Mark MacPhail's Mom Agonizes Over Troy Davis Execution Wait

09/21/11 08:39 PM ET   AP

COLUMBUS, Ga. — The mother of a slain Georgia police officer says she is agonizing over the wait while the U.S. Supreme Court decides whether to allow the execution of Troy Davis.

Davis was convicted 22 years ago of shooting her son Mark MacPhail. Davis insists he is innocent and has appealed to the U.S. Supreme Court.

Anneliese MacPhail told The Associated Press on Wednesday she's "a nervous wreck." Her comments came about 90 minutes after Davis' scheduled execution had passed.

She says Davis has had "all the chances in the world" to clear his name.

Murdering people based upon flimsy evidence and recanted witness testimony to appease the grieving relatives of someone who was murdered is spectacularly idiotic.

And you wonder why people cheered during the debates when the moderator brought up the fact that Texas has executed 234 people? Look at these comments!

It doesn't seem to matter to some if an innocent man is put to death, even though we've seen over the years many innocent people released after years of incarceration! While I'm a supporter of the Death Penalty, today, I'm REALLY rethinking my position. I think that it should be BEYOND ANY REASONABLE DOUBT!! Because unlike releasing a prisoner that was found to be innocent years after being convicted of the crime. You CANNOT RELEASE anyone from the grave and you cannot UN-KILL anyone!

death penalty does not solve anything
all states should ban execution

Hi I have followed this case and felt very bad for the mother, son and family of the off duty cop.
Now after hearing that is not enough proof. The mother wanted him to get executed to fill her heart before she dies. Well guess what i am happy to hear that your heart isnt filled and will never be and happy to say you deserve what you got.

So are you happy now? Are you jumping for joy? Does this make your son come back? If you believe in God do you think he's jumping for joy as well? The death penalty diminishes us as human beings when we use the state as an excuse to have state sanctioned murder posing as justice. And you do know of course that it is not up to him to have to prove his innocence but rather the state must prove it beyond a reasonable doubt? Or are you so vested in your hatred, your anger, your slavering for vengeance that it makes no difference who pays so long as someone pays? Is that what your son was being a police officer for? To make sure someone somewhere pays irrespective of innocence or not? You may publicly say your thirst for blood payment has been slaked but I know you will never admit this but you yourself will always deep down, wonder if your joy over the death of a man might be joy for the wrong man. You will.

The McPhail family won no victory. GOD claimed the victory and freed Troy Davis from this evil and sinful world.

Mrs MacPhail, I am sorry for your loss but the system in the United States does not require the accused to prove innocence; it requires the state to prove guilt beyond a reasonable doubt. The point here is that reasonable doubts have been raised and it was not too late to re-examine the case. Shame on you, Mrs MacPhail for choosing to mark this moment by dishonoring the very system of justice your son died to uphold.

Gshepnyc: I could not have worded this better. I agree with you 100%. I would rather have a person sit in jail until this could get sorted out rather than execute someone with reasonable doubts remaining.

I thought that guilt had to be beyond doubt before a death penalty could be imposed, or is that just for wealthy white folks?

If there was no death penalty and a convicted killers would be sentenced to life in prison, the healing process of the victims family would start earlier, there would be no reason to wait for years and years for the execution to finally find peace. So many years of their lives wasted, opening the wounds over and over again through all the appeals, waiting for revenge.

"agonizing" over waiting for troy's death?

did it bring your son back, Mrs. MacPhail?
11:57 PM on 09/21/2011
I hope the family of the security guard is going to sleep better now. I wonder why it took 22 years for the MacPhail family to have peace. I will get the satisfaction in knowing that Troy's family will continue to fight for justice and his dealth will not be forgotten. May both families put God first and ask God to give you both peace.

I think it would take a particularly sick mind for them to think killing this man will bring them peace.

I sincerely hope it does not to be honest.
