Sarah Palin Lawsuit? Ex-Governor Threatens To Sue Book Publisher, ABC Reports

Sarah Palin Lawsuit

First Posted: 09/26/11 09:49 PM ET Updated: 11/26/11 05:12 AM ET

ABC News reports that Sarah Palin is considering suing Random House, the book publisher that released The Rogue, a highly critical book about her life by writer Joe McGinniss.

According to ABC, Palin family attorney John Tiemessen wrote a letter to Maya Mavjee, the publisher of the Crown Publishing Group (a division of Random House) in which he spelled out the family's legal grievances against McGinnniss.

Tiemessen also makes reference to an email in which McGinnis describes Random House lawyers expressing concern that his reporting amounted to little more than "tawdry gossip."

“The final work that was published contains most of the stories that Mr. McGinniss complains were nothing more than ‘tawdry gossip’ that amounted to the wishful fantasies of disturbed individuals,” Tiemessen writes. “Since both your company, and the author, clearly knew the statements were false, admitted they had no basis in fact or reality, but decided to publish in order to harm Governor Palin’s family, you and Mr. McGinniss have defamed the Palins.”

McGinniss created instant controversy when, in 2010, he rented a house adjacent to Palin's in Wasilla, Alaska to work on his expose. Among the more lurid allegations in his book: Palin snorted cocaine off an oil barrel, slept with a string of black men, and may not have been the real mother of Trig, her fifth child.

"The Rogue" has received largely negative reviews from mainstream media outlets, which have criticized McGinniss' book for its reliance on thin sourcing. Janet Maslin at The New York Times said that sections of it were "too nasty to be lucid." Nick Gillespie at The Washington Post wrote that McGinniss "serves up any and all rumors and calumnies about Palin, the more salacious the better." Slate reports that the book may have backfired on its author by creating a wave of sympathy for Palin; the result of all the unconfirmed accusations mean that "even regular critics feel a bit sorry for the former governor."

For his part, McGinniss, who made his name with the 1968 book "The Selling of the President," about Richard Nixon's re-election campaign, thinks his book has been underplayed by the media. Politico reports that the author complained on the website Firedoglake that NPR refused to book him for fear of losing Congressional funding for appearing too biased.

CORRECTION: An earlier version of this article suggested that "The Rogue" had alleged that Sarah Palin may be the real mother of "Trig, Bristol Palin's baby." Trig is in fact Sarah Palin's fifth child, and the book discusses rumors that Bristol is Trig's real mother.

Please, please, please, sue. It'll do a lot for book sales.

Sarah Palin's Alaska was so phoney that she made the beautiful scenery of the state look tacky.

To be coiffed and manicured as she was when she was supposedly fishing or shooting a moose was weird. Her kids kind of disappeared or appeared when they were needed.

Just looking at the slickers she was wearing when "fishing" showed either that she is wealthy enough to buy new equipment or that she doesn't do it all that much. When she shot the moose, supposedly the sight was off, so she had to shoot at it several times. Either she didn't shoot often enough to have the sights set, or she was careless with the gun. Neither points to an individual that has a great deal of skill.

I watched, hoping that the show would be about Alaska, but it was a vanity piece about her. I've noticed that it hasn't been repeated. Maybe the faithful watched it at first, but it quickly became tiresome.

Correct me if I'm wrong, but since Palin is a public figure, and especially since she's put herself and her family on "reality" TV, the standard for winning a court case for her becomes much higher.

I'd love to see her sue. She's going to have to prove that the book contents were not only false, but that they were intentionally so.

She doesn't have to sue McGinnis because nobody is buying his book anyway or Levi's for that matter..Conservatives actually want to shake his hand because he pushed her popularity up that much more.

I hope she does sue. She's made her and her family public figures by not only entering the political arena, but by also appearing on "reality" TV.

To simplify the standard she'll have to meet in order to prevail:

The more she threatens, the more the book will sell.

Sarah's biggest critics are Republican Alaskans. Her biggest supporters come from the lower 48.

Alaskans don't really blame her for cashing in, but they don't like quitters.

Palin is a freak, fake, fraud, and a fool!!! Let's see her GO THROUGH with the law suit. There's no telling what else might come out about her in the process. Huff Post is far too kind to this stand up one liner commedienne without a clue to suggest there's any doubt as to the truth in McGinniss's book. After all, this book is not the only source that says that Palin is a lousy mother, left children here and there at random. There's too many people who have said the same thing about her. And I have absolutely no doubt she slept with every black man she could. Is it any wonder she refers to Herman Can as the "flavor" of the week. That was just a Freudian slip on her part.

Having committed the acts written about in the book, Palin knows everything is true.

