States Consider Banning Teens From Tanning Salons

LOS ANGELES -- If a proposed law passes, California teens under 18 will need a fake ID to "fake and bake" themselves to a golden brown.

Citing skin cancer risks, legislators have joined lawmakers in at least 21 other states who have debated bills this year to ban or restrict tanning bed use by minors.

Teens under the age of 14 are already banned from tanning beds in California, and older teens need parental permission. But lawmakers in the Golden State are considering banning anyone under age 18 from using tanning beds, even if a parent says it's OK.

Sen. Ted Lieu, who proposed the more stringent legislation, says the parent signatures on permission forms are often forged, and tanning salons benefit financially by looking the other way. The bill has been approved by the Senate and faces review by the Assembly policy committee Tuesday.

Lieu chides vain teens who make a habit of slipping into tanning beds, saying they're short-sighted because "you will age doing this. Your skin will look more leathery later on."

According to the Food and Drug Administration, exposure to UV radiation, whether from the sun or a tanning bed, can cause skin cancer, burns, premature skin aging and eye damage. Approximately 30 million Americans visit tanning salons every year, and 2.3 million of those are teens, the FDA says.

"There is no such thing as a safe tan," according to the agency. "The increase in skin pigment, called melanin, which causes the tan color change in your skin is a sign of damage."

In 2009, a World Health Organization research group classified UV-emitting tanning beds as "carcinogenic," adding that health officials should strongly consider restricting minors' access to sunbeds. WHO, the American Medical Association and the American Academy of Dermatology all support legislation banning the use of sunbeds and lamps for teens younger than 18.

Tanning businesses across the country are feeling the heat.

Along with California, lawmakers in New Jersey, New York and Pennsylvania are considering banning tanning beds for people under age 18. Similar legislation failed this year in Illinois, Maryland, Minnesota and New Mexico.

Legislators in Massachusetts are considering a ban for teens under 14 or 16 in two separate bills. Lawmakers in Florida, Kentucky, Vermont and Washington rejected such measures this year.

John Overstreet, a spokesman for the Indoor Tanning Association, said sunscreen sellers are behind the legislative push and tanning beds are not proven to cause melanoma, the most deadly type of skin cancer.

California's bill is sponsored by the state's dermatology association and a cancer research group called AIM at Melanoma, which lists major drug companies, including Pfizer Inc. and Bristol-Meyers Squibb Co., as its sponsors.

Overstreet said business owners in his trade group worry that the legislation would hurt small businesses already struggling in the current economy. There are now about 878 tanning businesses in California, a number that's seen a 24 percent drop since 2009 because business has cooled, he said.

In areas where teens do a lot of tanning like college towns or affluent areas, Overstreet said, the legislation could mean a 10 percent hit to tanning salons' income.

"UV tanning is by far what people want," said Overstreet, saying tanning is a personal choice that shouldn't be interfered with by government.

"Tanning lamps and beds are designed to mimic the noontime sun, and you use them a measured amount of time," he said.

But according to American Academy of Pediatrics, powerful tanning beds produce radiation levels up to "10 to 15 times higher than that of the midday sun" and frequent tanners get a level of radiation that is not found in nature.

More than a million cases of skin cancer were diagnosed in the U.S. last year, according to the American Academy of Dermatology.

Cancer survivor Lisa Andrews, 41, said she shouldn't have trusted tanning salon salespeople for medical advice. As a teenager, she went in for tanning bed stints one to three times a week in the winter months.

"I've always lived in California, and I wanted to have the blond hair and the brown skin and live up to all that California girl stuff," said Andrews, who now protects her naturally pale skin with religious use of sunscreen. "I remember thinking I was so ugly when I was my own skin color."

At age 35, she was diagnosed with a malignant melanoma on her leg, and she is now vigilant about watching her skin for signs of cancer. She attributes the cancer to her time in the tanning bed, which she also came to rely on for the euphoric buzz she would feel after the experience.

Exposure to UV rays from tanning beds or the sun may be addictive because the radiation may cause release of endorphins in the skin, according to the American Academy of Pediatrics.

For the past five years, Long Beach resident Samantha Healey has slipped into a tanning bed up to four times a week.

"I almost get, like, re-energized," the 23-year-old said.

Healey has worked in tanning salons in California and Nevada and says rebellious teens do try to forge their parents' signatures.

Wayne LaVassar, who owns 14 tanning salons in the Los Angeles area, says he requires parents to come in to sign permission slips at his California Tanning Salons. Requiring in-person authorization would be an appropriate middle ground instead of a ban, he said.

Missouri lawmakers are considering a bill this year that would require parents to sign off on their children's tanning, but similar measures failed in Connecticut, Nevada, South Dakota and West Virginia.

In North Carolina, Ohio and Rhode Island, legislators are weighing whether a doctor's note should be required for teens under 18. Iowa and Washington rejected such a requirement this year.

LaVassar said he doesn't understand why legislation is moving in so many states when tanning beds are overseen by the FDA and parents should have the right to make decisions for their kids.

"I don't believe the sun is bad for you. I believe too much sun is bad for you," he said. "We should be sending a message of moderation and responsibility."

Better to go lay out on one of those beautiful SoCal beaches all day, get 15 times more UVB, turn into a lobster, and then blame it you ails on the five tanning sessions you did when you were in your teens.

Stupidest thing I've ever heard of, even for California. It's about the Total DOSE, not Dose RATE.

Tanning Beds ARE NOT giving people more UV exposure than sun. In fact, they give significantly less burning rays and no more than EQUAL UV-A rays to Sun.

