Alabama Immigration Law: Key Parts Remain, Churches Lose Fight

HUNTSVILLE, Ala. (RNS) A federal judge jolted the national immigration debate on Wednesday (Sept. 28) by approving most parts of Alabama's aggressive immigration law that religious leaders had called the "meanest" in the nation.

In a ruling hailed by many state officials, U.S. District Judge Sharon Lovelace Blackburn refused to block much of Alabama's far-reaching immigration law from going into effect.

Blackburn's decision came after three separate challenges were filed by the U.S. Department of Justice; Catholic, Episcopal and United Methodist bishops; and a coalition of civil rights groups, unions and individuals who said they would be harmed by the law.

The Justice Department argued that immigration law enforcement rests with the federal government, and that states could not set up their own systems. Blackburn disagreed, saying Alabama's efforts mirrored the federal government's or were complementary.

Plaintiffs, led by the Hispanic Interest Coalition of Alabama, said they will seek an emergency delay of Blackburn's order pending an appeal to the Atlanta-based 11th U.S. Circuit Court of Appeals.

"Today is a dark day for Alabama," said Mary Bauer, legal director for the Southern Poverty Law Center. "This decision not only places Alabama on the wrong side of history but also demonstrates that the rights and freedoms so fundamental to our nation and its history can be manipulated by hate and political agendas -- at least for a time."

United Methodist Bishop William Willimon, who had crusaded against the law, continues to oppose it, but said it was "good news" that Blackburn struck down a provision that made it illegal to harbor or transport an undocumented immigrant.

Willimon and other religious leaders said the provision would have hampered churches' ability to minister to all, regardless of immigration status.

"We will continue to provide food, shelter, transportation, housing, and the church's sacraments to all of God's people, regardless of race, class, or citizenship status," he said in a statement.

Similar but less far-reaching laws in Arizona, Georgia, Indiana and Utah have been temporarily blocked by federal courts, but Blackburn found that Alabama's laws were generally consistent with the intent of Congress, which gave the states a supporting role in immigration law enforcement.

She also pointedly disagreed with court rulings that blocked Arizona's immigration law on the grounds that immigration law enforcement was the unique responsibility of the federal government.

The judge refused to block a portion of the law that authorizes police to conduct immigration checks during routine traffic stops. She also left in place a new system that requires public schools to check students' immigration status upon enrollment.

Blackburn blocked parts of the law that bar illegal immigrants from seeking work, as well as a new traffic penalty for motorists who stop in the roadway to hire day laborers.

The judge's decision emphasized that blocking a law before it is implemented is a drastic step that requires clear evidence that the Constitution and will of Congress would be violated.

Alabama Gov. Robert Bentley said the law, even without sections that Blackburn blocked, is the "strongest" immigration law in the country. But he also promised to fight to see all sections take effect.

"With those parts that were upheld, we have the strongest immigration law in this country," he said. "I believe that all sections of our law will be upheld."

Which position is the most fair, protect the ability of illegals to work or protect the rights to Americans and/or legal immigrants to work? One will be at the expense of the other.

America has become such a cruel place that not just immigrants be US citizens are
leaving. Alabama will taste the bitter fruit of this foolish move when the low wage
labor pool is all gone and the costs of services, food and all the other things these
people do, skyrockets, as the economy continues to collapse. They will lose
sales, sales taxes, excise taxes, property taxes, rental income, fees for licenses,
registrations and the services these people buy. The costs of all of these will
increase markedly and be borne by the fools who support these types of
"political cleansing" laws. A society, any society depends on labor to function.
Any attempt to destroy that labor pool is foolish beyond measure. America is
consuming itself with fear and ignorance.

Unemployment & food stamps add up to nearly double what these job positions pay. MINIMUM WAGE 32 HOURS PAYS $800 A MONTH after taxes. UNEMPLOYMENT $1120 A MONTH! FOOD STAMPS $408 A MONTH! THAT'S $1528 A MONTH TAX FREE! $12 AN HOUR TO STAY HOME with free medical! (Undocumented immigrants cannot apply, stop lying saying they get benefits. NO VALID ID = NO BENEFITS federal law in every state since 1979.)

If you lose your job the absolute minimum you will earn in the entire USA is $12 HOUR TO NOT WORK! No wonder unemployment is so high! Nobody wants minimum wage jobs (only an illegals that don't qualify for any of these free benefits.) Without these abused minimum wage workers EVERY FACTORY, FARM, RESTAURANT, & CONSTRUCTION COMPANY IN THE ENTIRE USA WILL CLOSE. Anti-immigration laws are stupid! THEY RUIN THE ECONOMY!

