Los Angeles Unified School District Settles Federal Civil Rights Probe, To Boost Student Equity

LOS ANGELES -- A 19-month civil rights investigation of the Los Angeles Unified School District found that the district failed to provide an equal education to English-learners and black students, resulting in wide academic disparities, the U.S. Department of Education announced Tuesday.

The district, the nation's second-largest, agreed to remedy the disparities through a variety of measures, including a complete overhaul of its English-learning program and improving resources such as computers and library books to schools with predominantly black student bodies.

U.S. Education Secretary Arne Duncan, who unveiled the agreement at a news conference at LAUSD headquarters, said it would help ensure that every student in the nation's second largest school district would receive the same academic opportunities "regardless of race or national origin."

Noting that these issues are "incredibly complex and politically charged," Duncan said he was encouraged by the district's sense of urgency and willingness to voluntarily remedy the disparities without an order.

"Though we still have a long way to go before we see that English learner students and African-American students are consistently getting what they need to perform up to their fullest potential, I'm confident today's agreement will help address the causes of concern that prompted our review," he said.

Duncan stopped short of saying that students' civil rights were violated and did not reveal detailed results of the investigation, just the terms of the agreement. But the Education Department said in a statement that it will monitor the district's compliance with the agreement until educational codes are met.

The agreement was the result of a "compliance review" by the Education Department's Office of Civil Rights, which was concerned about wide achievement gaps between the district's lowest performing student groups and other students.

Only 5 percent of high school English language learners ranked as proficient in either English or math; for black students, 32 percent ranked as proficient in English and 9 percent in math, according to the district's 2009-10 report card.

The overall district average was 37 percent proficient in English and 17 percent in math.

LAUSD Superintendent John Deasy said the district did not dispute that disparities exist and worked to hammer out a solution with federal officials. The district will be studying how to fund the measures as plans for specific areas are developed.

The district's English-language learning program has long been criticized for allowing non-native speakers to remain in English-learning programs for years, sometimes throughout their school careers, never meeting the criteria to move into mainstream classes. Students often fall behind grade level and end up dropping out.

For the 2009-2010 school year, only 14.4 percent of English learners were reclassified as fluent.

Under the agreement, the district agreed to completely revamp its nearly 200,000-student English-learning program by next school year, with special emphasis on high school students who have not been deemed proficient in English in order to take courses needed for graduation. The district has the highest number of English-learning students in the nation.

English-learners will receive grade-level courses, teachers will be trained to handle multiple English-proficiency levels and special-education teachers will receive English-instructional materials.

The program will also include a component aimed at black students aimed at boosting their "academic language proficiency" starting in elementary grades.

The investigation also found black students are underrepresented in gifted and talented programs but overrepresented in suspensions and disciplinary actions. Schools with predominantly black populations also lack technology and library resources.

The district agreed to remedy those disparities with fairer evaluation of gifted and talented programs and disciplinary actions, and allocating more computers and increasing library book collections.

A school-based community pilot program will be launched in an African-American neighborhood to provide health and social services, he said. No details were revealed.

Warren Fletcher, president of teachers union United Teachers Los Angeles, praised the Education Department for shining a light on longstanding disparities, but noted that the district has laid off more than 1,200 teachers and closed libraries in many schools.

"It's very general," he said of the agreement. "We have to see how those services are going to be provided."

Parent Irma Munoz, who has had three children go through the district's English learner program, said the program needed to be overhauled. Her children were put in classes with English speaking teachers who they could not understand, she said.

"It's a bad program," she said.

What trouble me most about this story is how little press it received. HP buried it soon after it broke and as far as I know not one blogger cared to put in his or her two cents. It seem unlikely that two of my favourites here would ignore this story , but perhaps they had no choice.this story tells a story by way of what it fails to reveal. 20 years ago aggressive reporters at LAT would have been all over this and the Feds for yet again allowing the district off with a slap on the wrist, some resourceful journalists would win awards for investigative reports on the set and corruption as well as the disparities on campus. They'd take photos of the poor products of an LAUSD education and interview teachers about how cuts will only mak things worse.they'd deconstruct the tests, document police oppressing students behind fences at Watts while kids in San !arino wander about on state if the art school ground, free to leave if the wish, There too much of this to put down here but wtf? When did reporters become stenographers and he exploitation of children and taxpayers become little more than HP fluff?

