What Gay Marriage Means For Gay Divorce

(Reuters) - As New York's same-sex couples head to the altar to celebrate their newly won right to marry, they can take comfort in the fact that, if it doesn't work out, their right to get divorced in the state just got a lot easier as well.

State senators on Friday voted 33-29 to approve marriage equality legislation introduced by Governor Andrew Cuomo, a Democrat in his first year of office. New York will become the sixth and most populous U.S. state to allow gay marriage.

Given our small percentage of the population, this will hardly be a profitable market segment.

What it means is the risk of divorce court and having the state control your life and assets. 50% marriage ends in divorce. Why copy a heterosexual failed system of out dated religious law?

Straight divorce is such a horribly lop sided unfair process. My question is - who will the courts favor when the genders are the same? :)

Perhaps gay divorces will expose the fundamental unfairness of heterosexual divorce?

Massachusetts continues to have the lowest divorce rate in the country. This was true before same sex marriage and has been true after same sex marriage. So far there have been a couple high profile same sex divorces, but no floodgate. Of course many same sex couples thought long and hard about marrying before it was a legally meaningful option. My husband and I had been together 16 years before marrying in in Boston in 2007. One local gay couple I met had been together 49 years before marrying, another pair were sweethearts for 19 before they wed. Not all gay men fit the stereotype of promiscuity and short term relationships.

And they usually don't get pregnant and aren't forced to marry while they are going through their young promiscuity stage.

It will be interesting to see if some attorneys will specialize in this area.

I would guess probably not - there always have been, and there always will be few gay people.

Further, with the genders being the same - the chance for blow out settlements is pretty much nil.
