Obama Drilling Rules Thrown Out By Federal Judge

CHEYENNE, Wyo. -- A judge on Friday threw out Obama administration rules that sought to slow down expedited environmental review of oil and gas drilling on federal land.

U.S. District Judge Nancy Freudenthal ruled in favor of a petroleum industry group, the Western Energy Alliance, in its lawsuit against the federal government, including Interior Secretary Ken Salazar.

The ruling reinstates Bush-era expedited oil and gas drilling under provisions called categorical exclusions on federal lands nationwide, Freudenthal said.

The government argued that oil and gas companies had no case because they didn't show how the new rules, implemented by the U.S. Bureau of Land Management and U.S. Forest Service last year, had created delays and added to the cost of drilling.

Freudenthal rejected that argument.

"Western Energy has demonstrated through its members recognizable injury," she said. "Those injuries are supported by the administrative record."

An attorney for the government declined to comment but Kathleen Sgamma, director of government and public affairs for the Denver-based Western Energy Alliance, praised the ruling.

"She completely discounted the government's argument that the harm was speculative," Sgamma said of the judge.

The Energy Policy Act of 2005 allows the BLM and Forest Service to invoke categorical exclusions and skip new environmental review for drilling permits under certain circumstances.

The circumstances include instances where companies plan to disturb relatively little ground and environmental review already has been done for that area. A categorical exclusion also can be invoked when additional drilling is planned at a well pad where drilling has occurred within the previous five years.

Categorical exclusions were widely used throughout the West – especially in the gas boom states of Wyoming, Utah and New Mexico – until last year.

In Wyoming, the BLM invoked categorical exclusions for 87 percent of the new gas wells drilled in the Upper Green River Basin between 2007 and 2010. Those drilling permits added up: Close to 3,000 over those three years in the basin's Jonah Field and Pinedale Anticline gas fields.

The Jonah Field and Pinedale Anticline ranked fifth and sixth for gas production in the U.S. in 2009.

Federal land agencies adopted new rules for interpreting the Energy Policy Act last year in response to an environmentalist lawsuit over the use of categorical exclusions. The Western Energy Alliance sued over the new rules last fall.

I pose a few concepts to see at what point you find something objectiona­ble.
Ask yourself, if ok for one example, why not all?

What if a president waved federal contract laws, writes a rule to bypass fed laws?What if the contracts went to his strongest supporters and doners? What if these are defense contracts?

What if a president decided a popular movement by his voters is science, skipped scientific review boards, public hearings, economic analysis?
-What if this were all birth control users registrer with the federal gov?
-What if all backyard gardens need a federal permit because sometimes people get ecoli?
- What if growing food requires a permit because you are no longer buying from the interstate market?
- What if admin passes a rule for permits to cut down a bush or tree because it impacts Co2?
-What if admin decides that all perspectiv­es of the origin of man must be presented?

What if admin decides to ignore some fed laws, enforce others, make a new rule based on the color of your skin? What if it is based on nationalit­y of origin? (immigration)

What if an admin decided that they were not going through procedures­, the balance of gov, and had their agency make rules convenient for them?
What if a president ignores senate/con­gress?

Beyond the new rule for drilling or not, what does it mean when a gov picks/chos­es whom it serves, ignores laws when convenient and makes it owns rules?

the left must be full of Luddites...the Volt is loser..with nobody paying $40k to drive a car that only goes 40 miles. don't hink propellers will work on my car....one day, when we can figure it out, fuel cells might replace all this oil. The first step shoudl be convert transportaion to nat gas...its cleaner. But folks...we are going to need oil for a while.....the earth has been warming and cooling over millions of years...to say that in only 150 years mankind is repsonsible..with so much science in conflict. The earth may be warming....but without fuel you'll have stavation, joblessness.....cows and sheep probably produce more CO2...concentrate on getting people to eat less meat will be more effective that raising gas prices on citizens who have to travel for work and for vacatinos...Unless you want to see everybody who works in that industry jobless.

More oil, more gas, more CO2 in the air and we are that much closer to suicide. Really, don't you people know how scared the oldest and best climate scientists are? Besides, if they are fracking, you are going to clean up the mess. Mineral extraction is a private industry, they take the profits and run. Capitalism rules the extraction, the cleanup is shared, its socialistic. Extraction companies love socialism.

What do you have against fracing? Do you know what FRACing is? Do you know where FRAC is done? Do you understand the hydraulics of FRAC? It's about time something is starting to get done to end the slavery to Obama's, Clinton's and Carter's foriegn oil buddies.

Look for more stock market fluctuations as people attempt to save the funds they dumped on oil futures, as US oil companies are aloud to do what they do best...Drill, pump, and refine oil....reduce fuel costs, AND open the JOB MARKET.

What's common sense? Drilling on public land, i.e. owned by all of us, should be reviewed for the numerous inherent impacts that may be caused. This is not a new step," consultants live off this. Realistically, it will cause job loss in the private sector (consulting firms). Hell, my parents had a frack company drill on their land in Ohio. I pointed out logical "common sense" things like having them test their well water thoroughly beforehand; driller fought that idea, parents (Tea Party Rush-lovin' Repubs) took the Kool Aid. Now if, god forbid, the well becomes contaminated, the driller can state the well had prior contamination b/c no sufficient pre-testing was done. Thanks for your common sense, I'll take logic over it any day! I work with consultants/contractors daily, some are reasonable people, others just want the permit, with many showing complete disregard with actually reading it.

I think any court that rules in favor of big energy is dumb. They've taken us to the cleaners with any and all costs. The courts just blithely go along, especially when they are in a Republican state!
