North Carolina Planned Parenthood Funding Safe For Now, Rules Judge

RALEIGH, N.C. -- North Carolina cannot withhold funding from Planned Parenthood until a lawsuit over that provision of the state budget has been resolved, a federal judge ruled late Friday.

The ruling by Judge James Beaty Jr. gives at least a temporary reprieve to Planned Parenthood of Central North Carolina while they seek to invalidate the portion of the state budget that would withhold funding for non-abortion services. The group, one of two Planned Parenthood affiliates in the state, said the injunction should allow them to keep operating until the lawsuit over the provision known as Section 10.19 is resolved.

"Based on the evidence before the court, it appears that Section 10.19 was adopted specifically to penalize Planned Parenthood" for the organization's stance in favor of abortion rights, Beaty wrote, even though the law bars the group from using public money for abortions, except in cases of rape, incest or when the mother's life is in danger. Planned Parenthood in North Carolina provides a range of other services, from tests for diabetes and high cholesterol to screening for sexually transmitted diseases.

Federal judges in Kansas and Indiana have blocked at least parts of laws stripping Planned Parenthood chapters of funds, but officials in both states have appealed.

The North Carolina budget provision would have barred Planned Parenthood from funding for contraceptive and teen pregnancy programs. The group says the loss of funding would lead to layoffs, the end of free or low-cost contraceptives for poor women and the closure of its Durham clinic.

"We feel like this is a tremendous win for women in North Carolina, particularly for those who are poor or uninsured," said Paige Johnson, vice president of public affairs for Planned Parenthood of Central North Carolina, which operates health clinics in Durham, Chapel Hill and Fayetteville.

The next step in the lawsuit will depend largely on whether the state appeals Beaty's injunction. If not, Beaty could have a final decision shortly, Johnson said.

A call Friday night to NC Right to Life, which had supported the provision in the state budget, was not returned.

The provision was part of a state budget passed by the General Assembly, which is controlled by Republicans for the first time in over a century. Although Gov. Beverly Perdue vetoed the spending plan, the legislature mustered enough votes for an override.

In arguments before Beaty earlier this month, state lawyers defending the General Assembly said the budgeting decision doesn't unfairly punish Planned Parenthood because the group could apply directly to the federal government for family planning funds.

But in his 35-page ruling granting the injunction, Beaty said the provision's legislative history makes it clear that the denial of funds was intended as political punishment for the organization. Beaty quoted statements by House Majority Leader Paul Stam, R-Wake, tying Planned Parenthood to the eugenics movement and saying, "We should not be rewarding the perpetrators of that program."

A message left for Stam was not immediately returned Friday night.

Beaty also dismissed the state's argument that the budget is consistent with the General Assembly's policy of "favoring childbirth over abortions," noting that the funds in question can't be used for abortions.

The state, Beaty wrote, "has not presented any evidence or even contention to establish how Section 10.19's ban on using (Planned Parenthood) for non-abortion-related projects is rationally related to a legislative policy of funding childbirth services over abortion services."

With the injunction in place, Johnson said Planned Parenthood hopes to be able to offer its services as usual until the outcome of the larger lawsuit.

"We fully expect to win the case," she said.

I like how the judge offered no legal basis for the ruling. This will be overturned by SCOTUS. State's aren't required to fund anything.

Why do such a large number of conservative Christians seem to have such distant for women? Trying to defund Planned Parenthood is not only an attemped crime against poor and uninsured women but it is also counter productive. PP is the leading sexual and repoductive health advocate and provider in the U.S. Trying to defund them is proff of this. PP provides women with such services as screening for brest, cervical, and testicular cancers, menopause treatment, and sex ed. to but name a few. Abortions account for 3% of total services provided any yet all the talk is about PP and abortion. So, let's talk about abortion.
The overwhelming argument against it is based on religious grounds but nowhere in the new or old testaments is "abortion" forbidden. The anti-choice Christians spend a lot of time and money to ensure the forbidding of an act not explicitly forbidden in the Bible, yet they spend comparably little time fosterering actions that they are explicitly commanded to undertake---save the hungry, naked, thirsty, and sick. Matthew 25: 31-46 enjoins us, as well as to more generally ensure that the poor are not oppressed, economic justice is established, and that immigrants are welcomed and treated well. So, I ask...why do such a large number of conservative Christians seem to have such distant for women ?

I was born, yes.

Conceived by deception. Gestated only due to coercion, blackmail, and threat. Wanted by my Father only as an investment (Only "family men" were eligible for promotion to executive levels) and by my Gestational Carrier not at all.

My support of abortion rights is informed by my experience as a resented child. You see, a Mother's Love is not something that can be forced. Her body sure. You can force that. Her heart? Impossible. Can't be done. Precious stuff. The love of a Mother.

