Madonna Heads To Court Over 'Material Girl' Line

Uh oh -- the Material Girl is in trouble.

Women's Wear Daily reports that Madonna has been hit with a lawsuit by L.A. Triumph Inc. for the name of her "Material Girl" clothing line and that Madge's request to throw out the lawsuit has been denied.

In the suit, first filed a year ago, California brand L.A. Triumph claimed it has been selling a clothing line called "Material Girl" since 1997. Therefore, writes WWD, it arguably hold trademark rights stemming from first use.

But, as Madonna shrewdly claimed, she herself coined the phrase back in 1984 with her song of the same name.

That argument, however sensible it sounds (and it does sound really sensible to us), is not enough to throw out the lawsuit. Judge S. James Otero rejected the argument, allowing for an October trial.

If Madge ends up having to rename the line, we recommend that she return to her musical catalog for inspiration. "Express Yourself" has a nice ring to it. Or she could capitalize on a major fall trend and go with "Lucky Star." And of course, "True Blue" would work if she decided to focus on denim.

We can't wait to see what she'll wear to trial. As we've seen, many celebs treat the courtroom as a fashion runway.

If someone has something trademarked, and you don't, than they own that term whether or not you conceived it first. It works just like patents. Well with patents you can get a temporary one- year provisional patent for a date of conception, but nonetheless you still have to get documentation. Sorry "Madge"( What's up with that) but no matter who you are, you must follow intellectual property laws.

She did not trade mark the name. Little wayne came up with the term. BLING and did not trade mark it. Can you imagine if he did. Just because you say it doesn't me you own it. Thats why you have to be smart and go about it the right way. Madonna has a self entitled attitude that most So called STARS have. The name stars is ridiculous to me. Only one star in my life.

The title 'Madonna' is Italian meaning 'My Lady', usuallly ascribed to the Blessed Virgin Mary, Mother of Jesus, for over a thousand years before this Singer/Performer adopted said title to make lots of money off it.
Perhaps Christians should file a class action law suit against her for her use of that 'title' (name) - it's not like the singer invented it - she stole it, initially using it for the blasphemous shock value it had for her clueless fans and the financial gain this brought her.

The only problem with this line of thought is that Madonna is her real name. Her mom was deeply religious and Italian. This is her name on her birth certificate, not a stage name. And there are a number of other women with that name. So she can't be sued for her name.
