Alabama Immigration Enforcement Law Has A 'Chilling Effect' In Classrooms, Critics Say

Alabama's controversial new immigration enforcement law is fostering an environment of fear in the state's classrooms that's affecting all students, leading critics of law said during a Wednesday conference call.

The new law requires that all schools verify the immigration status of children enrolling for the first time. State education officials estimated that over 2,000 latino students -- or about 7 percent of Latino students -- were absent from Alabama schools on Monday, the first day the new law came into effect. This represents an 80 percent increase from the previous Monday.

The absences have provoked questions from fellow students, said Roseann Rodriguez, who counsels in Birmingham schools on behalf of the Hispanic Interest Coalition of Alabama, a nonprofit organization dedicated to the empowerment of the Hispanic community in Alabama.

ā€œMy sixth graders of African American descent were asking me if they were going to have to go back to Africa,ā€ she said in the teleconference, which was hosted by Latino advocacy group National Council of La Raza.

There is a "fear factor out there that is written between the lines of the law," Rodriguez added, that's having a "chilling effect" on Alabama classrooms.

Although the law took effect earlier this week, the Obama administration has filed for an appeal, along with various teachers unions and advocacy groups.

Sam Brooke, Attorney for the Southern Poverty Law Center, said that there is widespread misunderstanding about the implications of the law, provoking parents to pull their children out of school at an alarming rate.

School officials have ensured that immigration status will not be used to identify individual students. Interim state superintendent Larry Craven said in a statement on Monday that this information will only contribute to ā€œstatistical data,ā€ presumably to determine how much is spent on educating undocumented students.

"We would like all parents and students to know, regardless of whether the enrolling student has an original or certified copy of their birth certificate, the student will be enrolled and receive full participation in all of the academic, co-curricular and extra-curricular programs that will be offered by the local school system," Craven said.

State authorities also sent school "sample letters" for parents of new students informing them of the new requirements and also trying to calm their fears, the Associated Press reported. ā€œRest assured that it will not be a problem if you are unable or unwilling to provide either of the documents,ā€ said the letter.

Critics say despite the state’s efforts to assure families, the new law has instilled an atmosphere of fear.

The Associated Press reported last week that in Montgomery County, ā€œmore than 200 Latino students were absent the morning after the judge’s Wednesday ruling." In a "tiny" town called Albertville, 35 students withdrew in one day, and in Shelby County about 20 students ā€œeither withdrew or told teachers they were leaving."

Janet Murgiua, President of the the National Council of La Raza, said in the conference call that it is ā€œnot just immigrants, or Latinos affected by this law, but all residents of Alabama." Murguia said the law is the ā€œgreatest educational crisis in the state since Jim Crow,ā€ adding that it is more disturbing than the Arizona’s controversial SB1070 immigration law because it affects schools.

"It’s another thing to have the target of a decision affect children. This not only goes against our constitution, but against our values,ā€ Murguia said in the teleconference.

"Educators should not be put in the position of being immigration law enforcers," said Randi Weingarten, President of the American Federation for Teachers. Educators are now also tasked with answering their students questions about what the law means and why their friends are missing from class, informed Weingarten in the teleconference.

"Nobody wins when a law pushes children into the shadows of society. Teachers should be safety nets, not snitches -- guardians, not guards," she said.

Immigration is a tough issue, but spreading fear to the point that children are scared? People that do want to stay, work and become U.S Citizens need to legalize and if necessary pay a fine for entering illegally. Promoting a path to citizenship is necessary.

Immigration is not bad, its a natural phenomena and nobody can stop it. If it weren't for immigration the U.S probably would not exist.

IIlegal immigration is wrong but whats worse is spreading fear and hatred. That path will only lead to violence and people getting killed or hurt.

Im not buying this whole, Illegal immigrants are taking our jobs thing. I can see a job here and there, but the real killer is greedy corporations looking to maximize profits. Their shipping the jobs overseas for pennies.

Any child born here is an American citizen. It is the responsibility of the parents of that child, no matter where the parents came from, either legally or illegally, to teach that child that they are an American.

Not an African-American, not an Asian-American, not a Mexican-American, but an AMERICAN. When the parents do their job, the children won't be asking questions like that.

Actually I do want this to cause an atmosphere of fear.

I want anyone here illegally to know they are not wanted. If they will break this law what is to keep them from breaking others. They should do the right thing, either start the process to become a citizen or get out!!!

