Alabama Immigration Law: Police To Enforce Controversial Provisions Following Court Ruling

BIRMINGHAM, Ala. (AP) -- Police in Alabama are getting ready to enforce what is considered by many as the toughest immigration law in the nation.

Beginning Thursday, authorities can question people suspected of being in the country illegally and hold them without bond, and officials can check the immigration status of students in public schools, Gov. Robert Bentley said.

Those two key aspects of Alabama's new law were upheld by a federal judge on Wednesday.

The governor said parts of the law take effect immediately.

"We intend to enforce it," Bentley said.

U.S. District Judge Sharon Blackburn, a Republican appointee, wrote in a 115-page opinion that some parts of the GOP-backed law conflict with federal statutes, but others don't. Left standing were several key elements that help make the Alabama law stricter than similar laws passed in Arizona, Utah, Indiana and Georgia. Other federal judges have blocked all or parts of those.

There are three separate lawsuits against the Alabama law, including a challenge from President Barack Obama's administration. Blackburn's ruling is expected to be appealed.

John Carroll, a former U.S. magistrate judge who is now dean of Samford University's law school in suburban Birmingham, said Blackburn's ruling was mostly consistent with decisions from other states with the exception of her allowing Alabama's "stop and ask" provision, which lets police request people's immigration papers.

"I think down the line there are other arguments that can be made as the case goes forward," said Carroll.

Agricultural leaders fear the law could cost farmers money this autumn by scaring away Hispanic workers who are vital to harvesting crops statewide.

"There are some sweet potato farmers in this state it's really going to hurt. I don't know how they're going to get their crops out," said Jeremy Calvert, a farmer in rural Bremen.

Zan Green, a tea party activist in metro Birmingham, said she was happy with the decision, saying citizens of foreign countries have benefited for years through welfare, entitlements, education, medical care and child tax credits.

"Judge Blackburn's ruling is the beginning of removing the enormous financial burden of illegal immigration from the backs of Alabama citizens," she said in a statement.

The judge refused to block a section of the law that requires public schools to verify students' citizenship and report overall statistics to the state, but the immediate effect isn't clear since schools have already started. Alabama was the first state to include such a provision, so Blackburn's decision could set a blueprint should others adopt similar laws.

Immigration became a hot issue in Alabama over the last decade as the state's Hispanic population grew by 145 percent to about 185,600. While the group still represents only about 4 percent of the population, some counties in north Alabama have large Spanish-speaking communities and schools where most of the students are Hispanic.

Alabama Republicans have long sought to clamp down on undocumented immigration and passed the law earlier this year after gaining control of the Legislature for the first time since Reconstruction. Bentley signed it, saying it was vital to protect jobs of legal residents.

Republican Sen. Scott Beason, one of the sponsors of the bill, was happy with Blackburn's decision and hopes, like the governor, that the entire law takes effect after appeals.

"There are still legal questions and there's still work to be done," he said.

Blackburn's orders temporarily blocked several parts of the law until she can issue a final ruling. Those measures would:

_ Make it a crime for an undocumented immigrant to solicit work.

_ Make it a crime to transport or harbor an undocumented immigrant.

_ Allow discrimination lawsuits against companies that dismiss legal workers while hiring undocumented immigrants.

_ Forbid businesses from taking tax deductions for wages paid to workers who are in the country illegally.

_ Bar undocumented immigrants from attending public colleges.

_ Bar drivers from stopping along a road to hire temporary workers.

_ Make federal verification the only way in court to determine if someone is here legally.

Not going to happen with a patchwork of state laws, especially with laws such as Alabama's. Alabama's simply harasses people and encourages racial profiling. Legal immigrants are angry and are leaving our state en masse. The courts will eventually strike down these laws as the Constitution gives the federal government the sole power to deal with immigration. The federal government NEEDS to get its act together and DO IT. Both Bush and Obama promised to reform immigration and have done nothing. Bush promised the "guest worker" program and nothing happened. "Green cards", or visas, are extremely difficult and expensive to get for the average person hoping to immigrate. Obama's "Dream Act" is still somebody's dream.

