Legal Experts: Casey Anthony Will Be Released From Jail

ORLANDO Fla. -- Casey Anthony is still behind bars, but by Thursday afternoon she may enjoy her first day of freedom in almost three years.

According to legal experts with whom The Huffington Post spoke, there is little doubt that will happen.

"The judge has limited options," said Mark NeJame, the veteran attorney and legal analyst who once represented Anthony's parents.

"He's looking at four misdemeanors, which he could stack or run concurrent, but she's already served most of the time," NeJame continued. "The reality of it is that it is very likely he will say the jury has spoken and you've done a lot more time than most people do on these charges."


On Tuesday, Anthony, 25, was found not guilty of killing her 2-year-old daughter, Caylee. She was also found not guilty of aggravated child abuse and aggravated manslaughter of a child. However, she was convicted on four charges of misleading law enforcement.

Famed Seattle attorney Anne Bremner, a regular legal analyst for several national media outlets, agrees with NeJame.

"There are four misdemeanors and each has a max sentence of one year in jail," Bremner said. "My belief is that she will be given one year on all four, credited for what she has already served and released tomorrow."

Anthony will learn her fate Thursday morning when she goes before Judge Belvin Perry for sentencing. Regardless of the outcome, Anthony's acquittal has ensured that she can never again be tried for her daughter's murder because of the double jeopardy clause in the U.S. Constitution. Prosecutors are also unable to appeal her acquittal.

There has been some speculation online that she could be tried in federal court for violating the civil rights of her child, but Bremner said that is not possible.

"You can only violate someone's civil rights if you’re acting on behalf of the government," Bremner explained. "The violation would have to have been committed by law enforcement, the state or some other government agency."

And what of Anthony's future? According to NeJame, she can earn as much money as she wants to by selling her story.

"Can she profit? Absolutely," NeJame said. "There is no legal prohibition against her profiting."

Anthony's legal problems, however, are far from over, the veteran lawyer explained.

"She was served today with a subpoena for a civil suit filed by Zenaida Gonzalez and has to appear for a deposition in two weeks," NeJame said.

When police questioned Casey Anthony about her daughter's disappearance in July 2008, she blamed a woman name Zenaida Gonzalez for taking Caylee. The woman suing Anthony shares the same name as the made-up nanny.

NeJame said one of his regular clients, Tim Miller, founder and director of Texas EquuSearch, the missing person search and recovery group that looked for Caylee in 2008, is also thinking about filing a lawsuit.

"Miller is considering suing her for the $114,000 Texas EquuSearch lost when the volunteers came out," NeJame said. "I had to pass on that," he added. "Having represented [the Anthonys], I was not going to get [involved]. Tim has a Houston attorney [who can deal with it."

Tim Miller did not immediately return calls for comment from The Huffington Post.

The Orange County Corrections Department released a statement earlier Wednesday, saying it is their agency's policy to "release a jury-acquitted inmate from the courthouse under normal circumstances. However, due to the high profile nature of this case and intense, emotional interest by the public, appropriate measures will be taken to release the acquitted into the community in such a manner so as to preserve the safety of the acquitted individual and the public."

Casey Anthony and her family have already received death threats, so extra security measures are being put in place for her release, NeJame said.

"They are going to take her and process her out of the jail and then have a car in a secure garage so you won't know which vehicle leaving is her," he said. "Is it special treatment? No. I think it is preferential treatment but appropriate. Her safety needs to be safeguarded as well as public."

There is also a possibility that Anthony might not even be at the courthouse Thursday morning, Bremner said.

"Remember Mary Kay Letourneau?" she asked.

Letourneau was a 30-something elementary school teacher from Seattle who, in the mid-1990s, was convicted of having sex with a sixth-grade pupil. Sentenced to seven-and-a-half years in prison, she was released in August 2004. In an effort to avoid a possible mob scene, authorities released Letourneau around 1:30 a.m.

"That's an interesting angle," NeJame said, referring to Bremner's comment. "This judge is not afraid to work nights, weekends and holidays. The fact of that matter is that as despised as she is by so many, I think it would be appropriate for law enforcement to extend those considerations so mob mentality does not take over."

It remains unclear where Anthony will go once she leaves state custody. Her parents, George and Cindy Anthony, have declined multiple requests for comment. Instead, they released the following statement through their attorney, Mark Lippman:

"While the family may never know what has happened to Caylee Marie Anthony, they now have closure for this chapter of their life," the statement read. "They will now begin the long process of rebuilding their lives. ...The family hopes that they will be given the time by the media to reflect on this verdict and decide the best way to move forward privately."

A source close to the family told The Huffington Post Wednesday afternoon that the Anthonys have arranged for Casey to stay with an aunt in Texas.

