Alabama Immigration Law Blocked By Federal Judge

BIRMINGHAM, Ala. -- A federal judge temporarily blocked enforcement of Alabama's new law cracking down on illegal immigration, ruling Monday that she needed more time to decide whether the law opposed by the Obama administration, church leaders and immigrant-rights groups is constitutional.

The brief order by U.S. District Judge Sharon L. Blackburn means the law – which opponents and supporters alike have called the toughest in the nation – won't take effect as scheduled on Thursday. The ruling was cheered both by Republican leaders who were pleased the judge didn't gut the law and by opponents who compare it to old Jim Crow-era statutes against racial integration.

Blackburn didn't address whether the law is constitutional, and she could still let all or parts of the law take effect later. Instead, she said she needed more time to consider lawsuits filed by the Justice Department, private groups and individuals that claim the state is overstepping its bounds.

The judge said she will issue a longer ruling by Sept. 28, and her temporary order will remain in effect until the day after. She heard arguments from the Justice Department and others during a daylong hearing last week.

Similar laws have been passed in Arizona, Utah, Indiana and Georgia. Federal judges already have blocked all or parts of the laws in those states.

Among other things, the law would require schools to verify the citizenship status of students, but it wouldn't prevent illegal immigrants from attending public schools.

The law also would make it a crime to knowingly assist an illegal immigrant by providing them a ride, a job, a place to live or most anything else – a section that church leaders fear would hamper public assistance ministries. It also would allow police to jail suspected illegal immigrants during traffic stops.

Finding a way to curtail public spending that benefits illegal immigrants has been a pet project of Alabama conservatives for years. Census figures released earlier this year show the state's Hispanic population more than doubled over a decade to 185,602 last year, and supporters of the law contend many of them are in the country illegally.

Isabel Rubio, executive director of the Hispanic Interest Coalition of Alabama, which is among the groups that sued over the law, hopes Blackburn will block it entirely but was happy with the temporary reprieve.

"We are pleased that Judge Blackburn is taking more time to study the case," she said.

Republican Gov. Robert Bentley said he would continue to defend the law, and GOP leaders in the House and Senate praised Blackburn – a Republican appointee – for taking time to fully consider the law.

"We must remember that today's ruling is simply the first round in what promises to be a long judicial fight over Alabama's right to protect its borders," said House Majority Leader Micky Hammon of Decatur. "To put it in sports terms, it is the first half-inning of the first game of a seven-game World Series."

While the Obama administration contends the state law conflicts with federal immigration law, state Sen. Scott Beason, R-Gardendale, contends the federal government isn't doing its job enforcing immigration laws. Beason said that he spent years researching immigration law to help write the 70-plus page law, and that it's unrealistic to expect a judge to go through it all in a few days.

"You just can't do that," he said.

I couldn't help but to reply to this. I actually just read this article, and normally I could care less about what goes on in the news, but you say that the law may prohibit charities from helping someone here illegally? What about the people who are born here, who have fallen on hard times? My sister just moved back to Illinios from Tennessee, she has a college degree, and is having a hard time finding a job, but yet, she called the public assistance office for some help, maybe just wic or insurance or food stamps to get her by for a couple of months, and she was told, Why? you don't have kids, or seem like you need help?? Really??? Because she was white, educated and single with no kids, she got denied.. So I say, everyone is racist, it just depends on who you are talking to.

best solution I've heard was from a comic,Micky Dean---shoot all illiegal immigrants,crossing into the US with tranquilizers darts, carry their asses up to Casnadaian border, when they wake up, they run across into Canada- not our problem anymore!! If only it were that easy~! What is wrong with asking,no demanding that people come into this country LEGALLY??? We will offer them support, welcome them even, but ,good Lord, DO IT LEGALLY!!!!!

The problem is they get all they need without becoming legal. They don't want to pay taxes. Most of them live here with the thought that they are going back to Mexico one day. They send all their money to Mexico and don't bother getting documented.

Why real legal Americans support this law:
1. We do not give a c$%p what Obama wants in the way of new illegal voters.
2. We have separation of church and state - churches get out of my politics.
3. Illegal Immigrants have no more rights than any lawfully residing person.
4. Everyone questioned, ticketed, detained, interviewed by the Police must identify themselves - there is no racial profiling going on at all.
5. Skinheaded omobob : All detainees receive due process - they are adjudicated as not lawfully present and are to be deported. You have Afganistan confused with Alabama.
6. The 14 th Ammendment is being celebratred by this law(s) everyone must give up their ID.
7. La La Liberals quit trying to make illegal aliens permanent residents here - you are making a mockery of the lawful process that other legal immigrants cooperate with.

Who is hating anyone? I don't think anyone "hates" undocumented foreigners. We just don't have the funding it requires to take care of them. We are also frustrated with the Feds for not doing their job. It has nothing to do with hate.

I support national biometric fingerprint/iris ID cards for US citizens. It's coming to that. Who can you believe are who they say they are? Identity theft and false documents for illegals are a big business. Can't tell the players without a scorecard.

To answer your question, from another post, No I do not lock my doors when I sleep.  To be perfectly honest, we don't even know where our house keys are.  My purse and car keys are in my car.    We live in the country.  Our property is fenced and gated.  We fenced to keep the deer out of our gardens.  I would never live where I felt that unsafe.  Fear and I do not get along.

