Paul Doering, Dakota Wild Bunch Old West Re-enactor, Faces Federal Charges After Tourists Injured By Live Ammo In Fake Gun Battle

SIOUX FALLS, S.D. — An Old West gun battle re-enactor who injured three South Dakota tourists when live ammunition was fired instead of blanks faces a federal weapons charge because he should not have been carrying a gun since he's a convicted felon, federal prosecutors said Wednesday.

The tourists were hit during the June 17 reenactment staged by the Dakota Wild Bunch, who use blanks when they perform several times a week on a street in Hill City, a tourist town in South Dakota's Black Hills.

The bullets shattered a leg bone of Carrol Knutson, 65, of Birchwood, Minn.; hit the forearm and elbow of John Ellis, 48, an optometrist from South Connellsville, Penn.; and caused minor injuries to Jose Pruneda, 53, of Alliance, Neb.

Now, 49-year-old Paul Doering of Summerset faces a felon in possession of a firearm charge because of his previous criminal record, said Mark Salter, a U.S. Attorney's office spokesman.

Doering made an initial appearance in a federal court in Fargo, N.D., on Wednesday morning but did not enter a plea. He's ordered to appear in federal court in Rapid City on Aug. 11 for an arraignment, Salter said.

An indictment issued last week was sealed by the federal court, he added

The sheriff's office submitted its investigative reports to the Pennington County state's attorney's office and the U.S. Attorney's office, said chief deputy state's attorney Lara Roetzel.

Roetzel said her office doesn't have any intention of filing state charges against Doering.

Investigators have not made any comments on why the incident happened, but Hill City Administrator Brett McMacken said Wednesday that it appears to have been accidental.

The mock shootouts between lawmen and outlaws, which are sponsored by the Hill City Chamber of Commerce, have been held in the town for at least a couple of decades, and the Dakota Wild Bunch has been doing the show for about four years.

The shows have since been suspended.

Investigators earlier this month found that Doering had served more than five years in Minnesota prisons on multiple felony convictions.

South Dakota law prohibits a person convicted of a felony in South Dakota or another state from possessing or having control of a firearm for 15 years.

Federal law prevents felons convicted of crimes punishable by more than one year in prison from possessing any firearm or ammunition unless the person has had their civil rights restored by the state where they were convicted.

McMacken said he has no idea whether background checks were done on the re-enactors. He said the city had an agreement with the chamber for the shows to be staged, "and that was the limit of our involvement in that group."

A message left for Brenda Nolting, the chamber president, was not immediately returned.

Doering was imprisoned from April 1982 to January 1984 on two first-degree assault charges, according to the Minnesota Department of Corrections.

He returned to prison on Dec. 14, 1990 to serve time for second-degree burglary but was convicted of escape less than two months later, which extended his stay. He was released in May 1992. In October 2001, he began serving another sentence for escape, which was extended by a Dec. 2001 escape conviction. He got out in May 2004, according to the department.

No phone listing could be found for Doering, and attorney information was not immediately available.

According to South Dakota a persons civil rights are automatically restored after they have served their time and any probation. Firearms rights restoration is delayed fifteen years after a violent felony conviction. Because of the assault convictions, he finished serving time for in 1984, his firearms rights would have probably been been restored around 1999. Unless the burglary or escape convictions involved violence he should have been clear upon completion of sentence and has probably not in violation for simple possession. This is based on the information provided in the article and state law.

I think the loophole in use here is that Coyboy Re-Enactor revolvers are considered black powder devices and thus "not real guns". Confusing blanks with live ammo is a colossal mistake - or is this guy hiding some violent thoughts? Background checks for persons using stage equipment that is perhaps dangerous to the audience would reveal ex-felons and perhaps some nut cakes.
Seize his.
Ban him.

no sir. They actually use the Colt SAA with a live size chamber and bore. I'm very Pro-2nd amendment, but not using prop-guns with either blocked or blanks only restricted barrels is a serious breach of firearms safety. Even firing blanks from an unrestricted gun is a dangerous mistake, one that has cost several actors (in hollywood) their lives.

Not ot mention 12 notably famous old time magicians - the last one I know of to do that bullet catch with live ammo was Theodore Annemann, he lived - I have a silent DVD of him in performance that day - lip reading him is gruesomely amusing - and he never did it again after that day. Life Magazine sent a photog but never dared publish the pics - they were terrified kids would try it at home. As a magic fan I am in favor of unblocked barrels - they make certain stage effects possible but with live people down stage - no - no - never.

It is not a lie, just a simple non-sensical rant that everybody who is frustrated with this whole gun issue is entititled to once in a while. It is no more of a lie than trying to say that "carry" laws have contributed to the delcine of crime. There is absolutely nothing that supports this other than nra (non caps on purpose because anyone who belongs does not deserve my respect) spin doctors. Therefore, if you believe this, then you are lying to your self. Wake up and see the "obvious lies" you swallow every time you pull the trigger in the name of "self defense". Put a picture of the innocent victims on your target and justify their deaths. You are oblivious to the real issue.

Clearly this guy didn't clear his chamber and check the clip.  The weight differential between blanks and slugs is significant.  Moreover, someone should have checked his record before hiring him.

I was thinking the exact same thing!

hmm maybe this was a re-enactment for cowboys and aliens, and the cowboys were armed with Ak-47s, they had those back in the mid to late 1800s right?! :-P

They were using revolvers. But it's still possible, if the guy had previously been using his for target practice, for several live rounds to be in the _gun. People are careless that way. (I can't imagine him doing that intentionally, but you'd think they'd at least test candidates for a knowledge of firearms safety before hiring them for a role like that.)

Anyone even remotely familiar with guns would not mistake blanks for live rounds. Either he was shooting live rounds on the side and forgot it was loaded with live rounds or he picked up he wrong gun.
