ABA Urges Congress To Reject Birthright Law

TORONTO -- The American Bar Association passed a resolution Tuesday urging the U.S. Congress to reject any changes to the Constitution that would eliminate automatic citizenship for anyone born in the United States.

About 400 members of the attorneys association, which is holding its annual meeting in Toronto, passed the resolution in a voice vote.

Some Republican lawmakers have called for legislation to repeal birthright citizenship and have proposed a constitutional amendment.

Outgoing American Bar Association President Stephen Zack said in an interview that racism is underlying the call to change the constitution. Zack, the first ABA president of Hispanic origin, said it was an important statement by the American Bar Association that the U.S. Constitution must be respected.

"This is something that should be avoided at all costs," Zack said. "Certain issues are not really about what the words are about, but what the underlying concerns are about."

The ABA debated the issue last week ahead of Tuesday's vote.

John Eastman, a conservative law professor at Chapman University in Orange, California, argued that it's an open question whether the citizenship clause of the Fourteenth Amendment allows for citizenship for anyone born in the U.S. and said it's time for the U.S. Congress to clarify the issue.

Eastman challenged a claim before the Supreme Court that Yaser Esam Hamdi, who was seized by U.S. troops on the Afghanistan battlefield in 2001, was a citizen because he was born in Louisiana while his Saudi parents were in the U.S. on a temporary work visa.

Eastman called it odd that a man who had little connection to the U.S. could be considered a U.S. citizen. The Supreme Court ruled in 2004 that Hamdi had the right to use U.S. courts to challenge his detention.

Thomas Saenz, president of the Mexican American Legal Defense and Educational Fund, which is based in Los Angeles, said the Latino community is most at issue in discussions about citizenship by birth and said it's hard not to see that the reinvigorated debate is really about opposition to demographic changes.

Saenz said the issue is closely tied to the efforts by some states, such as Arizona, to limit immigration.

If people have a right to bare arms per our Constitution, then we should follow our Constitution.
Why pick and choose, if you are born hear your a citizen by law. When we become the majority
something you guys fear, we will be able to make changes also, are you guys sure you want to ride this train. Its a great topic for thr 2012 Election, latinos this is the republican party, if they change that law
think of many others they will change to try to suppress us, The Republican party is Anti-Latino

I think that a change does need to be made. I think the only way someone born here should get citizenship is if the parents are here legally.

I'm not sure where I stand on this. I don't think its right for someone to come here for a few months, give birth then leave the country and the child is a US citizen with all the rights that go along with this. This child brought up in a different culture with possibly different values would be able to run for President when an individual who spent the majority of his life within the culture etc cannot ( yes, this an extreme but it is within the realm of possiblity even though the person is not likely to get anywhere). I also wonder why a child of someone here illegally should obtain the rights of US citizenship when the parents broke the law and the child would not have been here otherwise. The question is , should any of this matter? If a child is born here should he not have all the rights associated with his birthplace? I just do not know. American citizenship has always been a life changing asset so we should guard this right without changing the basis of what makes the country the land of opportunity.

Look at your school tax bills, your overcrowded hospitals where YOU GET TO PAY FOR THE ILLEG'S KIDS BILLS, look at your welfare taxes that pay for the disablities that so the MANY ANCHOR BABE S HAVE DUE TO FREINDLY DOCTORS. Look at your neighbors who have ruined neighborhoods and their house values goning DOWN, DOWN AND DOWN due to the illegals and many, many, many many anchor babes that YOU GET TO SUPPORT. Look around and see if you want barrios instead of neighborhoods with parks where everyone is safe and not going to be robbed day or night...look around and see if you like the signs in spanish, look at your voting ballots and see if you think it is fair to have to print them in NON-ENGLISH, SPANISH??? LOOK AROUND AND THEN SEE IF YOU CAN MAKE UP YOUR MIND.

The ABA and its blathering has become less about law and more about feelings. Since they stopped vetting Supreme Court nominees on actual experience, practice, judicial decisions and went on the nominees political, personal views they are nothing but mouthpieces for special interests groups.

Changes are a comin, in Nov 2012..... within 1 year the 14 th aamendment will either go to the supreme court or better yet thru congress with legal legislation to change the birthrights to ONLY CHILDREN OF USA CITIZENS...... GOT THAT ONLY USA CITIZENS.

If I was born here and I have no birthright citizenship how would citizenship be determined? What if I and all my relatives were born here since the early 1700's--would all those "birthright citizenships" be nullified? Would any of us be citizens?

neither party has enough support to amend the constitution, and they know it. it is just political theatre to float these amendments as a solution for any problem.

Dream on! There are some "legal authorities" that believe/assert that the changes req. can be made by simple statute clarifying the genuine "intent" of the 14th constitutional amendment. Even the case law establishing this egregious phenomenon is ambiguous (Plyler et al.), and the "Roberts Court" should be sympathetic to a clarification....!

Another way to discourage "anchor babies" is a requirement for parents seeking hospital admission (especially since most such births will be paid for charitably) to demonstrate the BONA FIDE of their citizenship. Illegal aliens are INELIGIBLE for Medicare/Medicaid (except by fraud???).... Thus the parents will be forced to come forward....???

clarifying a statute or amendment that already exists is clearly not the same thing as amending the constitution. i simply said neither party has the popular support to amend the constitution -- which has nothing to do with your assertion that an actual amendment is not needed. "me thinks ye doth protest too much."