The only legal immigrants who are leaving are those who have harbored illegals here.

Most illegals have a support system of legal residents, many of whom are recent immigrants. If we had a law that would make it a deportable crime to knowingly harbor a illegal it would stop -until then they will hide their friends and family. That is just human nature.

So the family of two legal immigrants with their 8 family/friends who live with them leave the state. Alabama wins.

Please note that State Senator Scott Beason, the author of Alabama's immigration law, was overheard on tape in federal court last summer (a case involving gambling pay-offs to legislators) referring to African Americans as "aborigines". Yes, this law has had racial overtones from the get-go. I'm an Alabamian and do not support this mean-spirited harassment of immigrants that we encouraged to come here to start with to do the jobs that others turned their backs on. Althought most people agree that our immigration laws need reforming- very much- harassing people's children, racial profiling, and charging someone with a felony for trying to get a car tag isn't the way.

In the coming days route 95 north will be choked with pickup trucks containing loads of household goods lashed on with twine. All headed to a state with looser laws. When Norfolk VA cancelled all homeless support funding a few years back - the homeless vanished from the waterfront - without the free food and shelters they moved on to make a vicitim of another municipality.

Additionally, I would like to point this out.

Blue Collar Union Plant Workers: Average Pay $27 per hour. Support Union bosses to steadily drain the equity, capital, and revenue profits from the plant; forcing to either close or relocated to more favorable places; like other states or offshore. Reason for most strikes; better health care plans.

Illegal's: Average Pay $6. Willing to work extra hours with no overtime pay, no health care insurance, no tax benefits because only can be paid under the table; however, must pay taxes on consumer goods, such as food, clothing, shelter. Reasons for work: better pay than in foreign country, and labor income too low to support low-income American's basic needs.

Cons to Illegal Immigrants: the need for social services.

Pros: Severally reduces cost of goods and services for Lower Income Americans.

Reality: Jobs that are primarily filled by illegal immigrants do not always deduct taxes that support social services that are required to support and supplement the financial needs of low income Americans; thereby, limiting tax revenues that would support greater social services to supplement both Americans and illegal immigrants equally.

It is clear to me to know that HP only want to post articles and comments that support Law demonizing illegal immigrants. I know this, because they refuse to post my comments.

The real problem is the system, not the illegal immigrants. The systems in place have all but failed. But demonizing Latinos, and not all the other illegals is not the way to go.

The system in place creates too much entitlement to too many Americans that abuse the system. It is only because of laws that discourage discrimination that allow ALL illegals the same benefits; not all benefits, but many.

There are countless Europeans, African, Asian, Middle Easterners, and Latino that are here illegaly. However, the U.S. only wishes to demonize Latinos by creating laws similar to those imposed on Jews prior to WWII.

OK, I know Alabama is only going after Latinos and not the Russians, Africans, Asians, or Canadians, etc.

However, here is what Alabama should do, scare off all the illegal immigrants. Then anyone that is legal and still on a social welfare system in Alabama should be required to do the labor that these illegal's were doing before they were demonized. Lets see how many Billy-Bobs and Bessy-Sues will pick Sweet Potatoes for their income. Oh yeah, don't forget to offer them health insurance. We don't want to be stuck subsidizing that too. Oh yeah, the money Billy-Bob and Bessy-Sue will make picking friggen Sweet Potatoes won't even pay their RENT, let alone Health Insurance. Oh, but its the illegals that are draining the financial resources of Alabama, right? Wrong, at least the illegals are WORKING!! G-Dmit!! GET A Friggen CLUE Already!! For crying out loud. Your white poor constituents are the problem to your financial crisis there. Hmmm, but Sally-Mae is more entitle to suck the welfare system than those that actually work.