4 MED's (FDA max reddening ray dose per tanning bed session) is approximately equal to a 1:1 ratio to a 20 min bed, summer sun at noon for latitude of Southern California. (draw a line across map)

As for UV-A, Sure there is a lot more per min in a bed than the sun. However, it isn't full of UVA-2 which the sun has a lot of and is shown to cause skin aging. The portion of UVA-1 is in the higher nanometer range (weaker) range, where there is little to NO skin cancer evidence published from anyone. 350nm is approx. 500 times LESS energy than center of the UVB spectrum. 300nm.

So, even though you're getting 10 times the UV-A per MINUTE in a tanning bed vs sun, you are getting NO MORE than 20 min. of summer sun at noon UVB, and get the equivalent of an 1-1/2 to 2 hours of UVA. (each side) but only 3-6 times a month.

Total Exposure per month is MUCH less UVB and at worst EQUAL to someone tanning outdoors to achieve the same color.

All without the controls of indoor tanning. All without the eyewear etc.

I see what they are trying to do here, but I also agree we have far bigger issues with our teenagers... Underage drinking, smoking, sex.. Which each of these can be just as deadly as a tanning bed. If we could get rid of the ideal that girls need to be tan to look beautiful, it would not be such a huge issue. But when you have show's like Jersey Shore on tv, where tanning is one of their beauty regimens, you are bound to have young kids/teens who think its the only way to be attractive.

The only thing I worry about is even with parents approvale, the law would say no. so here is another law trying to take rights from parents. that sould never be!!!. leave parents to be parents. we don't need any laws preventing this.

Nanny state can't do that. Don't you know we are all too stupid and have to be told what to do by the gov't. This one will be challenged, just like the violent video law, will be overturned, and responsibility turned back over to the parents. Thank God for checks and balances. Now, will the parents be responsible enough to do the right thing?

I also heard having sex at a young age might cause cancer. I know it causes babies,

burdens on the girls parents and a lot of money from the government.So don't worry about tanning beds, get on the teens having sex. Get on the boys making these girls pregnant and then walking away. Bristol Palin good example.

Keep making rules and we might be living under little Hitler's. None of the governments business..

Why don't these egg-heads who make up these rules really take a challenge and stop teen sex.

In my area I still see to many kids under the age of 18 SMOKING! What's being done to stop them from getting their cancer? And out of the two which one is worse? Plenty of under aged teens will be getting into those salons with no problems. Plenty owned by friends of others parents that will make it easy. Some will let them in to keep a business going. To much fall in money will hurt.

Stuff like this makes me SICK. Heaven forbid you let your teen tan in a controlled enviroment where the risk of burning is so minimal. Let's instead force them to go outside where they have NO idea what type of ray they are recieving or how much. So they can then blister and burn, and 50 years down the roads the government will be happy because they have 10 million skin cancer patients which they can then tax some more. Also, let's go ahead and kill small, mostly women owned business' while we are at it. Bravo California, you are total idiots.

Do you have any idea how high tanning in a bed makes your risk of getting skin cancer? The risk of burning is FAR from minimal in those beds, having watched many of my friends walk out of salon's with "tans" that are extremely painful. Especially in youth, as most of the damage (tanning in and of itself is damage to your skin, no matter how "hot" you look) that ends up causing cancer happens during your teens and early twenties. I'm the only woman in my family who has yet to develop any kind of cancerous or abnormal skin growth (despite being the palest and most fair-skinned one) and I'm the only one who wears sunscreen consistently and avoids these things at all costs. Try watching your mother, your sister, your grandmother, your aunt have melanoma, and you wouldn't go near one of these again, trust me.

Tanning in a bed is a controlled envrironment. Tanning outside is not.
The following news article regarding tanning and exposure to sunlight is from today. The crux of the story? Tanning is the only way your body naturally produces Vitamin D. Vitamin D prevents cancer. Vitamin D prevents SKIN CANCER.

"The thinking is, improving your vitamin D status, whether by supplements or by exposure to sunlight, you are providing your skin cells with a mechanism to prevent them from becoming malignant," he said.
What role calcium may play is unknown, Dr. Holick said. "We don't know whether vitamin D can have its effect in the absence of calcium or vice versa; there's rationale for both," he said.
Dr.Holick said he thinks the finding would be the same for men and other groups.
People can get their vitamin D from diet, sun exposure and supplements."

Sadly I know a number of women my age who were really into tanning while in high school and now aren't able to have babies. I think its a good idea to maybe "limit" teenage use but not ban them from tanning completely.

.....btw I'm 31 and I know ladies in their 20's that have the same issues. I can't help but think while laying in the tanning bed they were "frying" their eggs (kinda silly I know) but how else is there to explain it! In FL everyone is tan and these young ladies were loyal to their tanning appointments and now here they are some 10 years later unable to have children...its sad.

wow...REALLY? You actually think tanning causes infertility?? I havent heard this one since I was in the 9th grade. Tanning is light. And light, whether its from a lamp or the sun does not penetrate beyond the outermost layers of your skin. It CAN NOT "FRY YOUR EGGS"........ "(kinda silly I know)"....no, its more than that, its ignorance. Please educate yourself. HOW ELSE IS THERE TO EXPLAIN IT?? Ok, for starters, how about a polluted atmosphere, steroids and hormones in our meat, chemical additives in our food, pesticides on our fruits and vegetables, smoking, drinking, drug abuse, lack of proper nutrition, lack of exercise, high blood pressure.......but no, YOU say infertility is caused by tanning. wow.