This is nothing new and has been going on all over America. Hispanics aren't the minority! It's just a sad method to keep you separated from what AMERICA is supposed to be about. Failure with education for blacks and Hispanics is found all up and down the southern states TOO...which guess what ARE REPUBLICAN STATES. So stop calling this a failure for liberals. It’s the responsibility of the entire community for the values of education to be imbedded within our children. Learning starts from HOME, but if that parent was not given the promises of what an education can bring how in the world can you expect them to motivate children that they bring into this world. With this economy really and truly ARE we really telling the truth about education right now? How many people do you see at WALMART and MCDONALDS as CASHIERS that have a MASTERS DEGREE!!! Hmm. Don’t get me started on Social Security. A real teacher would be knocking on the doors of her students to make sure if they need help they are going to give it. Just like a real parent needs to be sitting down to figure out what they need to do to make sure their child can receive it. It’s not that hard to stop tilting your nose up like you're better then someone else, because you’re only as good as the person next to you when you don’t lend a hand.

You are dead on. Real teachers would knock on doors and unite with parents to bring these school systems down, but just being an advocate for your students is considered treason by these criminals. I know from personal experience. Most of my colleagues are complacent cowards, and a few are corrupt like our so called leaders. I am not going to be complicit in crimes against children

The quote from the last parent abt her children going through the English Learning Program, did she make that statement in English? One of my nephews recently moved to Germany and they have a new baby, they are adament that both German and English be spoken around the baby....its up to parents to teach children their early language skills, and its important when in a foreign country to speak the native langugage....maybe the English Learning program needs to start at home with the parents....speak English and your children will not have a problem understanding the language.

Seriously, forget books. iPads and moodle are far cheaper and can solve a lot of our issues, records can be kept effieciently to getter evaluate teachers and students objectively while Nin intrusive equitable oversight is available . Every book and resource a kid needs is bin the unit, he can get assignments, upload his work and ask teachers questions,his folks can look in anytime to see how he's doing. I bet you my pay check 90 %'improve drastically because they engaged and monitored . The teacher is also freer to assist them with this systemn which makes it simple to assess and accommodate them. Progressive schools use them. The only problem is the kickbacks for 50 LB text books, dreary programs, smart boards that don't work and mendacious operations would end. So would many costly positions ,these kids want to learn. The suit want to make money. The two agendas are at odds with each other. Yet the public , the people abide this. So unless parents rise up with us the test factory will prevail

it seems the blacks dont want to go to school or to be taught. they seem to feel that they are owed something. in this world, we us whites never condoned slavery. us we never brought not one slave here. the blacks seemn to project the idea that they are owned something. if they dont go to school and learn, if they want to live as useless people, then why do they feel they are deserving of anything. we as familys have to work together, and help each other, and work to make us all live normal, not special, not rich, but a sunday dinner of beans, greens and ham hocks and cornbread. that is a wonderful gathering for all americans. make the kids go to school help them learn. and the world will be better

Having retired from teaching, I can tell you what the next step will be. Bureaucrats and administrators will create more testing and heap more requirements on teachers, because its the only part of the equation they can control. When standardized test scores go up 1 point they will pat themselves on the back and move onto a higher paying administrative position, creating useless committees and employing more quasi administrators. The system is neck deep with Ph.D.s in trivial pursuits and they will feed at the trough as long as they can. The big majority of teachers are hard working and stressed out. State and Federal mandates have crippled classroom teachers. They spend more time complying than teaching.

English should be the "only" launguage taught in the US school system. Any other launguage should be an "elective" for the children that are on the Honor Roll or equivellent.

