Casey Anthony Trial: Verdict Leaves Public With Many Unanswered Questions

Caylee Anthony

TAMARA LUSH   07/10/11 03:50 PM ET   AP

ST. PETERSBURG, Fla. — Many of the thousands who followed the Casey Anthony trial did not get the guilty verdict they wanted, nor did they learn the truth about what happened to the 2-year-old daughter she was accused of murdering.

And for the public, that may be one of the most frustrating parts of the case: Despite all the speculation and theories, they will never know how or why Caylee Anthony died.

"I think we know as much as we ever will know," said Beth Hough, a 27-year-old administrative assistant from Chicago who followed the trial. "We don't know exactly what happened, but if we did, it would help people to finally just move on and to end the story."

That's what's missing: an ending. And because we're so used to neatly packaged, hour-long TV crime dramas where the bad guy is usually put behind bars, the fact Anthony could be convicted only of lying to police has left people unsatisfied. And they have been vocal about their dismay, turning to Twitter and Facebook to vent their frustration.

So what's left? Some fuzzy defense claims that little Caylee drowned and that her grandfather tried to make an accident look like a homicide.

"One of the quite healthy and appropriate satisfactions we get out of a well-functioning justice system is the belief that the justice system will give us the best answers to questions," said Doug Berman, a law professor at Ohio State University.

A little girl ended up dead in the woods near her grandparents' home with duct tape over her mouth, and her mother didn't report her disappearance for more than a month. But how did Caylee die?

That's where it gets complicated.

The defense said Caylee drowned in the family's swimming pool. Prosecutors couldn't say how Caylee died because the girl's body was too decomposed to harvest DNA or other forensic evidence. So the state relied on circumstantial evidence: the trunk of Casey's car smelled like a dead body to some witnesses; someone did an internet search for chloroform – a chemical that can be used to knock someone unconscious – at the Anthony home; and there was duct tape on Caylee's skull when it was found six months after she was last seen in June 2008.

"If we don't know how Caylee died, we can't assign responsibility for the factors that led to her death. So there's no justice," said Maryann Gajos, a 51-year-old mother of two and a sixth-grade reading teacher in Inverness, Fla. "Watching all of these crime shows has spoiled all of us. In TV shows, the coroner always has the answer."

But in this case, the coroner didn't have the answer. Dr. Jan Garavaglia told the jury that Caylee had been murdered, but she couldn't establish exactly how she died from only a skeleton.

And in the life-imitates-TV irony of this case, Garavaglia is also the star of her own reality TV show on Discovery Health Channel called "Dr. G: Medical Examiner," in which she solves cases through autopsies.

"It's frustrating that they can't come up for a definitive reason for this girl dying," said Sherri Cohen, a self-employed photographer from Fort Lauderdale, Fla. "Archaeologists can tell you about bones that were found thousands of years ago, but they can't tell you how a 3-year-old girl died three years ago."

How Casey Anthony acted in the weeks and months after Caylee's disappearance also contribute to the perception of whether the jury ultimately delivered justice.

"I feel that the way Casey Anthony behaved during the month her baby was `missing' and her lies to the police and others have really frustrated people who want to see justice served," said Marjorie Stout of Pinellas County, Fla., the same area where the jury was chosen because of the intense publicity in the Orlando area. "Not just for what is perceived to be murdering one's own child but her lack of concern for Caylee as well."

Berman, the Ohio State professor, has another theory about why folks are so frustrated: Casey Anthony never spoke. The defense made a strategic decision for Anthony not to testify – a decision that clearly worked in her favor, he said.

"It's not just that the jury decision came out differently than we had hoped, it's that the jury decision wasn't a statement of her innocence. It was a statement of `We can't figure out what happened.' And in some sense, that's even more frustrating than if the jury said, `We don't think she did it.'"

That's only amplified by the circumstances surrounding the case. After all, plenty of people are acquitted at trial because there isn't enough evidence, said Jennifer Zedalis, a professor at the University of Florida Levin College of Law. But, she said, "there aren't a lot of cases where that happens where the victim is a 2-year-old and the mother was out partying when her daughter was missing or dead."

It sucks that this little girl died but lets move on already. Over the past 10 years we have lost 5,000 men and women in two useless wars and that dosent count the 300,000 plus men, women, children who just happen to have the bad luck of being born Iraqi.

The center for missing children estimates that over 800,000 kids go missing in America every year.So it sucks that this happened, but it is not news anymore.

Not to mention that every year malaria KILLS > 500,000 children in Africa.

Haven't you heard of parents who knock their kids out with Benadryl, or cough syrup or the like? Why would Casey go to the trouble to cook up chloroform?

After a bit a research, you'll find that chloroform is used in the kid porn industry.

she dropped out of high school - and is probably not that bright. the only thing she excelled at was lying.

