Deshon Marman Saggy Pants Arrest: No Charges In SF Airport Case

SAN FRANCISCO — Prosecutors said Wednesday they will not file charges against a University of New Mexico football player who was arrested after wearing saggy pants on a plane at San Francisco airport.

The San Mateo County District Attorney's Office reviewed the June 15 arrest of Deshon Marman and determined criminal charges were not warranted.

"My belief is if we took this into a courtroom with 12 members of our community on our jury, they would tell me, `Come on guys, you have more important things to spend your time on,'" District Attorney Steve Wagstaffe said. "And I share that view."

Marman was arrested on suspicion of trespassing, battery of a police officer and obstruction after police say he refused to leave the US Airways flight on the captain's orders.

The incident sparked allegations of racial profiling after a photo surfaced of a man who flew aboard a US Airways flight wearing skimpy women's panties and mid-thigh stockings days before Marman's arrest. That man was white. Marman is African-American.

Dozens of people gathered outside San Francisco City Hall on Tuesday in support of Marman. San Francisco Supervisor Malia Cohen told the crowd that she planned to introduce a resolution asking San Mateo County prosecutors to dismiss the case and for a formal apology from the airline.

"I've been trying to search myself and search whatever information that was given through the media to find out what Deshon had did wrong," Marman's mother, Donna Doyle, said in a phone interview on Wednesday. "And for the life of me, I couldn't find anything."

Police also said Marman injured an officer while being taken into custody. But Wagstaffe said the officer suffered a minor scratch and twisted knee but no significant injuries. Marman should have left the plane at the request of police officers and a sheriff's deputy, Wagstaffe said, but his refusal may have reflected his mental state. Marman had attended a friend's funeral the previous day.

"I think the (district attorney) realized the real villain in this case was US Airways, not Deshon Marman," Marman's attorney, Joseph O'Sullivan, said.

O'Sullivan and Doyle said Marman was not available to comment.

The incident began when Marman was asked repeatedly to pull up his pants but did not listen, according to airline officials. They have said he was exposing a body part.

O'Sullivan has denied that, and Wagstaffe said Wednesday his investigation found no evidence that a body part was exposed.

Liz Landau, a US Airways spokeswoman, said the airline stands by its employees' claims that Marman's body part was exposed.

The airline is hopeful that the district attorney's decision will allow Marman and his family to "move past this incident," she said.

"As the (district attorney) noted, Mr. Marman could have resolved the situation quickly at the time of the incident had he chosen to do so," she said.

The airline has previously said Marman was thrown off the plane not because of his clothing, but because he refused an employee's request.

Marman plans to file a lawsuit against US Airways alleging he was the victim of racial profiling, O'Sullivan said.

You know, I hate the whole saggy pants thing as much as anybody - but this whole thing was completely ridiculous. The airline asked Marman to pull up the pants as he was boarding and he said he'd do it when he reached his seat - which, by the way, he did. There was no reason for him to be removed from the plane - and the whole arrest situation was beyond ridiculous. As the article said, if they let a MAN fly wearing nothing but women's underwear, they should have let this kid fly. It's nice to see that there is a DA in this country that still has some common sense.

Okay, here's the problem I have. First off, let me be clear, that I think that young men of any race that "sag" are immature and shouldn't do it, but for the sake of clarity if US Air says no indecent exposure for any passengers, then this guy would not have ever been allowed to fly next to me or my daughter (http://www.sfgate.com/cgi-bin/blogs/crime/detail?entry_id=91446), and if Mr. Marman did assault a police officer, curse at the pilot and cause a scene, it must have happened after he politely told the captain, there's no problem sir, I pulled them up once my hands were free, can we go now (http://www.sfgate.com/cgi-bin/blogs/crime/detail?entry_id=91290) US Air didn't know that a passenger filmed the entire incident, and now instead of issuing an apology for saying he was combative and threatening, they have to go kiss Jesse Jackson's ring for openly discriminating and profiling. Can you say Cha-ching? If that football thing doesn't work out for you, you'll still be sagging with all that cash in your pockets!

His original charges have absolutely nothing to do with the "saggy pants." He was arrested for battery on a police officer, trespassing, and obstruction. This situation is no different than a nightclub refusing admission, or the "no shirt, no shoes, no service" rule. I don't know why this guy has so much support when he acted like a thug.

well funny you say that......Gaga actually did walk through the airport and board a flight.....She took the flight, all while wearing only her underwear. So this man is arrested for sagging, even though he pulled up his pants?

secondly, you notice how the police through in an assaulting officer charge....hey, lets just through that in there....he's a big guy and he must made contact with me at some point while in the process of grabbing his arm to violate his civil rights....so, should just go ahead and throw on resisting arrest and batter to an officer...the dude left the flight without any incident and was arrested even though he was told he would be given his money back if he left...

so the police arrest him without any struggle other than, whoa whats going on....and he gets a batter and resisting charge? WHAT? people don't see the problems with this type of police work...If I were a judge, all cops' words would be questionable.

Of course not, they've already shown that they're fine with White people dressing inappropriately, since they let a dude with women's underwear--showing, not covered by any bottoms--on a flight days before this incident.

My thing is, he said he'd pull up his pants once he was to his seat and his hands were free, and that's just what he did. Thank goodness someone on the plane was recording what happened so there's proof of how the police and airline acted.

That US Airways let on a white dude wearing a bikini kinda puts the lie to their whole "dress code for security" thing. No, this guy got bounced for RWB -- riding while Black. The solution, if you object to US Airways Gestapo tactics, is to not give them money and encourage others not to give them money. That and sue the holyhell out of them if you are victimized.

1st of all he had 2 bags in his hands and hand on pajama pants. The pants started to slip as he tried to handle the bags when the stewardess came over and said something. Passengers on the plane said he let the stewartdess know he would address his pants as soon as he put away the bangs. A few minutes later the stewardess came back and he was already in his seat. She chose to bring the issue back up again and his pants were pulled back up and he was sitting down. There is a video of the conversation on this site and he was not hostile toward anymore on the fight. You might want to go look at it before you jump to assumptions.

Except I hate to have to explain that tact to my children....Have you seen how they wear those pants? They belt them below their BUTT with their underpants viewed. Why bother even wearing pants?

White kids wear saggy pant as much a black kids, when was the last time you heard of them being arrested or tossed out of somewhere for it?

You said it, and it is some bull. I saw the video the police and airline didn't know was being taken...the young man was totally respectful the entire time, not combative at all. And it's easy to prove they just picked on this man because of his color. The same airline let a WHITE man wearing women's underwear, with no other clothing on, fly without incident not long before this happened.

Partially correct: while it is jail-derived, it actually comes from how the cops confiscate anything you can use to commit suicide while in a holding cell such as your belt.
