TRENTON, N.J. — A former Rutgers University student accused of using a webcam to spy on his roommate's sexual encounter with another man wants his case dismissed because evidence of the teenager's state of mind before he committed suicide wasn't presented to the grand jury that indicted him.

Lawyers for former Rutgers University student Dharun Ravi argued Monday that prosecutors withheld evidence showing Ravi never bullied roommate Tyler Clementi, who jumped to his death from the George Washington Bridge days after his same-sex encounter was furtively captured on a webcam and transmitted through the Web.

Defense attorney Steven Altman asked prosecutors to turn over evidence that they said could clear Ravi, 19, of the hate crime accusations, and will ask a New Jersey court to dismiss the charges, according to the Star-Ledger. The newspaper reported that Altman is asking the prosecution for documents from Clementi's computer and dorm room that could shed light on his state of mind around the time of his suicide.

Altman and Philip Nettl, Ravi's other attorney, didn't respond to inquiries by telephone and email Monday from The Associated Press.

Ravi was indicted on 15 counts in April for events that took place in September 2010, when prosecutors say he learned Clementi, 18, and another man would be using the room. Prosecutors said he used a webcam to spy on them and invited others on Twitter to watch their sexual encounter. Clementi's suicide soon after sparked a national discussion about bullying and gay youth that prompted celebrities, senators and President Barack Obama to speak out.

Ravi and fellow student Molly Wei, who also watched the encounter, weren't charged with Clementi's death, but rather with invading his privacy. Wei later agreed to testify against Ravi in exchange for being spared a trial and having her charges eventually dropped if she complies with certain conditions.

But Ravi's most serious legal problem is a bias intimidation charge – a hate crime – that a grand jury approved after prosecutors presented evidence alleging that Ravi targeted his roommate because he was gay, and tried to intimidate him by broadcasting his encounter on the Internet. New Jersey's hate crimes law ups the stakes for those whose crimes are deemed to be rooted in bias. Ravi could face five to 10 years in prison if convicted.

Only the prosecution gets to present evidence when grand juries weigh indicting a suspect, said Joshua Cohn, a defense attorney and former New Jersey prosecutor who isn't involved in the Rugers case. But they're supposed to include contradictory evidence if it meets a certain standard.

"It's a fundamental principal of New Jersey law that anything that is `clearly exculpatory' should have been included in the presentation to the grand jury," Cohn said. "But it's a little fuzzy over what constitutes `clearly exculpatory.'"

A spokesman for the Middlesex County prosecutor's office declined to comment on the claims it withheld evidence but said prosecutors would respond to any motions filed during the next hearing, scheduled for Sept. 9.

If Ravi were truly a man, he would have saved his family and Clementi's family the pain of this whole sordid mess and pleaded guilty and make a public apology to the Clementi family as well as his own. He could have saved each family a lot of distress and honored Clementi's memory by not dragging his reputation through the media circus this trial is going to engender. That would have been the right thing to do instead of splitting hairs over excupatory evidence and putting your family into debt by running up a fantastic legal bill. The pain this trial is going to cause the Clementi family should certainly be something Ravi should be considering if he is truly remorseful. Pleading guilty and hoping the judge would have been merciful in light of that action would have been the kinder thing to do for all concerned, including Miss Molly Wei.

If Ravi or Wei had done that to my kid, I would put a hit out on Ravi, and then I would kidnap Wei and sell her into sex slavery. If you think I'm sick, so is streaming someones' homosexual encounter on the internet. Peace out.

For a senseless act of cruely a young man dies. These two should be held accountable and punished-no deals. They get to have a life, while the only thing left for Tyler's parents is to visit his grave.

So he's suggesting that when a person is standing on a ledge after having a bad day it isn't a crime to push them off?

Interesting.

Additionally, it may have escaped my notice, but nowhere do I see as much as a mention of Rutgers' contemplating expulsion of this dirt bag.

Is this the caliber of students they intend to coddle?

I believe both were expelled soon after the incident. This article refers to him in the first sentence as a "former" student.

Not true, they weren't expelled until Tyler committed suicide and the police investigation began, DESPITE Rutgers being aware of the situation through Tyler's complaints and the R.A.'s statements. The Clementi family was (don't know what happened or if they settled) planning a suit against Rutgers.

They voluntarily withdrew during the Rutgers investigation, which allowed them to avoid any disciplinary actions by the University.

This man is guilty of death by harassment. As a consequence , he should be imprisoned for the rest of his life. (since he is young, the death penalty would be too easy)

Law is so interesting. I wouldn't be able to defend what Ravi did if I were his lawyer. What they're asking for is ridiculous. Any teen (or anyone for that matter) who has his/her sexual encounter broadcast via the internet would be hard pressed to not consider an alternative to living. What he did pushed someone to the brink, whether it was intentional or not, however, his intentions were malicious, and that, you cannot defend.

I try not to hold anything against the attorneys. Our system gives everyone representation, and they have to do their best to defend it well. If they don't, convictions get overturned. So, someone has to take the role that gets tomatoes thrown at them.

His 'spoiled brat' gland seems to be doing just fine in guiding him through this case. I must say, this kid is a pure sociopath, not one ounce of remorse.

i think this guy's actions were malicious, cruel and designed to distress his roommate. though i'm sure he didn't think his room mate would be so distressed he'd commit suicide, to me, it just highlights the recklessness of his behavior.

he's right were he belongs IMHO: in the grip of the legal system where his fate will be decided by his fellow citizens.

I think its so sad that a fine young man is dead because of intolerance - and only three people have posted here. While Jesse James and Kat Von D are calling it quits has 480 with 12 pending.

I had a tough time even finding this article. Then again, it might be better represented once the actual case begins. This is just legal dancing. Dismissing with the argument given probably won't happen. The defense will have the chance at trial. They don't get to make a defense during grand jury, and the evidence their claiming is not exculpatory to the charges being made.

I'm sorry, what he did is so heinous that it would be a CRIME if this is dismissed. This little weasel needs to be put into a cage and locked up for some time.

He's ruined until he does a sit-down interview with a network to get people to "see his side" of the events and how he has changed as a person.
