LensCrafters Settles Female-On-Male Sexual Harassment Case

LensCrafters, the largest optical chain in the country, has settled a lawsuit accusing the company of allowing a male employee to be sexually harassed by a female co-worker. The company admitted no wrongdoing, but it will pay former lab technician William Sheard $192,500 and will start educating its employees about harassment against males in the workplace as part of the settlement.

The U.S. Equal Employment Opportunity Commission, which filed the suit on behalf of the technician in 2009, claimed Sheard fended off repeated come-ons from colleague Melissa Brandt in a LensCrafters store in Saginaw, Mich., and alleged that management ignored Sheard's complaints because he was a man being harassed by a woman.

"Sometimes people think that a young man -- well, they don’t believe it can happen to a man," Sheard told HuffPost. "They just believe every guy would jump on a situation like that. That's far from the truth."

According to the suit, Sheard started working at LensCrafters in 1998. In 2006, Brandt told him she wanted to have a relationship with him that was "more than platonic." Sheard declined. From then on, Brandt would reference sex acts in front of Sheard, talk openly about his body, touch and grab his chest and backside and tell him she loved him and wanted to have sex with him, the suit claimed.

At a holiday party in 2008, Brandt allegedly tried to grab Sheard's crotch several times, to the point where Sheard had to leave. After repeated rejections, Brandt eventually made a sexual harassment claim against Sheard, a charge she later admitted was false, according to the lawsuit. The lawsuit alleged that LensCrafters management immediately investigated Brandt's charge while ignoring Sheard's.

Sheard repeatedly brought his issues to management -- at first the lab manager, and then up the company ladder -- all to no avail, the suit said. All told, the alleged harassment lasted for more than a year.

Sheard left LensCrafters in 2008, after Brandt's father threatened him at the store due to his repeated complaints, according to court records. The EEOC took up Sheard's case and filed its suit the following year.

Life hasn't been easy for Sheard since his job at LensCrafters unraveled, according to the suit. The situation at work led to stress and anxiety problems, and after leaving the job he underwent psychiatric treatment and started taking medication for depression.

Sheard had worked as an optical lab technician for more than a decade, since he was 18 years old, and finding a new job in the field hasn't been easy. LensCrafters' parent company, Luxottica Group, which was named in the lawsuit, owns many of the retail optical chains where Shears could potentially find work, including Pearle Vision, Sears Optical and Target Optical.

Despite his struggles with unemployment, Sheard said he's relieved that the LensCrafters ordeal is finally over.

Brandt could not be reached for comment, but in a statement LensCrafters denied Sheard's claims that it tolerated sexual harassment. "Much of the conduct that formed the basis of the plaintiff's complaint allegedly occurred when DOC Optics owned and operated the store at issue," the statement said. "LensCrafters agreed to a settlement to avoid the cost and distraction of ongoing litigation."

Female-on-male harassment cases aren’t unheard of, though they are far less common than the male-on-female variety. According to EEOC data, the percentage of males filing harassment complaints has been rising in recent years, from about 12 percent in 1997 to an all-time high of 16.4 percent last year. But EEOC spokeswoman Christine Nazer says the agency doesn't track how many of those complaints are men filing against women or men filing against other men.

In 2009, movie-theater chain Regal Entertainment Group settled a similar EEOC lawsuit, in which a male employee claimed a female co-worker had repeatedly grabbed his crotch. In that case, the victim said management failed to address the situation and instead retaliated against him for reporting it. Regal paid $175,000 to settle the lawsuit.

In a statement on the Sheard case, EEOC attorney Nedra Campbell said, “Sexual harassment is always unjust and illegal, regardless of the gender of the perpetrator or the victim."

This is truly a one sided article. Not all the evidence has been supported here. Nothing was mentioned about the plantiff following the girl, who was supposedly harrassing him, outside when she was going on break. Or, how about when she was taking the trash out and he followed her to the rear of the building to supposedly help her. If he was feeling so threatened by her "years of harrassment", then why did he invite her to dinner on more than one occasion? And, on the evening of the Christmas gathering, why did he leave the gathering and follow her to a local restaurant with other co workers. Why did no one else witness her groping him more than once? The whole situation was mutal flirtation. The girl didn't file a complaint of sexual harrasement against him to store management. She filed a verbal complaint that he was "talking crap" about her for a negative comment she made about another employee.

As a teenager and in my early twenties I was sexually harrassed by older female employees at my first 3 jobs.
1. Paperboy: woman kept coming to the door in her panties.
2. Grocery bagger: older cashier told me she wanted to sleep with me.
3. Paint sales: woman sales associate kept groping me behind the counter AND another older manager woman told me "you have the kind of body any girl would love."

