Denise Gay, Bystander in Shootout, Not Shot By Suspect LeRoy Webster

By COLLEEN LONG   09/ 7/11 06:25 PM ET   AP

NEW YORK -- Police ballistics tests have determined a shootout suspect didn't kill a bystander on her stoop near the route for New York City's West Indian Day parade. It's unclear whether the fatal bullet came from a police weapon or some other gun.

Denise Gay was shot dead Monday night while sitting outside her Brooklyn home.

The shootout had erupted nearby after the annual parade, which has been scarred by violence including fatal shootings in 2003 and 2005.

Witnesses say shootout suspect LeRoy Webster's bullet hit the woman. Ballistics tests indicate that didn't happen.

A .380-caliber bullet found in a door frame where the woman was shot hasn't been matched with any gun at the scene.

Webster is hospitalized and can't be reached for comment. He has no listed home phone number.

This is exactly the question I asked here when I first read about Denise's death. It was reported that the police fired over 70 rounds. Yet, there was no mention of what kind of bullet killed Denise. Too many cops have guns and simply can't be trusted with them. It is inexcusable that, in a city as densely populated as NYC, police fire off over 70 rounds at one suspect. Additionally, with only 2 of those rounds hitting the suspect, it is absolutely amazing that more people weren't hurt or killed.

I absolutely agree! I live there and I was there that night and no doubt in my mind the police killed that poor woman. The cops were totally unprofessional in firing that many rounds. And now, of course, the police presence in the neighborhood has been INCREASED. It's ridiculous.

It doesn't matter. Webster will still be charged with the murder.

I hope not because the police instead of the criminal will be blamed. I'm sure no good (uncorrupt) officer intends to hurt a civilian.

Its tragic when innocent people get killed in other peoples crimes. Sorry that Deniese Gay losty her life to mindless violence. The suspect Webster is hospitalized does it mean he is no longer a suspect since it was not his gun that killed the woman? If he is not the shooter, who else might have a 38 calibre gun to kill an innocent bystander?

Despite the ugly history of this parade/zoo, It politically incorrect to attempt to do away with it and it also brings in over one billion (with a "B") in gross revenue for NYC. As far as the cops, whom I usually don't defend, they were wound up so tight because of the history and craziness of this event that there was going to be an overreaction even if a piece of paper was dropped on the street.
The annual Puerto Rican Day parade which goes up 5th Avenue in Manhattan along Central Park was so out of hand, that the buildings along the parade route (which are the most exclusive and expensive addresses in the City) began putting full size plywood barriers between the public sidewalk and the buildings themselves. It was an actual fortress style fence. There were also hired security to protect the buildings because of craziness, vandalism, assaults, rapes and on and on. Of course, for the same reasons as the parade in Brooklyn, the City refused to stop the madness. After a few years of the "your not welcome on our street", the organizers of the parade became so embarrassed that they decided to take the right steps to control the stupidity. It seems to have worked. Maybe the residents in Brooklyn should take steps to embarrass this event as well.

I don't know about NYPD, but I've seen local police at the range and they can't shoot straight. Mostly laughable, but a little scary.
