Osama Bin Laden Photos Must Stay Secret, Obama Administration Contends In Court Documents

WASHINGTON — Public disclosure of graphic photos and video taken of Osama bin Laden after he was killed in May by U.S. commandos would damage national security and lead to attacks on American property and personnel, the Obama administration contends in a court documents.

In a response late Monday to a Freedom of Information Act lawsuit filed by Judicial Watch, a conservative watchdog group seeking the imagery, Justice Department attorneys said the CIA has located 52 photographs and video recordings. But they argued the images of the deceased bin Laden are classified and are being withheld from the public to avoid inciting violence against Americans overseas and compromising secret systems and techniques used by the CIA and the military.

The Justice Department has asked the court to dismiss Judicial Watch's lawsuit because the records the group wants are "wholly exempt from disclosure," according to the filing.

Tom Fitton, president of Judicial Watch, accused the Obama administration of making a "political decision" to keep the bin Laden imagery secret. "We shouldn't throw out our transparency laws because complying with them might offend terrorists," Fitton said in a statement. "The historical record of Osama bin Laden's death should be released to the American people as the law requires."

The Associated Press has filed Freedom of Information Act requests to review a range of materials, such as contingency plans for bin Laden's capture, reports on the performance of equipment during the May 1 assault on his compound in Abbottabad, Pakistan, and copies of DNA tests confirming the al-Qaida leader's identity. The AP also has asked for video and photographs taken from the mission, including photos made of bin Laden after he was killed.

The Obama administration refused AP's request to quickly consider its request for the records. AP appealed the decision, arguing that unnecessary bureaucratic delays harm the public interest and allow anonymous U.S. officials to selectively leak details of the mission. Without expedited processing, requests for sensitive materials can be delayed for months and even years. The AP submitted its request to the Pentagon less than one day after bin Laden's death.

In a declaration included in the documents, John Bennett, director of the CIA's National Clandestine Service, said many of the photos and video recordings are "quite graphic, as they depict the fatal bullet wound to (bin Laden) and other similarly gruesome images of his corpse." Images were taken of bin Laden's body at the Abbottabad compound, where he was killed by a Navy SEAL team, and during his burial at sea from the USS Carl Vinson, Bennett said.

"The public release of the responsive records would provide terrorist groups and other entities hostile to the United States with information to create propaganda which, in turn, could be used to recruit, raise funds, inflame tensions, or rally support for causes and actions that reasonably could be expected to result in exceptionally grave damage to both the national defense and foreign relations of the United States," Bennett wrote.

Navy Adm. William McRaven, the top officer at U.S. Special Operations Command, said in a separate declaration that releasing the imagery could put the special operations team that carried out the assault on bin Laden's compound at risk by making them "more readily identifiable in the future." Before his current assignment, McRaven led the Joint Special Operations Command, the organization in charge of the military specialized counterterrorism units.

Taxpayers also fund the activities in the White House, but you can't go into the West Wing or the family living quarters during a White House tour; use some logic -- it is not in our best interest to publish the photos.

Agreed. 100%. If the other countries knew what was going on with the "Manhattan Project", or at Oak Ridge, Tennessee, or Hanford, Washington,in the 1940's, it's quite possible we would be speaking a different national language. I was taught welding by a guy that helped build the Oak Ridge project. He said it was the only job he ever had, that you weren't allowed to quit. It was either do your job, or go to prison. The only thing he knew, was he was building the overhead steam lines used to heat the buildings. Most of them are still being used. They were built overhead because it was easier to repair if a leak occurred, and they didn't have time to dig ditches and bury them. They worked each day, through the winter, rain, and mud that was everywhere.
I guess this "Judicial Watch " character Fitton, would try to stop the project, had he been alive, and aware it was going on. To function as a country, considering all that's going on worldwide, secrets need to be kept, like it or not. Take a ride sometime down south to The Savannah River Plant. You won't be able to find answers to all your questions. It's 310 square miles, of Federal property where the Department of Energy does "nuclear stuff". It's been there since 1954, and operating today.
I think it's accurate to believe Osama bin Ladin, is gone. That's all I need to know.

Because he is dead in their custody, an "official" decision is made to throw the body into the ocean, and withhold all proof of this event from the citizenry. Check the accuracy of your claim -- that helo crash killed other members of Seal Team 6; none of those killed were involved in the bin Laden operation.

The whole deal was done in the best possible way. No country in their right (or wrong) mind wants a martyrs monument on their soil. Even our enemies treat the dead with respect (usually). As for the proof, the proof is their if one opens their eyes. The government isn't into the business of faking things like this. We certainly didn't fake landing on the Moon and we still have people who question it.

And when you download it, and open it in Adobe Illustrator, you can see for yourself that it's a poorly fabricated fraud, with multiple layers, mixed fonts, mixed greyscale and binary, lines that don't line up that should, or line up that shouldn't, letters that are 100% identical pixels to other letters (not possible with 1960s typewriters), rotated segments, halo effects, numbers out of order, etc., etc. Yeah, it's not hidden, and neither are the bogus features to one who looks.

How many times has our government lied to us? I'm talking known knows, the things we know they've lied about. Not mentioning the known unknowns, the things they've lied about but we can't prove. From the Gulf of Tonkin incident to weapons of mass destruction and much much more, this government has no creditability with informed Americans. This is why we need proof!

Let's see -- you prefer the possibility of compromising operational security and/or intelligence sources and methods to ensure that you are convinced that bin Laden is, in fact, dead. That's neither reasonable nor smart. As regards the WMD issue, there was a "legion" of policymakers, intel analysts, and regional specialists who decried the Bush administration's decision to invade Iraq needlessly and recklessly, and many of them risked their careers in trying to stop that nonsense. As for the Gulf of Tonkin, we didn't have the information age available then as today to expose Johnson's folly and lies as we do today.

The tangible proof of bin Laden's death is not needed to prevent a war or invasion as you cite in the other two examples. Proof of his death has been provided to members of the House and Senate intelligence committees -- for the sake of accountability and concurrent security concerns, your proof has been provided and validated.

I still think "getting" Bin Laden was a really big deal. I think some of the folks I see at the rally's have a short memory. Unless they have that Bush mindset, where Bush was not really concerned about getting him, not because he couldn't, right? What a joke.