I sure hope someone takes care of her in a not so good way... My family is in Houston and if she crossed my path when I visit, believe me, it would be UGLY for her! BUT in all fairness, she is not wanted anywhere!! I have no idea how and where she can settle down. She will never be able to run to Target or Walmart to grab something, I think the world is going to treat her as bad as she treated Caylee, and she deserves it!! GET HER TEXAS!! DON'T LET HER FORGET WE KNOW THE TRUTH AND KARMA IS, YOU KNOW WHAT!

I am beginning to think CAYLEE did drown, in the swamp!


With having been perhaps put to sleep, and then thrown in the water, enough to drown her with duct tape over her head, that little heart on the tape, is what the Killer would do, a final goodbye sweet daughter.
I would like to know the truth, and I have to say, having witnessed a trial like hers, high profile, the molestation claim is pretty common to defense attorneys. And no Mr Baez, you did not save a life, God saved her life, you were only HIS tool perhaps. I do think you did a good job for what you were hired for.
I do think that George the father knows much about this case,,,,,he knew she was perhaps in the swamp when he was saying get the F off of my property to this reporter..And trying to commit suicide, guilt guilt all thru that note he left.Also, Too hostile, bad cop, Sleeping with the young latino girl,( I'd hate to be her right about now) shows Casey's dad was a liar. I understand all emotions are running high. I would have executed Casey, myself. However, I also would like to believe this place is a forum for speaking our opinions as we are allowed to do in this country. Be angry, be sad, be indifferent but try to get involved in the new Casey's Law that prevents people from making money from her death. Please, try to be civil toward each other in your posts. This is not a forum to attack each other.

I do hope that she crawls under some rock somewere (not in L.A. please) better yet I hope the media makes her life holy he?? and I don't mean TV deals, movie deals, book deals just follower her EVERYWHERE. The jury verdict was justified. The prosecetion did not make their case. Here's why,
What - Caylee is dead and should not be dead.
Where - Unknown
When - Unknown
How/Cause of Death - Unknown (A theory, based on circomstantial evidence via chloroform/duct tape was offered by the prosecution but not connected to Casey)
Why - So Casey could party with friends more often? Really? Caylee's grandparents obviously loved her and had no problem baby sitting
Who ... The Big One - Casey was not placed at the crime scene. Where and When unknown.
The prosecution did not make their case.

Casey never stalled, delayed, lied or conspired to keep the body hidden so that it could be deteriorated to the point the manner of death could not be detected..nor time. Alas the prosecution did not prove their case the wicked witch will soon be set free click her red shoes together and buzz off to Kansas to live happily ever after.

oh don't worry...she'll be doing anything but "living happily ever after". i think PLENTY of people have plans to make sure she doesn't live too much longer. i'm sure she'll be deceases very shortly after she's released. the defense strategy has backfired immensely because now it seems she really will get the death penalty....

The law states the prosecution does not have to prove those things. Cases have been one without any of those, even motive, being proven. If you have followed this case in its entirety, you could only find her guilty. If nothing else, she admitted not reporting her child missing for 31 days. That should have, at the very least, convicted her of aggravated child abuse.

She can never be tried again in a court of law for the death of her daughter, but she will be judged every day of her life by every person in contact with her. She is a souless, vindictive psychopath who blames anyone in her life for her shortcomings. The defense team is going to take her to a safe place because she's "lost" her daughter. She had that child with her and the kid was missing for 30 days and she lied over and over about it. And IF she knew that she drowned, then how did that baby end up with duct tape on her and in the swamp? She is responsible for that child's death. She may think she beat the system but she will end up in one system after another until she dies. And she'll be scamming someone, somehow all the time.

Regardless what she writes,doe's a movie,bio,anything even if she were to day yes I did it she cannot be retried over this period.The thing I don't like is that the one juror speaks out now that she voted and her words not mine.I am sick to my stomach now.She was asked under oath was she pushed or threaten in anyway and was this her vote and she replied yes it is.In no terms was she threaten or anything so to me if she had an ounce of not being sure she should have stood her ground and held out,if you noticed the verdict sure came back quick within ten hours I believe they said.They said they could only go on the evidence and no one knew how Caylee died.Not anyone not the coroner anyone so if that is the case she would be as guilty as Casey for lying.So what is good for one should be good for another.Had I voted with the evidence and remember you can't vote how you feel even if you felt she did it they were instructed to base all decisions on evidence not thoughts of their opinion and I believe that is what they did.The one juror feeling sick is because deep in her heart she believes Casey did it as a mother but leave it a lone now she is going to make herself look stupid more then she already has...

Shine ..the smug Ms Jennifer Ford looking for her 15 minutes of fame and $$ realizes now that she uh messed up and is not winning friends or influencing enemies. Now she's afraid...duh she did not have to put herself out there and she did. You reap what you sew. Not too bright to say ...."WE FOUND HER NOT GUILTY....I DID NOT SAY SHE WAS INNOCENT". Seems a juror who found a woman not guilty but not innocent should feel a few wrinkles in the sheet at night. But Jennifer Ford was a peer to Csey Anthony.....just look at her seeking the limelight, smug, know it all and thinking she can "explain" away everything and anything.
