Michael Pena, NYPD Officer Accused Of Rape, Held On $500K Bail

NEW YORK — An off-duty New York City police officer accused of raping a teacher was being held on bail of $500,000 cash or $1 million bond after appearing in court Saturday.

Officer Michael Pena was arraigned in Manhattan Criminal Court on charges of first-degree rape, criminal sexual act and predatory sexual assault.

His aunt, Ramona Pena, told WNBC-TV that the family was shocked by the allegations.

"He's a gorgeous person. He's a person with a lot of moral value," she said.

The television station reported that his attorney, Juan Campos, said in court that his client was "a very soft-spoken, peaceful individual." Campos could not immediately be reached by phone for additional comment after the arraignment.

Authorities say Pena grabbed the 25-year-old woman off a residential street in upper Manhattan, showing her a gun, before walking her several blocks through an alley to a deserted backyard, where he raped her.

He was arrested Friday by officers after police say a witness saw through her window that something was happening in the backyard and called 911.

His loaded gun was recovered near where Pena was standing, according to the criminal complaint.

Pena, an officer in the 33rd Precinct in Washington Heights, has been suspended without pay. The alleged rape took place in the neighboring Inwood section.

In the spring, two NYPD officers were acquitted of charges they raped a drunken woman they had been summoned to help get out of a cab.

The officers were convicted of official misconduct for repeatedly returning to the woman's apartment while telling dispatchers they were elsewhere.

The police department fired the two officers within hours of the May verdict.

Just a question. Why would a police officer leave his gun at the scene of a crime? Wait a minute why would anyone leave a gun presumably with their fingerprints on it at the scene of a crime?

He felt perfectly safe to rape this woman in an alleyway. Maybe it because he's seen other NYPD officers acquitted for the same crime. Wake up New York and make an example out of this rapist.(alleged)

Innocent until proven guilty, but if he is guilty I'm sick of the bad apples in Law Enforcement giving a bad name to the good Police officers that are really there for the community to " Protect and Serve"

Police officers who break the law should be subject to double the penalties that an ordinary person would face. What possible excuse can this sick individual give for his actions? Not only should he be locked up but every dime he has in the world should be awarded to the victim.

I agree that the penalties should be twice as harsh for trusted servants that, betray the public with their brutalization. Maybe if there were laws in place to do this; such laws may deter their desire to commit such crimes. I suggest instead of thinking about what should be done that we as citizens band together to form a petition, place it on the web, bring it into neighborhoods and then submit it to our legislative branch of government for a vote of approval. But we should also focus on getting media exposure for this intended law. I believe we can get over a/million signatures!!
