Alabama Immigration Law In Court: Obama Administration, Civil Rights Groups Face Off With State

BIRMINGHAM, Ala. (AP) -- Lawyers for the federal government and for a coalition of civil rights groups asked a federal judge Wednesday to block a new Alabama law cracking down on undocumented immigration, arguing that it stomps on basic rights, like freedom of speech and freedom to travel.

Deputy Assistant U.S. Attorney General William Orrick told U.S. District Judge Sharon Blackburn in Birmingham that sections of Alabama's law -- which has been described by opponents and supporters as the toughest such law in the country -- should be blocked because they conflict with federal law.

But an Alabama legislator said in an interview that the law was intended to protect the rights of citizens.

Blackburn was holding a hearing on lawsuits filed by the U.S. government, civil rights groups including the American Civil Liberties Union and Alabama church leaders that seek to block the new law signed by Gov. Robert Bentley in June.

Orrick said the new law intrudes on the authority of the federal government. Judges have blocked all or parts of similar laws in Arizona, Utah, Georgia and Indiana.

"There's no room for the states to be legislating in this area," Orrick told Blackburn, who listened to three hours of arguments from opponents of the law Wednesday morning. She was to hear arguments later Wednesday from Alabama Attorney General Luther Strange and other attorneys for the state asking her to let the law take effect Sept. 1.

Orrick told Blackburn that the law makes criminals out of people who rent houses to undocumented immigrants and in some cases makes it a crime to work.

Orrick argued the law harms the reputation of the U.S. with other countries.

"It corrodes the reputation of the United States for American values like openness and welcoming others," Orrick said. He also criticized a section of the law that requires schools to report the immigration status of students, saying it would make parents afraid to send their children to school.

After hearing the arguments from Orrick and other plaintiffs' attorneys, Republican state Sen. Scott Beason of Gardendale, one of the lawmakers who sponsored the law, said he did not hear any discussion of the rights of legal Alabama residents.

"I didn't hear the federal government of the ACLU arguing about the rights of citizens of Alabama who have been displaced from their jobs by these illegal immigrants. Who's looking out their rights?" Beason said in an interview.

He defended the provision requiring schools to report immigration status of students, saying the information parents will be asked to provide "is not different from what other parents have to provide. I have to show where my kids were born."

During the hearing, ACLU attorney Cecillia Wang questioned a provision of the law allowing police to detain people after a routine traffic stop if they suspect them of being in the country illegally. She said the provision would turn "law enforcement officers into immigration agents" and would subject innocent citizens to detention while their immigration status is being determined.

Blackburn frequently interrupted attorneys and indicated she would address the issues in depth in her written ruling, but she gave no indication when she would rule.

Blackburn told Southern Poverty Law Center attorney Sam Brooke that she was leaning toward accepting arguments that some parts of the Alabama law pre-empt the authority of the federal government.

"I very much want to look at the pre-emptive issues," Blackburn said.

At one point, Blackburn urged attorneys on both sides to avoid the passionate political arguments that might be made if the issue was being debated in the Legislature.

"The issue for me is not whether I would have voted for this statute. The issue for me is whether it's constitutional," Blackburn said.

I wish these ignorant busy body's that have littl else to do with their lives would go away.Ya I am totaly against illegals and I am all for whatever it takes to weed em out and get rid of them.Hell,we can't take care of our own people right now much less taking care of illegals.We really need to get a whole lot tougher on this problem

Ignorant busybodies are people who become, just off the tops of their heads, constitutional scholars who understand that due process of law and/or protections guaranteed by the Constitution of the United States of America shouldn't apply in cases where they themselves can't understand WHY? without paying attention and maybe reading a little bit.

