charges he supported the ambush that left 18 American soldiers dead in Somalia in 1993. The indictment was originally filed under seal but was made public later that year.

The indictment was later revised to charge bin Laden in the dual bombings of two American embassies in East Africa that killed 224 on Aug. 7, 1998, and in the suicide attack on the USS Cole in 2000. None of the charges involved the Sept. 11, 2001, terrorist attacks.

Also named as a defendant was Ayman al-Zawahiri, the Egyptian eye doctor and longtime bin Laden deputy who has become al-Qaida's new leader.

The charges included conspiracy to kill U.S. nationals, conspiracy to use weapons of mass destruction against U.S. nationals and conspiracy to damage and destroy U.S. property.

Around the time the charges were first filed, the CIA's bin Laden unit was pursuing a plan to use Afghan operatives to capture bin Laden and hand him over for trial either in the United States or in an Arab country, according to the 9/11 Commission.

This week, U.S. District Judge Lewis Kaplan signed off on a request made by federal prosecutors to dismiss the charges – a formality when defendants under indictment die.

To all those knuckleheads who posted here regarding a conspiracy; the court dropped the charges because a dead person cannot be charged with a crime. Pretty simple really; unless you live in an apartment covered in tin foil.

I guess the media has to cause emotions to run High, with the intention of pissing people off. This story about the Federal Judge dismissing charges against Bin Laden pisses me off. For God's sake, why are you creating hate seeking headlines for a process that is a normal follow up for somebody that has died before coming to trial?
Do you the media, really have to continually rouse hate and anger? Do you really?

I may not agree with all aspects of it, but President Obama sure has pursued a strong anti-Al Qaeda campaign. It's no surprise that the right doesn't give him any credit.

We essentially supported Al Queda in Afghanistan against the Russians .... so they could strengthen and then attack the USA on 9/11.... Could have left Russians alone to worry about the Afghan's... Now we have the worries with war there and damage of 9/11 behind us.

We helped Afghan's and also Islamics in Serbia/Yugoslavia but with no acknowledgement from any Islamic nation. Islamic nations sent help in any case to either location.

I don't get why we spend taxpayers money (there had to be actual people typing, filing etc not to mention the judges time - all paid for by US taxpayers) to do ANYTHING with the charges against bin laden......no taxpayers actually saw a body.

I don't see why they dismissed the charges, I believe that the charges should go down in infamy just as OBL will (did). reasons being that his followers will start thinking that the charges were never real and that it was a clean-up (cover-up) by the UN.

Dropping the charges against Bin Laden means Obama is guilty of murdering a innocent person. Who will charge Obama with a War Crime of murdering a civilian? The World Court? Wish!

Right after bush, cheney, rumsfled and the lot are brought up on their own charges. No man, President or not, should be above the law. And yes, that includes Obama. But, first things first...in fact seems to me like several President's, on both sides, have broken an international law or two and just got away with it. BTW, the charges were dropped against bin laden because he died. "Such requests are procedural and routine in case where defendants named in indictment die"
There's no way anything can clear bush of the murdering job he did in Iraq. As you remember, he lied about everything and to everyone in order to put us there.

Oh it was Bush that lied, eh? None of that intel was by anyone but him. At least Bush had to get Congress to go along with the Iraq thing. Unlike your hero, he just puts us in harms way because he thinks he can without going through congress. Remember Libya? We are not supposed to be there any longer than two weeks. It's been a sight longer than that I believe. Wake up.

They have no evidence that he was actually behind 9/11. Bid Laden had even denied it shortly after the tragedy but they released a mistranslated video saying it was a confession. People wanted a scapegoat before they even wanted to know the truth...Why do you guys think they never mentioned 9/11 on the listing for Most Wanted? Or anything else related to his capture. he was wanted IN CONNECTION but he was never an actual suspect because there was no evidence!. There was never enough evidence to even convict him of the crime so they killed him off when they could have easily captured him. Killed him off in front of his young innocent daughter, and mistreated his body and even gave him a disrespectful "burial" by putting him out to sea. That was seen as a postmortem insult to him by his family. I saw in the paper that they claimed they gave him a respectful funeral based on customs...bs. since when was it the american way to take pride in killing someone? since when did the america i was born in raised celebrate peoples deaths? No matter the crime, ive lost faith in mankind...people were out in teh streets dancing and partying to celebrate his death and people burned the Quran which was disgusting to see in a country that preaches about its freedoms...yet when they danced on american graves and burned out flag, we were furious.

I agree with you , I found it to be terrible that people were dancing in the streets,while I totally understood why though. Now I didnt see anyone burning the Koran, I would disagree with that also. I wish we as American's would have shown a little more class. Now Bin Laden admitted to 911 , therefore, he should have been brought up on charges. Not quite sure what your information was. There are many video's of him stating this also.

He denied being involved with 9/11 three times to al jazeera in the weeks following the event. The only confession was from a poorly translated video the CIA says they found in Afghanistan. Just saying.

So sorry your hero was shot in the eye at close range. I was actually quite elated when I heard the news. You and his daughter will have to get over it, but since her culture seems to celebrate death, perhaps she's elated too. As for koran burning, it's actually just a form of protest in a free society, so I suggest you get over that as well.

He was not my hero, but as an American i like to believe in true JUSTICE not fabricated information scribbled out just to make it easier for me to sleep at night. Also you are proving my point. You seem to support the burning of the Quran in the sake of "freedom"... s it now also in American culture to celebrate death as you have alleged them as doing so? While they are out allegedly dancing on soldiers graves and burning out flag which we took as an insult; We, the American people, were doing just the same as they did when they gathered in the streets in celebration after word of his death. We are a country of hypocrites. We are disturbed by other countries desecrating bodies, torturing people, burning our flag... yet during previous wars and im sure wars to come our soldiers were/are/will be doing just the same...even taking skulls of there enemies home as trophies and other "trophies". Torturing people with allegations that could very well and often are, false. And burning the holy text out of bias towards the Muslims.I do not believe that this country and our society is as free as you seem to think it is

Also, as a reminder, many Muslims and people of that "culture" that "celebrates death" were victims off 9/11 as many were inside the towers during the attacks. I don't think its very fair to say that its their culture that celebrates death and placing terrorists and innocent people in the same category by doing so...because i am very sure they, being of such a culture, celebrated in their terrifying, agonizing, and painful last moments of life.
