WASHINGTON — The head of the Bureau of Alcohol, Tobacco, Firearms and Explosives says that in at least one instance during a now-controversial gun-running investigation his agents did not intercept high-powered weapons when they could and should have.

Kenneth Melson's acknowledgement is the first by any senior ATF leader that confirms some of the criticism that Republicans on Capitol Hill have been leveling at Operation Fast and Furious. The concerns have resulted in congressional hearings and an inquiry by the Justice Department's inspector general.

Melson's comments were quoted in a letter Monday to Attorney General Eric Holder from Sen. Chuck Grassley, R-Iowa, and Rep. Darrell Issa, R-Calif. Melson spoke during closed-door questioning earlier this month by Senate and House investigators working for the two Republicans. Their letter contained excerpts from Melson's testimony.

The operation was designed to track small-time gun buyers up to major weapons traffickers along the Southwest border. Critics estimate that 1,800 guns targeted in the operation are unaccounted for and that about two-thirds of those probably are in Mexico.

Fast and Furious is one of thousands of U.S. law enforcement investigations launched since 2006 aimed at stemming the flood of weapons across the Southwest border.

At a congressional hearing a month ago, three ATF agents said they were repeatedly ordered to step aside while gun buyers in Arizona walked away with AK-47s and other high-powered weaponry headed for Mexican drug cartels. So far, 20 small-time gun-buyers have been indicted, but the investigation is still under way.

Melson told the congressional investigators that after the criticism emerged he assigned a task force of agents to review the operation and he personally read all the operations' investigative reports that pertained to one defendant.

"I read through those and found ROIs (reports of investigation) that indeed suggested that interdiction could have occurred, and probably should have occurred, but did not occur," Melson said.

Melson said the ATF gave the reports about the failure to interdict guns in that instance to Justice Department superiors "because to me that was a smoking gun" and "we really needed to look at the rest of this particular case."

Melson also provided some support for complaints by Grassley and Issa that the Justice Department has been slow in producing documents the lawmakers have demanded.

"I think they were doing more damage control than anything" at the Justice Department, Melson said, according to one of the excerpts in the letter from Grassley and Issa to Holder.

In his statements to congressional investigators, Melson also said he understood that some potential defendants in the investigation may not be indictable because they are working as informants with other government agencies. Melson said he raised the issue with the deputy attorney general and with the Justice Department's inspector general.

The Fast and Furious operation targeting high-level weapons merchants as well as street-level buyers was an ATF attempt along the Arizona border to respond to its many critics.

As recently as last November, the Justice Department's inspector general criticized some ATF managers for discouraging field personnel from conducting complex conspiracy investigations that target higher-level members of trafficking rings.

Another impotent failure in the War on Drugs... only the repeal of Prohibition will remove the black-market profit incentives that made millionaires out of Lucky Luciano and Dutch Schultz in New York, and billionaires out of the more than a dozen Mexican cartels currently running the "trade" there. When (alcohol) Prohibition was repealed in the US, bootleggers were literally out of business overnight.

When a cease-fire has been declared in the War on Drugs, drug use in America will likely drop by 90% (as it did in the Netherlands). isn't that what the conservatives want in America? that the solution to the gun violence is more guns? And since Obama is center with conservative leanings regarding guns that would be the republican position also.

that is if a repub was pres. then all you'd hear from the right is "at least they are trying to stop the violence; why is everyone piling on?; if it wasn't for all the govt red tape it would have worked; it was a bold move that didn't work out as well as we wanted"

so now, what, the party of unrestricted gun purchasing and "2nd Amendment solutions" get skiddish when a plan involving guns is a failure? admitting problems is admitting defeat... and then the cartel wins. hypocrites.

As a violence policy advocate, it’s important to note that none of what I write is personal conjecture but instead comes from the study of statistics, polls, and opinion found through research of web sites on the Internet. It’s come to my attention that Americans don’t like NRA leadership or their NRA politics. Additionally NRA members in large numbers don’t like the NRA leadership or their NRA politics. American gun owners do not like NRA leadership or their politics. NRA leaderships don’t like NRA politics and NRA politics don’t like NRA leadership. Report after report, poll after poll confirm this fact.

NRA minions have created a Planned Deception Fraud to overnight flag of websites so you believe that they are a majority and you cannot find supporting links to the TRUTH that I’ve written above. The gun lobby and its blogger minions are numerous, but not representative of our entire population. To say that American voters support the NRA is not true.

Americans don’t like Congress because Congress is known to be bought and sold to the highest bidder. The NRA with its vast wealth buys what it wants so they are popular with Congress. This is why the ATF has been selling guns to drug cartels to support the NRA arms dealers who buy Congress who appoint ATF officials.

Maybe one of us should be the next head of the BATFE? Personally, I'd do a complete reform of the agency, further stripping it of police powers, increasing cooperation with the FBI, CBP, DEA, and state and local agencies, and trying to repair the organization's image.

Melson also stated that the DoJ was:

"...really trying to figure out a way to push the information away from their political appointees at the department."

So one reason for obstruction of Congressional oversight and refusal to comply with Congressional subpoenas was to protect political appointees. I look forward to seeing which political appointees pay for the deaths and lawbreaking of this and similar programs (like Castaway).

There are 17 members on the Oversight Committee that are dems. If he lies he will be charged with Obstruction of Justice as I believe they can already charge Holder as it is evident that he lied about when he knew about the Operation(s) according to the OIG report that was sent to the DOJ months before the death of Brain Terry!

At the briefing last year, bureau officials laid out for Issa and other members of Congress from both parties details of several ATF investigations, including Fast and Furious, the sources said. For that program, the briefing covered how many guns had been bought by “straw purchasers,’’ the types of guns and how much money had been spent, said one source, who spoke on the condition of anonymity because the briefing was not public. “All of the things [Issa] has been screaming about, he was briefed on,’’ said one source familiar with the session.

Melson did come from the DOJ, and was appointed to ATF by Holder in 2009.
