SANTA ANA, Calif. — A police officer charged with killing a mentally ill, homeless man during a violent arrest posted $1 million bail Thursday and was released from custody, his attorney said.

Fullerton Officer Manuel Ramos, 37, made bail with the help of family and friends and also posted some property toward the bail amount, said attorney John Barnett. He would not say who assisted Ramos or to whom the property belonged.

"He's just relieved to be out," Barnett said.

In California, defendants can often post 10 percent of bail, called a premium, to secure their release.

Ramos has pleaded not guilty to second-degree murder and involuntary manslaughter in the killing of 37-year-old Kelly Thomas in a July 5 fight that involved five other officers.

Another officer, Cpl. Jay Cicinelli, pleaded not guilty to charges of involuntary manslaughter and excessive use of force and is free on $25,000 bail.

Ramos and Cicinelli, who have been on paid leave, will lose their pay starting Oct. 8 pending the outcome of the case, acting police Chief Kevin Hamiton said.

The other four officers, who were not charged, will remain on paid administrative leave while the FBI completes an investigation and the Fullerton Police Department concludes an internal inquiry.

District Attorney Tony Rackauckas has said that when Thomas became uncooperative, Ramos snapped on latex gloves, held his fists in front of Thomas' face and said: "Now see my fists? They are getting ready to F you up."

Prosecutors have called the statement a turning point that set the tone for what could have been a routine arrest to spiral into a 10-minute beating that involved six officers.

Prosecutors have said Thomas was shocked four times with a Taser, kneed in the head, punched in the ribs and bashed eight times with the butt of a stun gun.

The coroner concluded the cause of death was mechanical compression of the thorax, which made it impossible for Thomas to breathe normally and deprived his brain of oxygen.

Barnett disputed the chain of events and said Rackauckas took Ramos' quote out of context.

"There is the statement, `You see these fists? They're going to F you up,' but the very next thing that's said is, `...if you don't do what you're instructed to do,'" Barnett said. "This wasn't a threat to simply beat someone; this was an instruction to comply with orders, lawful orders."

Ramos was told to return to court Nov. 4 for a pre-trial hearing.

The Fullerton police union issued a statement Thursday saying it did not contribute funds or assist in raising the bail money.

I understand why he is relieved to be out, what I don't understand is why one commits murder when they do not want to go to prison. That shows a major lack of common sense.

It's damaged from a fight. Professional fighters get ears like that from time to time. Sometimes it's worse.

What I'd like to know is why the other cops were not charged. According to the DA, a murder took place, and these cops just stood by and let it happen. Charges should be filed on them as well.

who cares what this guys mother and father where.there are many good parents with fd up kids and this is one of them.unfortunately the payers for this guys crime is the community of Fullerton,the tax payer,these cops are your employees,always remember this.they are not out there to protect the citizens anymore,those are the old cops that walked a beat.these guys today are little sissy that had there feelings hurt and there asses kicked when they where little now they have gun and a badge.i want to see a cop rot in prison for what they have done.please show me one.he will be found not guilty and the city will be sued and the community of Fullerton will pay his tab till his next incident.

THIS MAN IS ASKING PEOPLE TO LOOK AT THE RESULTS OF HOW THE LAW ENFORCEMENT WILL BE CONDUCTED ON HIS COUNTY, AND IT IS NOT CONSIDERING THAT A HORRIFIC KIND OF MURDER OCCURRED HERE!!!!! THEY FOUND MONEY TO BAIL THE ABUSIVE OFFICER OUT ON BAIL AND THAT IS AN INSULT FOR ALL AMERICAN CITIZENS, BECAUSE ANYONE COULD BE IN THE SAME SITUATION OF ABUSE WHEN IT COMES TO MENTAL ILL PEOPLE'S BEHAVIOR. THESE OFFICERS ARE IGNORANT AND ABUSERS OF THE WORST KIND!!!! THEY KNEW MR. THOMAS FROM THE AREA AND THEY KNEW THAT HE HAD MENTAL ISSUES, THE PROPER CONDUCT WOULD IT HAD BEEN TO CALL 911 FOR PROFESSIONAL TREATMENT OF THIS MAN!!

Not even with a bail out of 10 million dollars this man should it be free.!!!! The horrible picture of Mr. Thomas destroy face at the hospital bed is enough proof of the kind of abuse that this Ramos officer helped by other officers inflicted on Thomas body!!!! I believe it is an insult of the greatest kind of failing justice system that the judges allow this man to be free!!! money is not an issue here and yes it pays for not justice!!!!!!!

I think most people are angry that fellow officers posted his bail.

"most cops are good" Yeah, well NO ONE that gave this man money for bail is a good cop. Not a single one.

You either stand against corruption and bad cops, or you ARE part of the corruption and bad cops.

Friends, family, and co-workers are usually the ones that post bail for almost every person who is charged with a crime. Are you going to paint all of them with the same brush, or just hold these police officers to a different standard?
