Houston Mom Got Daughter Abortion To Hide Rape, Officials Say

HOUSTON -- A Houston woman got an abortion for her 12-year-old mentally disabled daughter in an effort to hide evidence that her son sexually assaulted the girl, authorities said.

The woman made her initial court appearance Monday on a charge of tampering with evidence. Prosecutors allege in court documents that she took her daughter to a Cleveland clinic, where she had an abortion on Oct. 22.

Her 19-year-old son was indicted earlier this year on three counts of aggravated sexual assault of a child under 14 years old.

The names of the accused are being withheld to protect the girl's identity. The Associated Press doesn't identify sexual assault victims.

During an interview with investigators in December, the girl, who has moderate mental retardation, said her brother had sex with her in March 2010 and on several other occasions.

"She said she got pregnant because he had sex with her and said her mom took her to Ohio to have an operation so it wouldn't hurt when the baby came out. (The girl) said she told her father ... that her brother ... was the father of the baby," according to a probable cause affidavit.

Authorities say the mother knew of the investigation in the case and she "attempted to conceal evidence, the fetus/biological evidence, by taking (her daughter) to have an abortion in Ohio so the evidence would not be available for the investigation," according to the affidavit. Investigators say they recovered the fetus. The girl was about 22 weeks pregnant at the time.

The 50-year-old mother had tried getting the abortion a week earlier, but her daughter was too hysterical at the time, according to court documents.

Court records did not show an attorney for the woman, who made her initial court appearance on Monday. She did not immediately return a telephone message left Tuesday at her home.

Her son's attorney, Christian Capitaine, said that the mother, as a concerned parent, had every right to seek an abortion for her daughter, whom the woman might have believed would not be capable of taking care of an infant.

"I do expect the evidence will show she did not do that in order to prevent her son's prosecution or in order to somehow tamper with evidence," Capitaine said.

Capitaine said that at the time of the abortion, the mother was unaware an investigation was going on that was focusing on her son and that the son wasn't charged in the case until April.

"What you have is a case where folks are jumping to conclusions," he said.

Capitaine said the son denies sexually assaulting his sister. His case has not been set for trial.

The girl, now 13, and her 12-year-old sister were taken into custody in November by child welfare officials. The girls' family relinquished their parental rights earlier this month and the girls remain in foster care, said Gwen Carter, a spokeswoman for the Texas Department of Family and Protective Services.

"The girls are doing as well as can be expected. Our plan is to look for an appropriate adoptive home for them," Carter said.

Her 12 year old was pregnant. At 22 weeks, she would have been showing. The girl identified her brother as the father of the child to her parent. The mother takes her to get an abortion. I note that the article does not mention if the parents questioned how their 12 yr old disabled daughter got pregnant in the first place. As soon as the mother knew her daughter was pregnant, why didn't she file a report with the police? And then, to drive from Texas to Ohio for an abortion? That was a cover-up. Mom didn't need to know there was an investigation into her son at the time. She was attempting to cover up the situation before an investigation could even begin. Makes you wonder if the parents knew about it all along...

I am OUTRAGED right now! As a community awareness activist against molestation, I see parents trying to cover up and protect the violator ALL the time! If you're going to get the abortion why not report him as well? She was trying to protect her son and cover this up. People don't understand that the aftermath of molestation can ruin your whole life and how you function! The mother's job was to protect her child from harm, instead she lied to protect her son...THE VIOLATOR!!

Siblings sexually abusing siblings is a fact of life that is often not reported. It is typical for the moms and dad's to deny and cover up the abuse. It is not known, however if the abortion was to protect the daughter from having to raise a child that was a product of rape. I can understand a mother wanting to help her daughter obtain an abortion from a rape, especially when the baby has a higher chance of having birth defects because of the shared DNA, and the fact that the young mom is not competent to care for the child.

Dream on. Kids are never safe in the revolving homes they find in fostercare. Right now people care more about rescueing pitbulls than they do rescueing kids in the United States. We don't have any reality television shows about people attempting to rescue and rehabilitate abused kids. Sad.

What a mess. The brother sounds like one sick pup. And where were mom and dad when these rapes were taking place? I can see a mother not wanting her twelve year old daughter to have a child, especially a baby that might be a product of incest, but traveling from Texas to Ohio to have the procedure does sound quite suspicious. The parents should have contacted the police if they really knew nothing about their son's "activities" instead of trying to handle it themselves. I feel terrible for the girls, and I wonder what the younger sister experienced that hasn't been told yet. The article says that investigators recovered the fetus. Wow! I can't imagine having that task. Twenty-two weeks is rather far along, too. I hope Huff Post updates us on the DNA results. Oh, well. Best luck to the girls.

I agree with you flower. I can't imagine the moms dilemna of having love both the offender and the victim as your children. Easy choices don't exist but abortion Must be available in cases of rape and incest. If it weren't we could force preganancy on people
via rape. Rape happens a lot and so does incest.

From what I read, the mother is guilty. The father is guilty. The brother is guilty. I hope it was the doctor or the staff of the clinic who reported this crime, or they are guilty as well. They have a legal mandate to report crimes against chidren. Even if she didn't tell them what happened, she was not only under the age of consent, she was mentally handicapped as well. I hope they have counseled and questioned the litte sister, to make sure she was not a victim as well. I pray for the girls.

she's in texas and has something to do with obtaining an abortion...that is probably grounds for execution...texans don't care if the fetus was a product of incest, isn't that right, dr. paul?

My goodness there are so many reasons for Family Services to take the two preteens out of that home!! Stats show that mothers always protect the boy child if he is abusing the girl/girls in a family. There are numerous psycological reasons that change as a baby boy grows and changes and comes into his sexual self, but mama will help and protect her son as much as she can. This young man will probably be off to rape other young girls as soon as he is able and free to do so. These are families that produce serial rapists and killers.

There is no such thing as "always" when it comes to human beigns.

Do stats show what "mama" does when daughter is the molester? Or do your stats show that girls NEVER molest?

It isn't uncommon that family members would protect family members in cases like this, gender notwithstanding.

Are you seriously suggesting that when girls are caught molesting, "mama" will gladly turn her over to the authorities, but will "always" protect the son?

Must be why The System goes easy on girls but brings the hammer down on boys- all those serial rapist and killer nurturing mamas.

Do you have some sort of verification of these "stats" and killer/rapist producers?

Disgusting, the mother knew, the girl told her father. The father did nothing and the mother made the little girl get an abortion. I think both parents should be brought up on charges. The son is a sexual predator. If he didn't get caught now, he probably would have been caught in the future. I hope he is put away for a long time.

interesting that the focus is on the mom? the freakin brother is a predator. the thought of violating your family member is horrific enough but to defile a child who has limited capabilities is such a breech of morals. well he will learn the hard way when he gets a roomie who thinks he is his sister
