HAMP Sees Third Straight Month Of Dwindling New Modifications

WASHINGTON -- For the third consecutive month, the Obama administration's signature housing help plan posted the lowest numbers of preliminary mortgage modifications since the program's start in the spring of 2009.

Just 13,000 homeowners received initial mortgage modifications from the Home Affordable Modification Program in August, down from 14,000 in July and 15,000 in June, already the fewest since April 2009.

When President Obama announced HAMP in February 2009, he said the program would use subsidies to encourage bailed-out banks to modify mortgages for as many as 3 or 4 million homeowners. So far, fewer than 700,000 homeowners have received lasting help from the program, which is overseen by the Treasury Department and was initially funded with billions of dollars from the Wall Street bailout. The slowing of new trial modifications suggests HAMP is less likely than ever to meet its goal.

Former bailout watchdog Neil Barofsky called the program's administrative failures "breathtaking" in remarks prepared for a congressional hearing on Thursday. He said that numerous studies and anecdotal reports, including a Tuesday ProPublica story, "confirm the widespread abuse suffered by homeowners at the hands of the mortgage servicers charged with implementing HAMP."

"The foreclosure crisis continues to wreak havoc on millions of American homeowners," said Barofsky, now a senior fellow at New York University Law School. Barofsky noted that while there have been fewer foreclosure filings in 2011 compared with last year, the slowdown will likely be temporary as banks get past the paperwork fraud scandal that erupted last year.

As of August, 690,969 homeowners remain in permanent modifications, which reduce monthly payments by hundreds of dollars for eligible borrowers who complete three or four months of reduced payments during a "trial" period. Trial periods have frequently stretched for longer, as homeowners have complained that banks repeatedly lose paperwork. Nearly 1 million trial and permanent modifications have been canceled.

The administration says that HAMP deserves some credit for "proprietary" modifications that happen outside of the program. It said that 55,700 homeowners received non-HAMP modifications in July. Altogether, 5.1 million modifications have been started since April 2009.

"These programs have now set standards for the industry that have led to millions more homeowners receiving assistance at no expense to taxpayers," said Treasury official Tim Massad in a statement. "We recognize that there are homeowners who are still struggling but eligible for assistance and remain committed to reaching those homeowners."

To that end, the Treasury Department launched a TV advertising campaign in September.

Sad note , neighbor house was just forclouse . They try mod w/BOA . The mom worked 2 jobs but just couldn't make . 6 year old Daughter is going thru chemo . What a country

The GOP has been ratchet jawing about the Solyndra failure.

How come we don't have more airtime on the failure of this HAMP program. It was far more important than trying to refloat one start up company.

The fact that big banks have access to political figures and the average home owner does not means that big banks get their input and, often, the home owners do not. What ends up happening is not good for the home owner or bank. If you can't create a streamlined, simple process that leads to win-win solutions....it will fail. Lets look at specific examples: An owner-occupant owes $100,000 in his mortgage. the value of the home is $50,000. He just got demoted on his job and is considering letting go of his home. There are really three questions: How can we create a scenario that the homeowner prefers to letting go of the house? How can we create a scenario where the bank prefers letting the homeowner stay in the house rather than foreclosing? Where is the overlap? How can we make that overlap obvious to both parties? How can we make action that brings this overlap to fruition simple, convenient and cost-effective?

It is time to do business with local institutions. A local bank, saving and loan or a local credit union. Big multinational banks have no ties to the community.

The problem is that HAMP is voluntary for the banks........ and they are not about to agree to do anything voluntary that won't line their pockets with additional gold...........

Loan modifications is not the answer for most homeowners. Especially homeowners who have had a mortgage that was sold or transferred many times over. A better option would be to determine what mortgage lender actually has the authority to collect in the debt. Not opting to do this may result in you arranging payments to a lender that in not authorized to collect on the debt.
In short the most mortgages have so many issues that loan mods are just not the answer.

Yes. Then the question becomes, how do you fight a mega-bank with the law, even when it's obvious the bank / servicer does not have a clear legal right to the home with the odds stacked against homeowners?

The lawyer I worked with told me she had a case dismissed for a homeowner (but I don't know if it was dismissed with prejudice or without). The servicer / bank representative never showed up in court.

I DO think these cases are worth fighting, but it takes an incredible amount of fortitude and can wreak havoc on one's health. The government is NOT on our side.

We applied for a modification 9 times, our paperwork was lost everytime. Chase "misplaced" the $70,000. that we sent them from October 2010 until August of 2011. We have over 50 pages in names, dates, id numbers. We are still trying to work with these criminals. OCCUPY WALL STREET.

Chase has done our paper work 3 times so far. This time though, they let me know when something is missing. We just paid oiur last bankruptcy payment and supposed to be current. They, of course, don't converse with us yet. This probably won't be our answer either. Makes us mad - we have been in ouir home 35 years and first time that we've had such problems!

Just some suggestions if you're interested in applying for a mod to save your home. I am NOT suggesting this is any type of guarantee any of this will work, and I am NOT a lawyer, and I'm not a mod consultant.

(You've probably already done all of this if you've applied before):

1 - Contact your servicer and make sure they know you have an "intent to save your home"
Make the person you're talking to read your intent back to you, and make sure it's on file.
2 - Always take down the names of everyone you speak to, and ask for their employee ID number if they have one.
3 - Send the bank a QWR letter (you can find examples online). You USUALLY do not need a lawyer for this. Some cases might.
4 - Make sure you write a hardship letter with an acceptable hardship (that info is online as well), even if the application does not mention needing a hardship letter.
5 - Fill out all the areas on the mod application form, and even when the totals are 0, write in zero
6 - If you haven't already spoken to a lawyer (hopefully a free consultation), good lawyers can give you helpful tips and explain your options.

7 - (this should probably be first) and one of the most important things to do is to try to find out who holds the note. The QWR response may provide some info that will help

8 - Check your state's foreclosure laws

If you haven't already investigated online sources of info, there are many good ones now -
I'd start with 4closurefraud.com and they have links to many other GREAT info sources as well.

Expect this process to take at least a few months, and keep in contact with your servicer every few days to check on status.

If you get a mod, do not be surprised if your principal balance is RAISED, however, your monthly payments should decrease. Understand that you may be waiving some of your rights with a mod. It may not be the best option to pursue for everyone.

PS - if you've already received a default notice, an eviction, or any other type of urgent notice, your best option may be to talk to a lawyer as soon as possible.

The money that you save by refinancing every month can be sensibly used to repay your unique loan or to upsurge your savings. Do not forget to search online for "123 Refi" they found 3.17% rate for me. They taught me how to refinance smart.

What about help for those who had perfect credit and then the 8 neighboring houses went into foreclosure. Seems like if we're still standing the bank should be forced to wipe off the loan in excess to the existing worth of the home.

The HAMP program is nothing more than a farce and I am willing to bet if we find out who has gotten those modifications we will find they have all gone to someone who is either politically or big business connected. It is nothing more than another farce by our government to steal us taxpayers blind. We need to get all of the present members of congress out of office and then prosecute the crooks who have been running our country into the ground. Sorry to be so negative but I'm tired of getting screwed and not once kissed.