I do not see how any of you could convict Casey of murder. Yes, she may be a terrible mother and person. But that simple fact does not convict her of murder. Because the fact Caylee's body was outside for so long to where the tissue began deteriorating no autopsy could determine cause of death. How can you possibly convict someone of murder when the investigators and prosecution do not know the cause of death. You simply cannot convict upon emotion, you must convict upon concrete evidence that goes beyond reasonable doubt. And this particular case had no concrete evidence.

Judges instruct jurors that they do not have to dispense with their common sense or life experiences in their search for the truth. If there were 100 cases of a 2 1/2 year old child, not reported missing for 1 month by their mother, who were found dead, wrapped in their own blanket and items from the home, in a water filled swamp, less than a half mile from their home, I dare say their would be a 99% conviction rate, .Add to these facts the lies to everyone, grandparents, siblings, friends and authority figures. Compound it with the carefree behavior, even on the same day the child was unaccounted for. Parents are charged to care for and protect their children. Parents are even held responsible if their children are excessively absent from school.

You really dont know the law Plenty are convicted on circumstantal evidence. Cause of death is unknown in many cases people have been convicted of murder without a body the evidence was the baby was deadtape on her skull etc
05:53 PM on 07/17/2011
No You don't know the law. Just because miscarriages of Justice take place in other cases does not mean a miscarriage of justice should be welcome in this case.

Had you followed the case carefully you will know by now that the presence of duct-tape near the skull was hardly clear evidence.

- The duct-tape could have been moved by animals so no expert (not even the state's experts) could say with certainty that the duct-tape was place there when she was alive or after death, or even after decomposition. Therefore your so-called evidence just demonstrates ignorance of the facts
- The state's own witness admitted at one time he had touched the skull and moved it, then recanted. He claimed to have seen a skull out of a bag 3 months earlier but somehow the skull found itself in a bag when it was found. So was the skull moved or not. Do you know for sure. If not, you can not conclude that it's final state reflected how the child died. Therefore any duct-tape around the skull means nothing.

Most people shouting guilty, simply have no clue what the evidence did or did not show in this case.

i dont see how any of u can argue the Anthony verdict. There was no DNA, unfortunately, because the fact Caylee's body was in the swamp for so long that no autopsy could determine the cause of death. How can you even convict Casey of murder when you do not know the cause of death? That is beyond me. And there was no concrete evidence that linked Casey to Caylee's death. Nothing the prosecution presented in court convicted Casey beyond a reasonable doubt, which is how our justice system works
01:46 PM on 07/17/2011
Seems we're heading toward "beyond UNreasonable doubt" with the advent of CSI-type TV shows. No narrated video = No conviction.

What more can come out? the prosecution had 3 years to build their case. Maybe what should come out is why a grand jury elected to spend the money & man hours to prosecute a case that had no actul evidence?
05:32 PM on 07/13/2011
The more I listen to these jurors.......the more absolutely positively sure I am that they have the brain efficiency of a common house fly...or LESS THAN THAT !!!

I am not angry, I am disgusted. They keep saying (jurors) that they did their "job". Yeah, right. According to the Foreman...(OY, he most likely writes with crayons) he didn't think that her behavior ON THE NIGHT OF THE DEATH OF HER CHILD..should be considered! If life is like a box of chocolates..then he is a box of rocks.

It appears to me as if the jury didn't understand their instructions. I also heard that same thing; that they didn't think they could 'consider her behavior'. WTF?

They also did not consider the duct tape found on the child's skull, or the chloroform , as substantial evidence. But they did with the drowning theory. I really do not think that they understood the whole process. They need to stop talking, because they are making themselves look foolish.
11:58 PM on 07/17/2011
my thoughts exactly.

(the jury foreman was troubled by george anthony's inability to remember something innocuous about the gas can - but not about casey's lying from the pregnancy on out - no job - hiding it for three years. what the heck do they think she was doing for nearly three years? the cell phone pings of hers by the house, the duct tape, the borrowing of the shovel, the cholorform searches, the LYING, the rages caught on tape, the self-centered narcissism and NEVER asking about her daughter or shedding one tear for her, the laundry bag, the winnie the pooh blanket, the heat-shaped sticker...and on and on....so weird!) ugh!
07:52 AM on 07/13/2011
It's good to know that all you have to do to get away with murder is make sure the body is disposed of well enough so that the coroner can't figure out the exact cause of death.
08:19 AM on 07/13/2011
True,,,AND make sure that you have a jury that doesn't think that the TV show "CSI" is a Science documentary..

How many of us would be convicted if they found something like duct tape, knives, rope, bleach, etc.. in our homes? All of us. To convict someone of murder, thank God we live in a country where you still need proof of the actual murder and not silly people like us on bligs who convict based on sound bites. Now about states cutting off planned parenthood, union rights, and voter rights. Are we all pissed about that too?

