Anthony Makk Might Stay: Surprise Obama Deportation Announcement Tips The Scales For SF Couple

Due to a surprise announcement by the Obama administration to consider same-sex marriage in deportation decisions, as reported by The Huffington Post, Australian-born Anthony Makk, who is currently facing deportation, may be able to stay in the U.S. with his husband Bradford Wells.

Earlier this month, The Huffington Post reported the story of Anthony Makk and Bradford Wells, a same-sex married couple that faces deportation for Makk when his visa expires on August 25. Makk and Wells have lived together for 19 years and were legally married in Massachusetts in 2004. Makk is also the primary care taker for Wells, who suffers from AIDS.

The stress of Makk's deportation was intensified by Wells' unstable health condition, which worsened when he suffered symptoms of a heart attack in June, as reported by SF Weekly.

But according to the Obama administration's decision, deportation cases will now be reviewed on a case-by-case basis, taking into account a number of factors, including criminal history and family. In the decision, same-sex couples will be considered family.

Wells called the new policy "a really big step in that the government is showing compassion to gay and lesbian families," according to SFGate.

"There is no doubt that the press attention surrounding their story was noted by the Department of Homeland Security, and that we are on their radar today in a way we had not been before," said Steve Ralls, a spokesman for Immigration Equality, in an interview with SF Gate.

Makk applied for permanent residency earlier this summer, but was denied — a decision he is appealing. The new immigration policy does not currently apply to Makk while he appeals, but will likely aid him in achieving permanent residency if he is denied.

Besides same-sex couples, the new policy could also benefit students and members of the military, family of military service members, spouses and parents of citizens, the elderly and minors, caretakers, asylum-seekers and abuse victims and the mentally and physically ill. Because Makk is married to a citizen, has no criminal history and is the primary caretaker to a citizen, his case could be favorable.

According to The Washington Times, Illinois Democrat Rep. Luis V. Gutierrez celebrated the decision, saying, “Today’s announcement shows that this president is willing to put muscle behind his words and to use his power to intervene when the lives of good people are being ruined by bad laws.”

I hope that they will be allowed to stay in the US. For those who want to see them deported: they are legally married but because of DOMA their marriage is not federally recognised. This is just one of the injustices perpetrated by DOMA. I am so glad for this development.

This is great news and I sincerely hope everything works out for Anthony Makk. I'm happy the administration is taking steps towards equal rights. I hope a full repeal of DOMA will be next.

Isn't the President supposed to uphold the laws of the land???

What can a President DO when faced with clearly UNJUST laws? He can't just change them all by himself. A little compassion is always the right thing to do.

I certainly hopes the Obama administration reconsiders this decision to deport Anthony Makk, who is Bradford Wells' long-time life partner and primary caregiver. I also hope the Obama Administration QUITS WAFFLING on gay issues so when they do occasionally do something postive for gay people, we can relax and enjoy it rather than wonder whether Obama's right hand knows what his left hand is doing. The inconsistency of this administration on gay rights issues is VERY frustrating. One would like to trust it, but the record so far is sort of like Charlie Brown trying to kick the football held by Lucy Van Pelt.

Why should EITHER of them leave/be forced to leave?

Since immigration is a Federal Department and same sex couples would be recognized by this Federal Department this means the Federal Government is recognizing a same sex couple in spite of DOMA! Huge step forward! Huge step toward repealing DOMA. Huge step toward Federal GOvernment recognizing individual states same sex marriage status!

Better than trying to buy the "hate gay community" vote.

Obama probably sees 50 years down the line, when people will wonder how a country whose founding charter proclaimed "we hold these truths to be self evident, that all (men) are created equal" could have treated these citizens- who didn't choose to be born gay- so shamefully- before Obama.

He's going to get credit for gradually but forcefully requiring equal rights for these people. Mark my words.

It is just sad that President Obama and the dims play identity politics around election time. Where has he and his Congressional dims been since his election?

Why did they not propose meaningful legislation to resolve these matters when they controlled both houses of Congress and the WH?

I am afraid my homosexual, Latino and Hispanic friends are being played as pawns for election purposes. If Obama-Ried-Pelosi really had cared about them, they would have passed and signed legislation to end these matters once and for all.

I've been down on the TP for a couple of things.First,when Michelle BAchmann said she was under fire at a Bosnian airport (With her daughter -kelsey,I think)
Secondly,they're so anti science they believe in IQ.And SAT's.How ridiculous can they be.