When I grew up in the 60's and 70's Spanish and French wer both electives.

Ammend the Constitution to state Children of Ilegal Immigrants are not entitled to our educational system. This also slows down the classroom when teachers have to try and explain to no english speaking children.

This is how we will leave no child behind.

ell students arent taught in spanish.

the part of the constitution that allows illegal immigrants access to our education system is the equal protection clause. the very concept of equality under the law would go away if we removed that. not much of a modern version of the united states would exist in that case..

Actually in many classrooms English Learners are taught in Spanish and English, particularly if the teacher is bi-lingual which many are. In a merged classroom, this is time consuming and in fact effects content for the entire class.

If those children were born here they are ENTITLED to our education. Stop trying to punish innocent children because of their parent’s illegal acts. WHY on earth do you think they brought their children here instead of leaving them within their own country? AND frankly the true American is our Native Americans. MAKE the parents learn ENGLISH with their CHILD. That illegal immigrant’s child could be the one who cures diseases or develops a new energy saving method for our wasteful nation. Once again...you are only as good as the person next to you. I'm sure that 'illegal' isn't going to just leave 'you' behind if they saw you in an accident. EDUCATION needs to be held to that caliber.

You are very naive.

"Illegal Immigrants" are not entitled to anything in this country! They are "CRIMINALS" from the day they step foot in this country until the day they leave. If they bring their children with them, those children are also "Illegal Immigrants".

Right now children born here to "illegal Immigrants" are considered US Citizens, I got that. However hopefully someday that part of the Constitution will be ammended.

I fought for our Country for 26 years in the USMC and Army, not to protect the Rights of Illegal Immigrants but for the Rights of the Legal Taxpaying Citizen. People who contribute (legally) to our Social Programs. Not to people who are living off from us.

Personally I had nothing to do with what took place in the making of our country. All of you that want to live in the past need to wake to hell up before America disappears right before your eyes.

If you have children or plan on having children in the future and thinks continue the way they have been (as far as illegal immagration) your children will have NOTHING. NADDA. We need to go back to the "Basic Principals of Education" Reading, Writing and Arithmatic- which in our country was done in ENGLISH.

No pitty for "illegal Immigrants" here in AL, they can choose to leave their children that are considered US Citizens or take them with them, but they must leave or be forced to leave.

I have watched a girl from Guatemala go from EsL to AP in one year
and hit an exam with respectable scores . She wasn't legal but she went to college a year early without the support of anyone at the school but me. Her parents do not speak Englisg at all. She finished the 2 year school and headed to UCLA where she will be come a civil rights lawyer. If we could get a decent wage for parents and stop letting these administrative parasite bleed us dry, that is viable and my student can be a part of that' she should be .I suspect she will be quite angry about the lack of any punishment for this criminal indifference to what's best for youth.

This is ridiculous! Is this also a part of the "no child left behind initiative", because if so, it needs to be dropped! I think that if a student is rally there to learn, then they will...if they want handouts, then it will be said that we are not providing enough. Part of the reason we are falling behind academically in this nation is because we are too busy having to cater to those who are not proficient enough to be where they are placed. If my ninth grader is performing at a 7th grade level in math and reading at a 5th grade level, I'd want to know how the heck he ended up in the ninth grade! Parents need to start working with their kids at home, and stop blaming the teachers if your kids aren't "smart enough" to pass! Often it's not a matter of intelligence, it's a matter of initiative, and attention seeking.

It's very simple to bring children up to academic par. Unfortunately teachers just don't have a clue how to do that. All kids are smart and can excel, except of course children with some type of brain damage.

...and children who are taught that they are ENTITLED to this, that, or the other due to race or ethnic origin. Here it's not so much about race as it is about money - your family either has it, or they don't. Regardless of the "hardship" there are NO excuses! Teachers expectations and classroom itineraries have changed because parents have made it so. We don't challenge our kids enough these days...God forbid...we may just expect them to have to think - even worse, we may have to HELP them do it!
