LIBERTY, Texas — DNA testing delays prompted a judge Wednesday to push back until October the cases of 14 men accused of taking part in a series of sexual assaults on an 11-year-old girl that have horrified and divided their small southeast Texas town.

The men are part of a group of 19 individuals charged in the alleged assaults. Twelve of them, including one who remains jailed, appeared in state district court for status updates on their cases. Two others who remain jailed did not appear in court but also had their cases reset.

Prosecutor Joe Warren asked for delays in the cases because it could be another four to six weeks before DNA testing of evidence is complete. The testing is being done by the Texas Department of Public Safety.

"I'm going to pressure the state to pressure the DPS lab to get whatever analysis as quickly as possible," state District Judge Mark Morefield said.

Morefield reset the 14 men's cases for Oct. 3. Five juvenile boys also have been charged.

During the hearing, Warren told the judge his office was in tentative negotiations with at least one of the defendants, Jared McPherson. Warren did not say if he was referring to a possible plea agreement and he declined to comment after the hearing. McPherson's attorney also declined to comment. A gag order is preventing those connected to the case from commenting.

The investigation began in December, after one of the girl's friends told a teacher he had seen a lurid cell phone video that showed the girl being raped in an abandoned trailer. The case became public after arrests were made in February.

Authorities say the girl was assaulted on at least five occasions, sometimes by as many as seven or eight young men or boys at a time, from mid-September to early December in Cleveland, a small town about 45 miles northeast of Houston. Court proceedings are being held in the nearby town of Liberty, the county seat.

The suspects range in age from a middle-school student to a 27-year-old, and include two star athletes at the local high school as well as adults with criminal records.

Most of the adult suspects face charges of aggravated sexual assault of a child, while four face a charge of continuous sexual abuse of a child. Most have pleaded not guilty and are free on bond, while one, 26-year-old Marcus Porchia, was charged after his arrest with sexually assaulting another girl in an unrelated case. Porchia, who remains jailed, pleaded not guilty on Wednesday to the sexual assault charge in the unrelated case.

The case shined a sometimes unflattering spotlight on Cleveland after some in the town of about 9,000 residents suggested the girl was culpable in part for what happened, claiming she wore makeup and looked older. Some also accused her parents, immigrants from Mexico, of not watching her more closely. Those suggestions were sharply criticized by many Cleveland residents and by community and religious groups outside the city.

Also complicating the case was a belief by many in the predominantly black neighborhood where several of the suspects live that the arrests were racially motivated. All of the suspects are black, while the girl is Hispanic.

The girl, now 12, remains in foster care while her parents, who have health problems and moved out of Cleveland after receiving threatening phone calls, work with state child welfare authorities to get her back.

I've been to liberty Texas and like so many places they have girls dressing like hoochie momas it's sick to see a liitle girl so under dressed that pedos turn into something like a crack head trying to get them and these boys will grown into adult hood as pedos.
Parents quit letting your daughters dress like hookers there just kids that sponge everything around them if you don't want to be grandparents then tell your little girl about the problem with skimpy clothing and the mentality with teen boys and one more thing tell them to not go into an ugly trailer with 18 out of there mind males thats a plus.If it were up to me I would have these people casterated and medicated for 20 yrs.Why show them mercy?.He11 with them.

Yeah the problem isn't how a child or a woman dresses it, in the head the rapist. By saying all you did about girls and their parents you are putting blame where it does not belong.

Sexual assuault. I hope they are tired on more than just that. I would like to see if Texas has laws on the books about human trafficing. This was on going, over several months, more than just a "simple" rape and the pictures put out on the cell phone is in its self illegal.

I will say one thing...if this small town had this many young men that took part in this crime...and I lived there with a daughter...I would be packing my bags.

Here we go again. The culprits in the case are black; therefore this is a case of racism. I won't give my gut reaction to this story, though it is right more than 99% of the time.
We will now spend the next year hearing about the "racial injustices" in this country, the psychology caused by poverty, the cultural differences that exist within the American social fabric.
In other words all the same BULLSHIT we always here. The first will be "What we have here is a situation where all involved parties are VICTIMS". The next will be "These young men here should not be on trial. America should be on trial". Look for the usual suspects to show up and exploit the moment (Sharpton, Jackson, Mathews, et. al.)
We have seen this show before. We are going to see it again, and again, and again.
For a change lets not lose focus of the crime. Oh, sorry. I forgot when and where we are living.