Why is this an issue??? Police and Sheriff's departments in every state stop and arrest without probable cause! This seems to me that all they're doing is shinning a light on themselves. They have NO PROBLEM stopping and harassing blacks and whites for no reason and without probable cause. So let me ask, "Why get approval on Hispanics and other obviously potential aliens? If you're going to quash this for Hispanics because it is unfair and illegal then lets STOP the Police and Sheriff's Departments from illegally stopping and profiling African Americans. Hippocrates!!

The fact that this story has over 8K comments says that it is a hot-button one. When I started complaining about the deluge of Hispanics in my last 'hood, I was viewed by some as intolerant. It takes people living on the front lines and having to deal with this firsthand to understand exactly what takes place. I have nothing against Mexicans. Of course, I need to add Guatemalans, Pervuvians, Columbians, etc. And let's not get started on the Poles and such. But when you move somewhere humble, yet quiet and safe, just to get away from the crime and higher costs elsewhere, it isn't very nice when a group comes in and starts spraying graffiti, littering, gangbanging, and blasting their subwoofers from cars. We had two new schools built and an addition on a school in ten years. Taxes shot up. That's what it does....

How can you Repubs be so uninformed? You have "nothing against Mexicans." Of course not. You just happen to mention "deluge of Hispanics" and "living on the front lines" when you refer to your 'hood. Your views are bigoted/intolerant through and through. I know you know this already. But as for increase in property taxes, those are tied to property values. The more values of homes increase, the more schools needed, the more taxes are increased to pay for those schools and all business/commerce that comes with it. Why don't you move out? That might improve the neighborhood, at least the friendliness quotient.

First of all, your reading comprehension is rather limited. Note that I said "last 'hood" which means that it is now in the past. I am Hispanic and I was very happy to see diversity in this town of (admittedly) some racist residents. I AM NOT A REPUBLICAN!!! You ASSumed as much because you are so conditioned to see things as black and white, which is not a very sophisticated outlook on life. I was glad to see a deluge (yes, that is exactly what it was) of people of color UNTIL I saw what they brought with them, the above-mentioned blight.
As for the taxes, most of the dwellings in my tax base were rentals! And the cost of building the schools was what drove up taxes! DUH!!!!!

The REAL reason there's so much discontent regarding the current immigration system is, of course, NAFTA.

NAFTA was crafted for and by the megacorpor­ations, no one else. The Europeans acknowledg­ed that free trade and commerce also entails free movement of labor - that's the only way it works properly, hence any European can live and work in any of the member states. NAFTA, however doesn't accommodat­e this and when large corporatio­ns move in and agglomerat­e many of the family farms in Mexico, displacing 2 million workers, guess where they end up?”

Then why are EU countries cracking down on illegal immigration? Why - Because it brings little value to the table and works against the interest of citizens!

Denmark has re-instituted border controls and are charging illegals, their families and employer for the cost of deportation.

Holland is cracking down on illegals and is hotly debating border control.

France is cracking down on illegals and has started mass deportation of Romanians.

Britain has just voted to start deporting illegals back to their country of entry into the EU.

Italy started cracking down on illegals some years ago but is still struggling with the problem.

Greece has started construction on a border fence to keep illegal out.

Let's say there are only ONE million illegal immigrants in the U.S. right now, and they all only spend $1 per day. If we deport all of them tomorrow, then tomorrow we will lose $1 million dollars, and the next day, and the next, etc. Thing is, there are likely many more than 1 million illegal immigrants and they surely spend much more than $1 per day. So, my question is: How do we safely remove this much money from our economy? I know EVERYONE has statistics to show how much money illegal immigrants supposedly cost us every day, but does anyone have numbers to show much money they're spending in the U.S. on a daily basis?

(1) The premise of your comment is that illegal immigrants have savings, when generally speaking it has been researched that most do not have either discretionary or disposable income. In fact, most studies of the positives of illegal immigrants usually calculate that at least 10% of take home pay is sent out of the USA as a remittance to family members outside the USA.

That is one problem with your premise

(2) Another problem with the premise of your comment is that whomever hired the illegal immigrant, will just give up on why they hired the illegal immigrant and shut down, if the illegal immigrant is no longer in the USA and/or available. Not likely. More likely that the employer or customer would try harder to find someone in the USA to do the work. (Contacting high schools since teen unemployment is at the highest levels since recording began in 1948, contacting unemployment offices, contacting places of worship, etc.) USUALLY, that means by offering better wages, or offering benefits, or by offering a safer work place. Etc.

Basically, if the same function is done by a person in the USA at the same price, the economy will not lose anything. Even if the price is slightly higher, the economy will benefit because more taxes will be paid, more consumer goods will be purchased, and the nation will be safer because USA regulations are being adhered to.

(1) That doesn't make sense. If they're sending back 10%, then they're spending 90% here. So, that leaves us with 900,000 gone instead of 1 million. I'd still consider that a big chunk of change.

(2) Not sure where I implied all of THAT, but, being a high school teacher, I can tell you that you seriously overstimate the work ethic of American youngsters. To imagine a 16-year-old AMERICAN trying to fill a 3-gallon bucket with blueberries for a whole $2/bucket is absolutely comical.

It is a known fact that BILLION$ are sent back to Mexico or other countries - by illegal Aliens - that would be 100% of the money spent in the USA - if Illegal Aliens did not displace Americans for these jobs.

When a country is in a bad state, they look for a scapegoat. Hence, the illegal immigrants. Most of them work at jobs that many Americans frown upon, and we didn't have a problem with that when the economy is in a better situation. Now, it is hard to find a middle class job, and it must be the immigrant's fault who will work for a below minimum wage job. Please go somewhere with that logic.