Friggen idiots. Haven't these gov.s in capital of Alabama learned anything yet in the last 148 years? It is like they just don't get it.

And even tough Illegals hardly take the 3% of the US population, most anti-immigration protesters, say that, its draining their economy, they are scared that the 3% of that people will turn the US into a 3rd world country, that 3% keep the economy low... its funny cause out of the remaining 97% Legal born or naturalized citizens, 8% of them are indeed on WELFARE, and funny part of it is that, most protesters are usually employers of illegals immigrans, they are not going to pay some lazy hill billy $13+ an hr + over time to pick tomatoes or stand on top of a roof, and some hill billy wont do it for less. Its a proven fact. all this immigration issue its just a way that both parties can gain votes in this next election, the problem is that most americans give priority to worthless worries. Its funny cause I happened to drive by a low income area where most people where in welfare, and I saw most vehicles parked outside their homes worth twice as muh as mine... funny

Mexican investigators search for suspects after 35 bodies found in roadway

On the eve of a meeting of Mexico´s top prosecutors and judicial officials in Veracruz state, authorities Wednesday were still trying to determine who left 35 bodies in a busy thoroughfare there -- and why.

Investigators said a video may hold clues to how unidentified men managed to drive two open-back trucks filled with corpses through rush-hour traffic and then abandon them, blocking traffic as stunned onlookers watched.

Police in the Gulf coast state of Veracruz found the abandoned trucks and the bodies near a shopping mall in the municipality of Boca del Rio on Tuesday. Mexico´s state prosecutors and court presidents are scheduled to meet there Thursday

I hate to pay in USA in USA the "Greatest nation of the world; because still is private school for muy child." The public school is full of illegal immigrants kids. I do hate that, USA should charge stupid Mexican president for educating their people here. I said "enough is enough"

Actually, when you are in another country, they dont ask you for proof of STATUS, obviously you have never been abroad, The US is one of the countries that hardly requires a VISA of any kind to visit foreign countries, a passport would do... but the US requires a VISA to almost every nation to visit the country. You might wanna try to travel abroad sometime, and get to know people from around the world, most of them are quite charming and respectful, it might change your views towards illegals once you see their struggle at their home land... keep in mind that in the US only 3% of the population is illegal, the other 97% is not... that you happen to live at a place where alot of immigrants live, its another story

This is beyond horrific.. I am sorry to say, its no longer the terrorists we have to fear, but its our own government we should watch out for and fear. They are spiraling outta control, and the only monsters in the closet are us. Our Judicial system is so outta whack and irresponsible and nothing is being done to stop it. Don't get me wrong I am ALL for getting the drug dealers and gangs outta this country , but not hard working men and woman,who help support the efforts of our country, nor am I for not allowing kids to attend school , this is wrong on ALL levels. All children have a right to an education, and I am a tax payer who's money is being used to support their educations.How dare you single out children and put them in that position. I say we take all GOP officials and tea party members and send them out into the fields to handle these crops. Bunch of KKK bigots with a different symbol and name called GOP and Tea Party!! Shouldn't some of the blame be put on the employers of these people? Tell me that what these employers are doing is not the same as companies that re-locate to other countries.You put up numbers but these people have to live, eat, sleep and get around here. So I would figure that they have to pay rent, buy groceries, pay for gas. Not saying that the situation as is works, but at least they are putting something back into the economy. Can't say that for the corporations that move overseas.

How are "innocent" children being attacked or denied an education by this Alabama law? Every child's parents will be asked for their status in this country, not just some. Alabama merely wants to know who much it is costing their state to educate illegal alien children. Again, they aren't going to be denied an education so what are you talking about? How in the world does this equate to being a KKK bigot?

Mark, do you honestly believe that once they hit these school records that these children will be allowed back into school? That they won't be hurt by this somehow? Have you EVER been to an ICE detention center? I suggest you go and see for yourself exactly what is going on. Its not what you think.