This stuff goes on all of time. None of it was that serious but don't pretend that me don't get this too.

Given the role reversal that's been happening in America in the last 30-40 years - women becoming more aggressive and protagonistic, men becoming more passive and objectified - I think we'll be seeing more of this, especially as women rise to higher stations on the workplace. It's particularly interesting that her reaction to his repeated rejections was to file a sexual harassment complaint against him! Makes you wonder how many other women have filed these kinds of complaints for spite.

The sexual harassment is only because she knows he won't say yes. Be the aggressor and go up to her and tell her you want sex and see how fast her and any of her friends run!!!!!!

This happens to me almost every day only worse. Even if I'm in the front yard watering the lawn cars pull up and stop and some woman I never met wants to talk. I don't care, can't I atleast get the yard work done ? I'll be working somewhere and women there will be grabbing me, and I get away from them and then one of the older ones will punch me for no reason. Why ? Al

I know I should be really bothered by this, I mean sexual harassment is sexual harassment, but the idea that the fellow had to undergo psychiatric therapy because a woman came on to him and tried to grab his penis at a Christmas party seems kinda silly. I know I am wrong here but hey....

No you are not wrong. You are absolutely right.
Exception: If I wanted to keep a job, I had to sleep with the boss & she was built like a boy & had a face, well a double bagger. But that wasn't the really bad part. She wasn't a nice person. She was obnoxious but I needed to keep this really good job so I did it. I have had sex with 3 female bosses, two of them were good experiences but the third was as stated. Of course all of this happened when I was younger & not old & ugly. I never sought a head doctor, I just sucked it up.

Did any of them file false sexual allegations against you or seek to destroy your life and career and have you thrown in prison and labeled a pervert for life? It sounds kinda silly, but then when you read about the crazy stuff she pulled (example: she even told her dad the guy was harassing her and he showed up at work to make an epic scene), I think most of us would need a shrink. This lady reminds me of Jim Carrey's character in, oh, well, most anything. But I was mostly thinking about "The Cable Guy."

He did all the right stuff in order to collect his $192,000. Left the job, claimed anxiety, got a psychiatrist and now life will be better than ever...and he still has the jewels. For a woman to make such a claim, she gets humiliated, degraded and accused of dressing provocatively, or some other stupid demeaning accusation and is lucky if she gets to keep her job. Well, I'm getting carried away. Poor Sheard.

Don't these stores have security cameras? This woman should have been fired for misconduct on the job. When employees are on company time they need to behave in a professional manner. What they do after work is their business. If someone crosses the line and can't keep their hands to themselves they deserve a slap in the face. Shame on this woman, is she really that hard up that she has to throw herself at someone who does not want to be with her? Too bad no one had the stamina to stand up for this young man and put this little harlot in her place.

As for the incident involving the girls' father coming to the workplace to "create an epic scene", the father was calmed down immediately, before the plaintiff even knew he was in the building. As the father was being escorted from the building, the plaintiff stormed from his work area and began assaulting the father, as well as his manager, both of which were injured. After the scuffle, the plaintiff walked off the job. After repeated attempts to contact him to let him know the girl was no longer working in that location and he was to return to work, he ingored all communication and filed a lawsuit. He never lost his job, even though anyone else would have been fired for violence in the work place as well as walking off the job. SO.....Keep in mind, there are two sides to all stories. Only one side was taken into account in this article. I agree that sexual harrassment is uncalled for in any environment. If a person feels they are being harrassed, be they ma\le or female, they need to take all avenues to get it to stop it immediately. However, it's not fair to scream harrassment when you have been playing a cat and mouse game for a long time and are about to get caught in the trap.

There were no cameras in the building. This is a very one sided story. Most of the flirtation between them(yes, it was mutual) happened outside the business. Yes, the girl was an incredible flirt, but so was he. If he was so threatened by her then why did he follow her outside on her breaks, follower her to the back of the building to take trash out and ask her out to dinner, all os which were places where they would be alone together. This went on for a couple of years. He also left the Christmas gathering and followed her to a local restaurant with co-workers where he was allegedly groped yet no one saw this happen. And, where was his wife in all of this. He was never seen with his wife and is wife never escorted his to any of the outside functions that he and the girl in question were at. This situation was a two way street and when it got too hot and heavy he yelled harrassment to save face.

its about time men start turning the tables over and suing women workers. the law should applie to all women workers but most women dont know it does, since its an all male school on sexual harassment where women arent allowed to attend there just as much harassment againts men as there are againts women but just not reported eeoc should have adobted the harassment law to women and not limited to men only
