PHOENIX — Arizona Gov. Jan Brewer filed an appeal Wednesday with the U.S. Supreme Court to overturn a ruling that put on hold key parts of the state's immigration enforcement law.

The appeal comes as Brewer faced a deadline for contesting a district court's decision that, among other things, barred a requirement that police – while enforcing other laws – question the immigration status of those they suspected of being in the country illegally.

Brewer lost her first appeal in April when a three-judge panel of the 9th Circuit Court of Appeals rejected her request to overturn the decision. The nation's highest court has discretion on whether to hear her appeal. It will likely be three months before the Supreme Court decides whether to hear arguments in the case.

Lawyers for the governor argued that Arizona bears the brunt of America's border problems and that the 9th Circuit's decision conflicts with Supreme Court precedents and with immigration decisions from another appeals court. The 9th Circuit had said the federal government is likely to be able to prove the law is unconstitutional and likely to succeed in its argument that Congress has given the federal government sole authority to enforce immigration laws.

The governor said in a written statement that her appeal raises issues that apply to other states. "It's about the bedrock constitutional principle of federalism under which states have the inherent authority to protect the safety and welfare of their citizens," Brewer said.

The U.S. Department of Justice, which sued Arizona in a bid to invalidate the law, declined to comment on Brewer's appeal.

Her appeal said the federal government hasn't heeded the state's pleas for tougher immigration enforcement and therefore leaves Arizona open to illegal border crossings that result in the state having to eat the costs of educating illegal immigrants at K-12 schools, jailing illegal immigrants convicted of state crimes and providing health care for illegal border-crossers.

Brewer's lawyers pointed out that police in the Arizona border city of Nogales had warned their officers in the summer of 2010 to carry guns when they weren't at work after smugglers threatened to retaliate against off-duty officers who stopped a vehicle that was carrying marijuana.

The appeals said the 9th Circuit's decision suggests there is almost nothing the state can do to supplement inadequate federal immigration enforcement.

"The 9th Circuit, essentially, is almost looking for something in federal statute that gives states permission to take steps to deal with the problem" while Arizona contends states have that power unless federal law prevents them from doing so, Brewer attorney Paul Clement said in an interview.

In the past, the federal government has argued the law intrudes on its exclusive authority to regulate immigration, disrupts relations between the U.S. and Mexico, hinders cooperation between state and federal officials and burdens legal immigrants.

Kevin Johnson, law school dean at the University of California-Davis and an expert in immigration law, said there's a good chance that the Supreme Court will hear the case. "In this case, you have some conflicting lower court decisions and pressing policy issues," Johnson said.

Less than a day before the law was to take effect in July 2010, U.S. District Judge Susan Bolton blocked key provisions from going into effect, including also a requirement that immigrants get and carry registration papers.

But Bolton allowed other parts, such as a ban on obstructing traffic while seeking or offering day-labor services on streets.

The law was passed in April 2010 amid years of complaints that the federal government hasn't done enough to assist Arizona, the nation's busiest illegal entry point, with border security. The legislation inspired protests, led to lawsuits seeking to overturn the law and a debate about whether the law would lead to racial profiling.

Brewer filed a lawsuit earlier this year against the federal government that alleges that Washington has failed to control the Arizona-Mexico border and enforce immigration laws. Federal authorities are seeking the dismissal of that lawsuit.

The genie is out of the bottle. The Feds have not been effective in addressing the issue for the last 20 years. The constitution is not clear on specifics other to say that the Feds control foreign trade and naturalization. The declaration of independence entrenches the sovereign rights of states, which when combined pushes the whole immigration debate into the realm of the courts. The Supreme Court has to hear this one!

It is no longer acceptable to continue to ignore aspects of the sanctuary polices that are clear preemption of federal law while standing in the way of states who rightfully want to step into the gap created by inaction, intransigence and incompetence on the part of the Feds.

Given the growing weight of legislation by states, this is not going away and the supreme courts must rule on the issue sooner or later. It is too important and there is a growing upswell of support that is demanding action to resolve the problem.

The Pro-illegals (including and especially the Obama administration) don't want this and are fighting tooth and nail to prevent or at best delay the issue. If the courts agree to hear it now, this makes it a prime election issue that will take probably Obama out.

If they decline - it will resurface. If they defer - it is not the slam dunk that the libs and pro-illegals would have you believe.

Majority of Legal Americans have to show their identity on a daily basis, or should I just say Working Americans. Gotta show our license to the cops, our proof of citizenship at the Canadian u.s. border just to get back in,buy smokes, beer, cash checks get paid get a ballot, Show Log book, Show medical card, why you lib's so upset requiring the illegals to do the same as U.S. Citizens? Or like always want to make them a special class of people so you can champion them for your cause?

yes I go to Canada all the time and yes you have to show your ID (passport) and sometimes driver license. Yes some places here you have to show ID for beer and cigs no matter how old you are! Matter of fact some even punch in your drivers number. You also need ID to cash a check or withdraw money.

It is the duty, and obligation of the Federal Government to protect our borders; it's in the Constitution. Why is there no legal vehicle in place for States to force the Federal Government into fulfilling this or any other obligation so delineated in the Constitution?

The states already enforce federal law in many areas so why all the big deal about this particular law? The precident is already established and in place that states do enforce federal law every day. The only alternative the Suprme Court has to siding with Brewer is to send in enough Feds to enforce all Federal Laws and let Arizona enforce whatever state laws are left.

And then do that for the rest of the States.

That'll keep ol'Eric busy, the commie blockhead.

Holder has chosen to avoid enforcement of some Fed laws against illegal immigration. It is up to AZ to enforce local laws against crime. They can detemine if whoever they apprehend in the course of a crime is there with no legal residence, etc. I'd not be surpised if the Court says arrest them if they break local laws but ignore or report their legal status to ICE for whatever ICE wants to do with them if anything.

I don't understand this whole thing. We're talking about ILLEGAL immigrants, or invading parties. It is the federal governments’ responsibility, to protect us from invasion. When the federal government refuses to do it, what are the states suppose to do? It's not any different than if someone breaks into your home, it's the responsibility of the police to protect us, but if they're not there, you have to do it yourself. These invaders are sucking down the resources of all the Border States, federal, state, county and city resources, and stealing from of all taxpayers.

You forgot to add that many of these so-called 'invaders' provide you the food on your plate through farm and factory labor and many other services. If they come in legal no problem, Problem is the left made it so easy to break our laws that they come in droves, left says its our obligation to provide them with free medical care, housing cheap education which is straining our resources. Taxpayer? maybe when they buy stuff but for payroll taxes nope nadda don't pay need a ss number, which they don't have unless they stole someones identity . California said 98 mill plus go to support illegals, San Diego county hospital was our is broke because of them. Go travel central ca. valley, What use to be nice areas are now slums wires running from house to house because one pays the rest use. Correction!!! The only terrorist that have entered this country and that are on record have been through the northern border. Why bring the troops home to guard the southern border? There is no documented instance of a terrorist entering the country from the south. If we do bring the troops back home they should impose martial law and police up all the homegrown terrorist that have been terrorizing the countryside. The northern border is protected and watched guared and protected by both Canada and the US. So, of course the ones trying that avenue are being caoght while the litterally open southern ignored border isn't catching them. But you probable knew that.