The State of Alabama finds that illegal
immigration is causing economic hardship and lawlessness in
this state and that illegal immigration is encouraged when
public agencies within this state provide public benefits
without verifying immigration status. The State of Alabama
further finds that certain practices currently allowed in this
state impede and obstruct the enforcement of federal
immigration law, undermine the security of our borders, and
impermissibly restrict the privileges and immunities of the
citizens of Alabama. Therefore, the people of the State of
Alabama declare that it is a compelling public interest to
discourage illegal immigration by requiring all agencies
within this state to fully cooperate with federal immigration
authorities in the enforcement of federal immigration laws.
The State of Alabama also finds that other measures are
necessary to ensure the integrity of various governmental
programs and services.

Maybe I am being a little thick but I do not get it. When people are here illegally they are breaking our laws. The federal government will not enforce the laws on the books nor will they come up with a real solution for the problem. So states, who are actually taking the hit of illegal immigration, decide to clean up their own back yards and the progressives and the fed cries foul. Seems to me that the world has been turned upside down and anyone looking to turn it back is vilified. But that's just me...

Recognizing that you are a bit thick is the first step in a cure.

In this country, we are supposed to comply with the Constitution in enforcing the law. The problem here has nothing to do with laws curtailing services to illegal immigrants (who are, I understand, not a great problem in Alabama, anyway); it is the fact that it authorizes--no, REQUIRES--police and sheriff's deputies to pick up brown people and take them to prison without charges, to keep them until someone on the outside is able to locate their ORIGINAL immigration papers or birth certificates.

This situation is not unique. It is an ALEC model law, which if you are not familiar with them are a set of about 2,000 laws (810 of which have been leaked to the press) that are being pushed through in 32 Republican-controlled states at a rapid pace. The first state to pass it was Arizona, and after a great deal of litigation, the unconstitutional portions are still pending. Since two Supreme Court. justices are members of ALEC, the safety of the Constitution in this matter is far from assured.

U.S. federal law requires aliens 14 years old or older who are in the country for longer than 30 days to register with the U.S. government and have registration documents in their possession at all times. The Act makes it a state misdemeanor crime for an alien to be in Arizona without carrying the required documents and obligates police to make an attempt, when practicable during a "lawful stop, detention or arrest", to determine a person's immigration status if there is reasonable suspicion that the person is an illegal alien.

Funny how the immigration advocates claim that this law is trumped by federal law, but when another federal law (Secure communities) is used, they claim that localities should decide whether or not to apply it.

I read it. You need to read it too. You can find it here: http://e-lobbyist.com/gaits/AL/SB256 It appears that the majority here assume that this means police will be targeting people they "suspect" being undocumented. It goes much much deeper than that. I posted earlier regarding how this would affect EVERY U.S. citizen - of ALL ages - using public libraries in Alabama with this law. Every time you walk in the door, you will be required to show proof of citizenship before using any items or services. Even if you are the grandma of the employee checking - it must be done according to this law. The approved types of id are things like Drivers license, current passport, and military ID. They have photos. But what about children? What provisions are made for their proof of citizenship? Do they carry their birth certificate around? State approved photo IDs are expensive. Who will pay for this? Also, children grow and change every year and will need a new ID.

I believe that something needs to be done. But this law is not the solution. State, county, and municipal workers should NOT be enforcers of federal law.

You are missing the point. School teachers and librarians do not have the skill set necessary to this job. This law forbids using any kind of profiling. This means that all U.S. Citizens are assumed to be undocumented people until they prove they are not. Therefore - guilty until proven innocent.

The U.S. Immigration and Customs Enforcement (ICE), the largest investigative agency in the Department of Homeland Security, is responsible for enforcing the nation's immigration and customs laws.

You completely ignored the statement regarding undocumented children. Most American children don't carry their birth certificates every day. However, this law specifies photo id. Where do parents go to get a state authorized photo id for their children by September 1st? Therefore, when children go a public library in Alabama, and are asked by the librarian for proper id, they will be denied access as is mandated by this law.

Another point:
It’s not uncommon for Alabama to find itself near the bottom of nationwide rankings, and that was the case with the recent Kids Count survey released by the Annie E. Casey Foundation. Alabama was 48th, ahead of only Mississippi and Louisiana.

These children are already vulnerable for the unfortunate fact they live in Alabama. The "unintended consequences" of this law are horrible.