In Alabama we've already had 10's of thousands of jobs lost, several poultry factories closed, thousands of restaurants shut down, food rotting in the fields, and it's ONLY BEEN 2 DAYS! And keeping immigrants out of school, that only saves virtual dollars, you can't just close the whole or fire teachers when 1 of the 50 students skips class because his parents are legal!

Exodus 22:21 - "Don’t mistreat or oppress an immigrant, because you were once immigrants in the land of Egypt." + 14th Amendment + Moral Obligation to help the less fortunate + Nation's foundation on escaping oppression

This isn't rocket science!

The Lord reiterated His law in Leviticus 19:33-34:
"And if a stranger sojourn with thee in your land, ye shall not vex him. But the stranger that dwelleth with you shall be unto you as one born among you, and thou shalt love him as thyself; for ye were strangers in the land of Egypt: I am the Lord your God."

Indefinite detention unless a suspect prove innocence seems vexing, let alone constitutionally questionable. Where did Alabama come up with this scheme, from ante-bellum fugitive slave laws?

Religions are always at the crux of a problem. Catholic Church & others: Don't Mess With Alabama. Alabama is the role model for all other states, especially those of us in The South and Southwest who are directly impacted by these deviants who don't belong here in the first place.

I would be really concerned about a law that allowed law enforcement officers to check immigration status in traffic stops. It is a safe bet that many people will be stopped for speeding, changing lanes without a signal, having a tail light that is not functioning, and other things if they are spotted driving while "looking Hispanic." I say that as one of the whiter looking guys around.

Americans who favor weak immigration laws probably aren't aware of the REAL numbers involved. Here they are: 20 million in the amnesty. allowed to bring 10 family members into the country. That is 200 million new residents, most who are poor, don't speak English, and don't want to. These folks will not assimilate into our country. They will dominate it! Now after this amnesty, America will be beset by millions of new aliens wanting to become residents on the following amnesty. It just never stops. Wake up people...Reinforce our borders and laws!

Churches need to reject their superstitions and focus into discussions of Dawkins and Harris. Church Illiteracy is rampant. If I have a desire to talk to the illiterate I know where to find em. I go to church. Reasonable people don't feel comfortable. I reuse to go.

Dawkins and Harris declaring that their new religion is the only true religion is not going to help. We need to keep religion out of government; all religions. Evolution and Creation are not opposing theories. They have nothing to do with each other. Neither can be proved nor disproved. Belief in one or the other has become religions sponsored by political parties.
Both are totally irrelevant in government. They are distractions used by our Representatives so We The People don't realize that our Representatives don't represent We The People or work for us, even though we pay their wages.

Nothing in science is ever completely proved because new information gets added to what has already been learned. Evolution has been put to the hypothesis and evidence test repeatedly. It is one of the strongest theories (tested hypotheses) in science. Creationism is not an hypothesis that has been tested; it is a parroting of the words of Bronze Age people.

According to the Christian Bible, no one or thing is righteous. Righteousness only comes from god as a total gift. Both sides of the issue are violating Separation of Church and State.
Both sides are using religion as political rhetoric. Both sides need to discuss the issue without using religion as a weapon.

Jesus said exactly that when someone asked how anyone could pass the "camel through the eye of a needle" test. He said that getting into Heaven would be impossible, except for the grace of God. That assumes, of course, that all humans are essentially evil. Based on all the killing that God does, that seems like an accurate description of God's perspective about humans.

So let's see: make sure kids aren't in school (that'll lead to great things in our communities) and drivers can be harrassed for "their papers;" however, it's okay to employ illegal immigrants. Well, that is some kinda crazy.

No new news to hear that the Church doesn't want to obey the laws of the land.

The Church has disobeyed its own teachings on sex, and have paid out hundreds of millions to its victims in every major diocese of the U.S.

The Churches have also defied its own tax-exempt status thru its many political campaigns to deny Americans their constitutional rights.

Enough is Enough!

What's the big deal? When the Republicans ended Slavery in the 19th century, all the Democrat slave owners suddenly found themselves without a cheap workforce. They adjusted. The current crop of farmers will adjust as well and it will have a beneficial outcome for America.