This is one of the most outrageous and saddest things I've ever read. There are people in that town that actually believe the 11 year old girl was at fault because of the way she dressed and acted? SMH. No mater what, she was raped! She had sex against her will and even if she had consented the law says that she's not even old enough to do so! She wasn't violated by one man, but 18+ And some of them were adult men. I try not to judge, but then your faith is tested and you find yourself saying things, "What a disgusting and dispicable group of animals'!

It sounds like it was consentual .Since it happened 3 times she most likely went along with it.That's probably why they got bail except for the one who was implicated in another sexual assault. They are going to go to jail but i wouldn't be surprised if the sentences were lighter than usual. The truth is if it was a white girl they would be locked up right now. That's not playing the race card that's reality.

Minors cannot legally provide consent to sex. If the victim was 11, she didn't consent and any sexual contact with her was, by definition, a form of sexual assault or rape. It may not have been FORCIBLE rape, which is a significant distinction, but it was rape.

fscuttle, I hope you are being sarcastic abou tit being consensual, but if not let me point out that in no state in this country can a 11 year old child give consent to have sex. Please keep this in mind the next time you hit up a middle school for some action...also, please never never have children.

it takes a village to raise a child and it seems to me that this entire town has let this little girl down, except for the bravery of one young man, who has more common sense and compassion than all of those monsters put together. i find it hard to believe that no one else in that community knew what was going on with this little girl. if people would pay as much attenion to a childs cry as much as they do a dogs howl, maybe this child wouldn't have been abused this long and that goes for all of the abuse in this country. i'm not saying i'm for animal abuse either, so calm down. i'm just saying we'll turn our heads at the grocery store when a mother is slapping her child around because we don't want to get involved but leave a dog out a day without water and see what happens. again, it takes a village to raise a child and we all need to start doing more to get involved to save our innocent children.

There is a big difference between disciplining your child with a little smack and abuse.That line is getting blurred. Not condoning what these guys did because i think they should be punished to the maximum extent of the law but do you really think this girl is your typical 11 year old? She went back 2 more times! Society failed this girl way before this crime was committed.

How do you know she "went back" don't you think it's likely since she' s a little girl and there multiple teenagers/grown men, she was taken against her will?? And even if she was "begging for it" she's 11!! She can't give consent!!

Sodom was not the location and Abraham has been gone forever. This was a group of todays black males raping a young girl,knowingly doing wrong. If your all mighty God is so great why is the world the way it is? I lost all beliefs many many years ago,you may as well worship a golden idol yourself. Researchin­g Cleveland, Texas, I read there was a black man accused of stealing a pen, 1990-somet­hing, and he was beaten to death by white officers while in prison. The officers were acquitted.

There are racial issues in Cleveland for sure, but now is not the time to play out this race war. The issue is the fact that a child was raped repeatedly by men and boys. There is evidence. Whatever the circumstan­ces, whoever the perpetrato­rs, the crime is statutory rape.

Justice has to be done so that this will never happen to another child in Cleveland. Texas....a­nd Cleveland needs to do some serious introspect­ion.

On going, Three city council members are charged with corruption and recall, but County DA is boyfriend of one of them so , well, you know....ma­ybe the state could investigat­e.

Just did some googling on Cleveland texas and this "incident." Since the saw mill closed, wallmart and the prison are the biggest employers. Town is half white, who dominate the town and its institutions, and the other half, Hispanics and Blacks. There is a history of racial crimes. Bottom line, seems to me, this is a very sick and dysfunctional town, where there is no trustworthy safe haven available or justice.

Now outside activitists are involved taking sides Blacks against Hispanics. I would hope in this case, justice would be blind to color and focus on why this little girl had no help to turn to. There is no way an eleven-year-old girl would willingly participate in these rapes. Furthermore, what would make it ok, according to these men and boys, to rape a child repeatedly and take photos of it? Don't any of them have a conscience? A town of 7,000+ is not that big and probably pretty much everybody knows what is going on at some level. Half the town looks the other way?

My training is in anthropoloyg and I can't help but look at the bigger picture. In my opinion the whole town should be indicted. This should never have happened.