Another point:
If that librarian lets children use the public library without state authorized ids, that librarian just committed a crime - not civil disobedience - but a crime punishable by law.

what about all the families that are going to be riped apart by this new law. noone is thinking about the kids.there are alot of mixed families that are in alabama. and alot of mixed kids that are going to lose dads and moms. what are they going to do when this happens? you cant help who you fall in love with.

I agree - you can't help who you fall in love with, but you can help yourself and take responsibility for the choices you've made. You can go back with your spouse and if there are kids involved, take them as well, as the family unit is more important than the country they were born in. People need to take responsibility for their choices instead of being given a pass and continuing to enable this behavior knowing full well the person shouldn't be here in the first place. Also, children should be only given citizenship to parents who are both legal citizens, not only one - this reduces this constant refrain of mixed families - with this in place no more mixed families. Thanks for bringing an important issue.

And we are using them to do dangerous jobs without medical protection or workers' comp that our own people--even unemployed--can't conceive of doing because so many end up with no future after a short period in that work. For example: A fairly common accident when harvesting lettuce is to cut off one's hand. Americans in a job like this would expect some kind of economic protection, which is why those employers won't touch them, and they don't want the jobs anyway.

When the State of Michigan, at the beginning of the auto industry failure, tried changing the law to exclude LEGAL migrant workers, the southern part of the state was redolent with rotted produce in the fields.

There will NEVER be an end to this Story, not until what's wrong is fixed, and illegal immigrants are not being allowed to enter the United States I'm not ignorant or mean spirited, just very mad. We can all understand the plight these people are in.What we don't like is that these illegal immigrants ie Mexicans,puerto rican's coming into MY COUNTRY the IMPROPER WAY.Why are they more special than the other illegal immigrants waiting in line with Visas, paid their monies to go through the PROCESS TO BECOME A US CITIZEN?? Those people have paid large sums of money to do things the RIGHT WAY, dont you think they are pretty pissed off and mad that Obama is now allowing the illegal's to come in FREE??? It's wrong. And I don't believe any Judge should be referring to OUR CONSTITUTION for indivduals that are not US CITIZENS, for the United States Constitution is for AMERICAN'S, LEGAL ONES, not ILLEGAL IMMIGRANT'S! The President and his Cabinet and other's work for US, we AMERICAN'S. There obligation is first and foremost to American's. As I see it, President Obama has reneged on his oath, the Senator's have also regeged on their Oath to the American's of the United States Of America. Impeachment process should begin immediately. Our Representatives have chosen other illegal nationalities to "Bring forth prosperity both monetarily and physical/work wise" BE KNOWN, BEFORE THE AMERICAN PEOPLE THAT THEY THEMSELVES MADE A PROMISE TO BRING PROSPERITY AND SAFETY.

My great great great grandfather fought to remove British rule here, so they need to go home and fight for their freedom and quit asking the tax payers of this country to pay!

The current administration especially should quit challeng and start enforcing Federal Immigration Law, to the letter of the law, not some policy. When a President starts displacing laws with Policy, it is time for a replacement that will follow the law and not try to change it with his own desire to pimp for votes.

While traveling on business in this south for many years, I saw contractor load up hotel rooms with illegal workers. I see the same workers on road and other high paying jobs. The lie contractors spew is that they are better workers. Facts are they don't have to pay workers comp, and other regulatory cost. When the illegal worker get hurt, he drops him off at the hospital where the citizen pay, because he has no money. Too many citizens are out of work, though Obama cares more for the illegal person rather than the citizen he is obligated too support. Incidentally, I an a lifelong democrat who voted for Obama. I can no longer vote for a person who does not have the interest of the citizens oner that of illegal workers.

High-paying jobs? Like what? Truckloads of workers go out in the heat for 12 hours a day, using dangerous and antiquated equipment, for pay that makes minimum wage look like a bonus. I'd be interested to know where they take these truckloads of guys crammed into hotel rooms that they get these fabulous wages.