A child's love is a meaningless biological fact. Anyone completely dependent on another for life will come to love them as a child loves. In adults we call it "Stockholm Syndrome".

Which opens the gates to Hell when the object of your love despises you and holds you responsible for the destruction of all they wanted in life. A symbol of a betrayal by their spouse so fundamental it rendered their marriage a hollow shell and heralded decades of abuse of her by him.

There is a scare on my left wrist. It goes down, not across. It's grown faint over the years and the vein underneath has shifted and now lies a half centimeter to it's left. She never loved me but I loved her. I used to hate myself for harming her.

But I shouldn't hate myself. It wasn't my fault.

It was yours. You and people like you. The people who forced her.

All the judge did was say that the state may not tell participants in their medicaid programs what doctors they are allowed to seek care at.

He affirmed the GOP commitment to honoring Patient Choice that they seem to have temporarily forgotten.

PP gets *re-imbursed* for services rendered. It can only render services if someone says "I prefer PP care over everyone else's. I think they are the best" and seeks covered care at PP.

The state has no business refusing to reimburse any provider who is willing to provide care at the prices the plan pays. To attempt to do so is blatant corruption and it is the Judiciary's job to stop such shenanigans.

One politician wants to lower the minimum wage, raise the retirement age, cut taxes for everyone forever, abolish women's rights, and then talk about your freedom.

Another politician will raise the minimum wage, lower the retirement age, tax proportionately all Americans, protect women's rights, and then not even ask for a thank you.

Why is it that one of those politicians ever even has a slight chance of winning an election?

A woman has the freedom of choice concerning her body which she can do with as she wishes.

My issue is "The Double Standard". After the woman makes a poor choice (Less than 1% of pregnancies are due to rape or incest) with her body getting pregnant without intending to.

All of a sudden she and many other women expect society (which includes male tax payers and people opposed to abortion) to pick up the tab for the abortion as an entitlement because she can't afford it.

Rationalizing away the double standard that actions have consequences and it was her choice.

So you'd tolerate me dictating the uses your body will be put to because I have an arbitrary list of organs?

I wouldn't.

The issue is fundamental and transcends gender. The question is simply this:

When the Right to Life and the Right To Bodily Autonomy conflict with each other, which is more fundamental?

This isn't a gendered question. I can save a lot of lives by violating the bodily autonomy of a man. Medical science finds ever more uses for human tissue and can make great use of living donors.

Broadening the scope of the question is to your advantage. There is a reason the prohibitionists run screaming the moment you try to apply the principles they claim to hold so dear to any question other than pregnancy.

You don't understand what happened at all.

The state started a program to allot resources to *individual people* who meet certain criteria to help them purchase medical care. Specifically in this case, care that will prevent unwanted pregnancies and easily avoidable maternal deaths.

This was, in my opinion, a sensible move and one that has been proven to save money overall. But the nature of the program isn't the point. The program is an arrangement between the government and the patients. Not the government and PP.

IF the program exists at all, THEN it may not dictate what doctors the participants may seek care from. That is an intolerable invasion of government into private life. A ridiculous overreach on the part of the GOP.

Your mental model of Government just handing PP a check and hoping they do something with it is simply inaccurate. Every penny PP gets from the program it got because a *person* in the program decided that PP was their vendor of choice. Those people will still be in the program and still seek care.

They'll just go someplace more expensive and less professional than PP to get it if this blatantly illegal tripe survives. You won't save a dime. If anything, you'll pay more.

You've been manipulated into advocating actions that directly violate what I suspect are your own principles. You seriously want to be the tip of the spearhead inserting Government between people and their doctors?

Wrong I do understand you wish to make excuses for the women getting pregnant.

A Federal Judge overruled a state making hard choices trying to live within a budget. He didn't wave a wand and give the state more money to fund this program.

The Federal Government borrows 40 cents of every dollar it spends. The math makes it clear No organization can do that indefinitely and the USA is bouncing off that wall. The economy is terrible and revenues are down as demand for government increases.

Less than 1% of pregnancies are due to rape or incest.

27% of abortions in the USA are accomplished by this organization. Over 1,000,000 a year in the USA funded by the taxpayers because it is convenient.

People should be accountable for their actions.

"The State" started a program it should be able to end a program especially the programs which utilize real finite resources taken from the tax payer by an advocate organization with a vested interested in increasing their slice of the tax payer pie.

I for one do not support abortions. If people don't have the money for birth control then they should abstane. With all the education there is on birth control, a woman should know when she is in her fertile period. I don't see the tax payers paying for birth control devises.

I have none of those , but I pay taxes and I do not believe in "killing children". When I go to the voting booth my vote counts just as much as one of those peole that think they have the right to "kill unborn children" because of their body parts. We lose some and we win some but we are not going away!