If she sues it will only be that she and her (inept) lawyer think that McGinniss and Random House don't have proof of what the author alleges.

Of course, Palin and her lawyer know full well that McGinniss and Random House would not publish the book without being able to back up everything (besides, on reading specific detail Palin knows the information could only have come from people supplying McGinniss with evidence).

Just as Palin can read the tea leaves and would not waste her time announcing a run for president, so too has Palin read the book and won't dare sue.

They don't have to have proof, but statements from several sources who claim to have seen particular behavior will suffice.

As I said before, McGinniss and Random House can back up what the author says in the book and Palin knows it. Here is what McGinniss just said in regards to the e-mail (that of course was taken out of context):

"Not only my editor, but Random House attorneys verified every source, in some cases speaking directly to the sources themselves. I have dozens of hours of recorded conversations.

Random House attorneys listened to them all, then made an independent judgment about the trustworthiness of the sources. No material from an unverified source is included in the book. Many details were omitted for that reason.

Obviously, any writer would like to be able to name every source. In this case, the climate of fear the Palins created in and around Wasilla made that impossible. After seeing how Sarah reacted to my moving next door, many people became afraid for their own safety and said they’d talk to me only if I guaranteed confidentiality. When I felt I had to, I did.

Anonymous sources have a long and honorable tradition in U.S. journalism. Look at Woodward and Bernstein and “Deep Throat.” Just last week, the NY Times had a story about the Mets third baseman and quoted an anonymous source. In twelve books written over 42 years, I’ve never been through a legal vetting like this one. It lasted for months."

Also telling in the interview with Nick Broomfield, director of the upcoming documentary: "Sarah Palin: You Betcha" by Awakening Films, he said:

"People in Wasilla which is this small Evangelical community of 5,000 people are very frightened of talking out, particularly on camera.... People were so worried about her influence that she might run for president. They came and talked on camera and it wasn't like they were knocking on my door to come and do interviews. I had to spend a long time ingratiating myself in getting their confidence so they would take part."

I am sure that McGinniss had the same problem, but I have no doubt, the same as this film director, he can back up everything he says should push come to shove, aka Palin's lawsuit (that will never happen, unless her addiction to attention, cameras and lights overwhelms her to where filing suit over this book is all she has left to get the media to once again focus on her).

Why "threaten" to sue. She tout herself as "rogue" and "maverick", "Pull your AK47 off your back and start shooting, Sarah, don't threaten unless you're going to go through with your threats." After all, what leverage does she have against the book, now that's it's out? If she was going to "threaten", she should have done that before the book was published. Just another Palin-style grandstanding. They're getting old.

I have been saying in here that McGinniss and Random House have the goods on Palin and can back up what the author says in the book. They both welcome Palin bringing the book to light and they want Palin to sue (it is then that they will bring out the evidence to show everything alleged in the book is accurate).

Of course, Palin knows that so that's why she will not sue. To be sure, Palin knows exactly who all her enemies are and that they would have no problem testifying against her in a trial. (Most probably relish being "forced" under a subpoena to say what they know.)

Mark my words, when Palin drives around Wasilla she knows the entire town is out to get her (that's why she wants to move to Arizona).

Proof that this is Palin's environment is the upcoming documentary: "Sarah Palin: You Betcha" by Awakening Films. The film's director, Nick Broomfield, stayed weeks in Wasilla. He said:

"I tried extremely hard to find people to say nice things about Sarah Palin. I talked to her old school friends and Republican colleagues.

They were all incredibly da-mning of her. It is almost like the people closest to her were the most dam-ning of all.

So I think Joe McGinniss came out with the same problem. It is people can't believe that there aren't people saying wonderful things about Sarah Palin. But of course her lowest approval rating is in Alaska."
03:42 PM on 09/28/2011
I read a post from one of her supporters (on C4P, I think?) who is so convinced that she will sue and win and a percentage of the proceeds from the book will go to her that he went out and bought the book, so she could get the money from his purchase of the book. THESE are the kinds of people she attracts!
10:23 PM on 09/29/2011
Just wow.
12:08 PM on 09/28/2011
Probably just saber rattling, more of the scorched earth Palin takes to all who cross her. But I wish she would sue McGinniss, there could be not better way to get rid of this horror than to have the author's evidence against her corroborated in open court. It won't happen, though, Sarah knows the truth, and it's the LAST thing she would want revealed.

I'm sure all the police detectives, FBI agents, crime lab technicians and forensic anthropologists who have dug through garbage, sieved dirt through maggot-infested dirt and even crawled through sewers and septic tanks to find evidence to identify and convict criminals are charmed by your sentiment.
