DADT Repeal Guide Answers Questions For Gay, Lesbian Troops

WASHINGTON -- Is it required to come out if you're a gay or lesbian service member? Is it safe for gay troops to confide in their chaplain? Which benefits will remain off limits to married same-sex service members? And if you were discharged under "don't ask, don't tell," can you now rejoin the military?

These and dozens of other questions are addressed in what is being called a "first-of-its-kind" guide to the laws and policies on military service by gays, lesbians and bisexual troops once the military's DADT ends this fall.

The 53-page "Freedom to Serve: The Definitive Guide to LGBT Military Service" was released Thursday by the Servicemembers Legal Defense Network (SLDN) and is available on the gay advocacy group's website.

But it also comes with a warning printed in bright red letters on every page. It reads, "IMPORTANT: This guide is effective upon repeal of 'Don’t Ask, Don’t Tell' on Tuesday, September 20, 2011. Until then, service members are cautioned about coming out publicly."

The guide was issued nearly a week after President Barack Obama and the Pentagon's civilian and uniformed leaders certified that the military is ready to formally lift the 17-year-old ban on openly serving gay and lesbian troops. The announcement started a 60-day countdown to Sept. 20, when repeal officially goes into effect.

To help gay service members make the transition, the manual outlines standards of conduct, benefits that are and are not available for spouses and family members, rules for upgrading discharges made under DADT and veterans' benefits.

A recurring theme is how service members who marry their same-sex partners in the six states and the District of Columbia where gay marriage is legal are not eligible for all the benefits given to opposite-sex couples because the federal government forbids recognition under the Defense of Marriage Act (DOMA). The banned benefits for spouses includes health insurance, family separation allowances, higher housing allowances and surviving spouse benefits

The guide notes at least one "advantage" over straight married service members: "Because same-sex marriages are not recognized under DOMA, a service member who is married to a same-sex partner would not be subject to adultery charges for having extramarital sex with another 'unmarried' person."

In a section on "Transgender Service," which will still be banned after repeal, the guide offers "tips for serving in the closet."

Another section offers guidance for former service members expelled for being gay before or during DADT on how to have their discharge paperwork changed to remove negative re-entry codes that can hurt with future civilian employers and bar them from rejoining the armed forces.

SLDN, which was founded in 1993 -- the same year as DADT -- said by issuing the guide it was not signaling that its mission to overturn the policy meant its mission was accomplished.

“The work of advancing military equality marches forward after repeal," said executive director Aubrey Sarvis. "We will fight alongside those who may face harassment or discrimination as we oversee implementation; when necessary and timely, litigate in the courts to bring about full LGBT equality in America’s military; advocate for legally married service members to receive the same benefits as their straight counterparts; and assist veterans to correct or upgrade their discharge paperwork."

If gay married couples are not going to receive the same benefits as straignts, then we need to take the benefits away from straights. Why am I paying taxes just so that money can go to a straight woman who made the CHOICE to marry a military man and she can now get free medical/ dental/ housing and base privledges.

So now it starts,perverts demanding their "rights" I FEEL SORRY FOR THE NORMAL SOLDIERS.Soon these people will become a protected class & Heterosexuals will have no rights.If a normal soldier says somthing wrong,looks at a queer the wrong way or refuses to be friend one then it will go hard for them.Queer behavior on the other hand will be overlooked,excused or ignored.This may take time but it will happen.Find another way to serve your country & DO NOT JOIN THE MILITARY under these circumstances!!!you may regret it later.let the queers take it all over & save normal lives!!

To all like myself looking forward to the repeal of DADT and hearing the naysayers I have a warning. Don’t mistake their whimpers as the smothering battle cry you are hearing from those folks. It is the tattletale whimper heard after the Supreme Court decided Roe VS Wade. We see today just how dangerous that cry is, it warns me. That even after repeal, our military will continue to under assault to discriminate and if we are not mindful of history of the whiners, DADT will likewise be legislated out of existence too.

I still see people talking about why repealing DADT is a bad idea. It's clearly apparent that a number of them have never served in the military themselves­­­­­­­­­­. For those people, I have a suggestion­­­­­­­­­. If you haven't joined the military & served your country, then you have no right to tell the people risking their lives how they have to live & what they can or can't talk about. It's as simple as that.

You people sit there in the comfort of your homes & have the gall to judge soldiers who lay their lives on the line for you, thereby insuring you the freedom to live as YOU want to, but you've never actually served your country yourself. You people disgust me.

Speaking as a happily married heterosexu­­­­­­­­­al male, who has also served in the military, I can say with all honesty that I would rather fight alongside a whole platoon of openly gay soldiers, than I would a whole battalion of you people who seem to be more concerned with if a soldier is gay, whether or not they are talking about it & if they're going to hit on you.

GOD will punish our nation for going against his words. And nobody is going to stop Him. You can say what you will, but, His wrath and anger we will feel because of this decision, so be prepared for it. You cannot defeat GOD, no matter how hard you might try. I know it really bothers you that we are not required to be Christians to be US citizens, vote, marry or join the military, but that's reality.

The beauty of this country is that we're free to believe (or not believe) as we choose. You don't get to use your personal interpretation of religious "morals" to dictate civil law and civil rights.

When i was in the military we also had civilians working on base. Right along with us. Even oveseas. and guess what? I knew several GAY civilians who were on base and working wth us. Openly gay. I didnt effect anyone.

And for as long as I can remember (at least back to 1998 when I first got involved with the military), government civilians couldn't be discriminated against because of sexual orientation. It was right there in the employment disclaimer.

When I was in the military I knew of a few homosexuals in our company, and a couple were in my platoon. We slept in the same barracks, showered in the same showers & used the same bathroom. It was never an issue.

Would you hit on someone who you know has no interest in you? How about someone you knew disliked you? No, probably not. Why would you think a gay soldier would be any different?

Instead of trying to perpetuate these ignorant talking points go educate yourself. You'll look a lot less foolish if you do.

who cares? what paranoia. you better stay away from the following places. Gyms, camp grounds , YMCA / YWCA , public pools etc. becasue gay use them and they might see you. Scary thought huh? I bet you'd break down and cry for Jesus if a gay saw you in the bathroom.

At least it is happening. But those who are married in a state where it is legal and have the license, should get all benefits. I hope that happens soon. another reason DOMA needs to die and all states need to be forced to allow gay marriage.

I have no experience in the military. But I am certain that other countries allow gay men and lesbian women to serve openly in the military. I believe those foreign armies have been able to withstand the openness and I support it.

When I was in the military I did not see or hear of anyone geting kicked out for adultery. and trust, many married guys were messing around, exspecially overseas, with hookers. including my first sgt.