Thank god and the new law that the illegal immigrants are leaving alabama. The schools resources can now be used for US citizens kids. Tons of Jobs are now opening up for jobless US citizens in alabama. The new alabama law and the judges ruling to allow it is some of the most awsome news we could ever here. Now we need to make a law like that throughout the whole country. Some employers in alabama are worried because they are loosing their cheap, illegal labor. If they would have been hiring legal american citizens in the first place and practicing ethical buisness prctices, they would not be in the boat they are in and neitheir would the rest of OUR country. Thank god the illegals are leaving alabama and opening jobs and schools up for honest, legal citizens who need them.

I hear you...I know alot of people that will pick fruit but we have a MIGRANT worker program. Which gives first dibs to Mexicans who are here for that program. But as a Migrant worker you go around and work in different areas to make some money and then you go back to Mexico. It does not equate to citizenship. Migrant workers knew the deal when they signed up as a migrant worker. Now our economy has changed. We don't need them as much. Go home. I would advise everyone to look up the migrant worker program. If the want citizenship apply, if you're a migrant worker then be a migrant worker.

My guess is that i will want the construction jobs opening up because i am a carpenter and myself and many other skilled construction workers were layed off and replaced by low skilled or no skilled illegal alien third world workers. most could'nt tell the differance between a ten penny nail and the hammer you drive it with but they were cheap labor. Many contracts were won by low paid illegal aliens crews who refuse to hire english speaking citizens, black or white. They totally descriminate and they put many, many well paid, skilled construction workers out of work. Take thatto your cucumber field and pick at it....

I don't know if Huff Post thought Americans would be sympathetic, but we are fed up from being sqeezed from all sides. The banks won't loan money to us, but will loan for a new mexican restaurant. Americans can't find jobs but illegals can get jobs under the table. I was watching a food program the other day and all the line cooks were Mexicans. I guess students graduating from a culinary arts school are SOL. So much for Americans taking care of Americans.

You all are just looking at the small picture and not getting the big picture. The immigration stuff is a small issue but they are trying to make it something bigger with their intention to let everyone follow immigratition issues and try to slip something else past the American people. Wake up America before the garbage really hits the fan and then you will see the big picture. People are being lead around like sheep and it is so sad. People need to look outside of the box and there is way more to this story but no one seems to get it.

Okay we all know the republicans are for the rich and anyway they can try to remove the legal immigrants from voting say democratic gives whatever republucan candidate a better chance to beat Obama. Do you all think the immigratition issue is just going to stay in bama? Even if you are a legal immigrant you might rethink on voting think about it. Do you know it can take up to a few years even with all the right paperwork for an illegal to become a legal immigrant? I know someone will tell me I am wrong but I am not I have friends who have gone through the process so i know what I am talking about even though some folks think I don't.

It is interesting that the libs rail against the employers who hire illegals (rightfully so), but will not assign any responsibility to the individual because that would be mean and heartless. At the same time they want their livelihood cut off which means they would be without income and would have to go home anyway. So, the lib doesn't want to be directly "mean" to the poor illegal they just want to stick in their back. And I'm mean? LOL!!

so when did breaking the law, mean it is okay as long as you want a better life? many americans came from other countries legally, and that is great, that is the way it should be. but breaking the law is breaking the law, and i am tired of people being rewarded for it, when it takes away from americans.
I would never be able to go to another country and say "hey, I like it here,so i tell you what, i think i am going to stay and you can't make me leave. Then not only are you going to educated, but give me and my family, health care, housing, protection and all the benefits of your citizens, and if you don't i am going accuse you and your country of being racist, and file lawsuits, and protest, but i still won't leave, even though i don't have a right to be here, all because i want to be here and i am so special that i don't have to follow the laws and i can do what ever the heck i want." if i said that they would laugh so hard and toss me and my family out...

Ok thanks for everyone who replied to me and I love the one person (idiot) who called me dumb!!!!!! That made my day but everyone has an opinion. What is going on is another way for the republicans to try and flex their power before the next Presidental elections. Look we all know that the republicans/tea-party have their own agenda. Democrats are for all the people and that is how it should be. Look if a child is born in this country but their parents are illegals doesn't that make the child a US citizen if I remember correctly it does!!!!!!!!! Look this is all about politics because the republicans/tea-party candidates know that if they make a big stink about all the possibilities of illegals in the country when it comes time to vote then maybe the legals won't vote so it will give the republicans/tea-party candidates a better chance of winning the elections. They know that the rich people side with the republicans (look at not putting single people who make $250,000 and a couple who makes $400,000 raise their taxes) talk to the republicans/tea-party folks about that one. Some candidates want to tax the poorer people in their states and have done that already in the USA while the rich get richer and the middle class goes away (that has already happened) and the poor get poorer.