Take the pledge:

You will not buy any books she or her attorneys publish, nor see movies that enrich them.

If you find her living next door to you, you'll call the press (to keep her under pressure).

You will boycott entities that enrich her -- and let them know you are doing so.

You'll be a better, more diligent juror than hers were (if/when you get called).

How much money do you think each network charged the advertisers when they had their one hour specials devoted to "the Casey Anthony trial, the casey anthony verdcit, after the verdict" etc... Are you kidding me. Fox and MNBC made more that week than Anthony could even comprehend.
How about an even better pledge. You will write to any news organization and demand that they not sensationalize another missing person ever again? Not when we are facing the worst economy in history, partisan politics that threaten our future, corporations selling out the American workforce to increase profits, and attacks on voter and womens reproductive rights. I will sign that pledge for sure.

It may help to google "narcissism" and read half a dozen entries. You'll get the complete picture of who this person is and understand that change will never take place. It won't make you happy, but you'll quit trying to push that particular sisyphian rock up the hill.

A motion has been filed to release the "mystery" video, showing Caseys' reaction after lil Caylees body was found. I heard also that Casey told another inmate that she (Casey) did use cloroform to put Caylee to sleep so that she could go out at night. Here is a link to that, but I aplogize for the commercial.

Couldn't have been, and that surprised me because Casey confessed to this "Robyn" in writing. The same Robyn who she corresponded with in those jailhouse letters. I've read a lot of the jailhouse letters, but obviously not the ones confessing to 'no Zanny and the cloroform.' I believe Robyn was moved to a federal prison, but not certain just where she was moved to.

She also told one of the investigators that she used Chloroform on Caylee to make her sleep . There is a Florida station that has all of the information on its website.

I just listened to that "nursing student" juror.

(LORD, don't let her read anyone's med chart!!!) .

She admitted that there was "circumstantial evidence" but nothing concrete....

Sickening...sitting in a Jury box....and this ignorant of the instructions.

This jury denied Caylee any rest, perversely and wilfully,a bucket of DNA and video would have been rejected, they dressed up on the verdict day sure to find an adoring tv audience but were met by an incredulous public. They were unwilling to consider any evidence and their interviews only confirm their malignant stupidity.

This jury didn't need to know exactly how Caylee died to convict Casey. Many people have been convicted on far less evidence. The foreman was on FoxNews tonight speaking about reasonable doubt. After he was finished I can say that I have no reasonable doubt that he is a total wuss.

There have been a number of convictions without a body being found. But that takes jurors with brains and the ability to reason.

If they were shown a picture of a child with an empty candy wrapper and a sticky mouth, they would conclude the child swallowed an automobile. What a waste of space they were,I hope they all end up on milk cartons.

These total imbecilic Dirty dozen jurors are showing their aptitude..which is TOTAL ineptitude.

The Foreman..dumber than a door knob man was suspicious of George and thought that the Mother who lied cheated stole hid her child's death and had a sex-a-thon...was "not guilty"?

THIS GUY NEEDS A BRAIN TRANSPLANT....he may actually already have room in his empty head to just slide it in.

The "foreman" who just spoke out on Fox News indicated that he felt there was a chance that George himself killed Caylee!! Huh?! What would have been the motive for that? Clearly, this individual is not the brightest bulb on the tree. He also repeatedly said that Caylee died on the 15th. When it was the 16th.

This has become a tragedy upon a tragedy. Justice was NOT done. And I will not be told I must have respect for the jury and their decision.

Wait a minute. I just saw Wendy Murphy on TV. She claims that some pictures of Caylee were kept from the trial because they were prejudicial. She also claims that Caycee was pimping out Caylee and one of those people killed her.. How ridiculous is that? If that is the case, the feds would have gotten involved. I know that Ms. Murphy is an advocate for children, but I think she's far afield on this issue. If this were proven, which I doubt, Caysee could be charged again for sex crimes. She claims that Caysee got her money from people she allowed to abuse her child, but we already know she stole to get her money. This woman is a nut.

I had never heard of Wendy Murphy until last night. I read her blog, which contains a detailed theory of how and why Caylee died. I have to admit, it sounded pretty wild to me.

If these 'pictures' really do reveal something shocking, maybe we SHOULD rethink the whole thing. But I doubt they do.

The world is a weird wild place. Often what we think is the truth isn't. On that basis, I'm not going to call Ms. Murphy a "nut" just yet. Would love to hear what others think of her opinion.
12:14 AM on 07/18/2011
I think she's just trying to "cash in" -- and is trying to send out "feelers" for a book.

How perverse is that? Beyond shameful.

The case is so OBVIOUS - and needs no embellishment. The mother murdered her in a rage (against her own mother -- with whom she seems to have had a "hate/hate" relationship w/).
