Lindsay Lohan Probation Revoked, Hearing Set

DERRIK J. LANG   10/19/11 10:21 PM ET   AP

LOS ANGELES — Lindsay Lohan sported a new accessory Wednesday after a judge revoked her probation: Handcuffs. The actress was taken into custody after Superior Court Judge Stephanie Sautner revoked her probation because she was ousted from a community service assignment at a women's shelter.

"There has been violation after violation," Sautner said.

Bail was set at $100,000. Lohan's spokesman Steve Honig said it was immediately posted and the actress was later released from Airport Courthouse.

"We're dealing with someone on probation," said Lohan's attorney, Shawn Holley. "Most people on probation don't always do things perfectly."

A city prosecutor recommended jail time, but Sautner set a Nov. 2 hearing to decide whether Lohan should serve another stint behind bars, where she has been sent four previous times only to be released early due to jail overcrowding.

"If jail meant something in the state of California now, maybe I'd put her in jail," Sautner said.

The development marked the latest legal problem for the 25-year-old Lohan, who was given probation for a 2007 drunken driving case and a misdemeanor theft case this year.

"Lindsay is hoping this matter will be resolved on Nov. 2 and the court will reinstate probation and allow her to continue fulfilling her community service," Honig said.

Lohan had been ordered in April to serve 360 hours at the Downtown Women's Center, an agency that helps homeless women. Nine of Lohan's appointments at the center were "just blown off" and she "showed up once and left after an hour," Sautner said.

Lohan has since started serving hours with the American Red Cross, but Sautner said that would not count because it was not part of her sentence.

During the tense proceedings, Sautner hammered Lohan for failing to show up for her four-hour appointments at the women's center and for taking six months to complete a court-ordered Shoplifters Anonymous course. The judge also questioned how Lohan could have complied with her court-ordered weekly psychological counseling when she was traveling in Europe from Sept. 9 to Oct. 5.

"I don't know how she did that in person every week," said Sautner, who suggested Lohan complete a minimum of 16 hours of her community service at the county morgue before the Nov. 2 hearing, when Lohan's probation officer and other officials will testify about her efforts to complete her sentence.

Lohan, aside from a role in last year's film "Machete," has seen her acting career evaporate in recent years. She has been in perpetual trouble since May 2010.

Another judge determined she violated her probation in the drunken driving case and sentenced her to jail and rehab. She faltered after being released early from a rehab facility early and was sent to the Betty Ford Center, where she got in an altercation with a rehab worker who later sued.

Within weeks of her release from Betty Ford, Lohan was accused of taking a $2,500 necklace without permission from an upscale jewelry store near her home in the Venice neighborhood of Los Angeles.

Sautner determined the January incident constituted a probation violation, and Lohan was ordered to undergo psychological counseling and perform 480 hours of community service, with 120 hours to be spent at the morgue.

Lohan later pleaded no contest to a misdemeanor charge in the theft case and served 35 days of a four-month sentenced on house arrest.

Serving time might just save her life. Getting her away from drugs and enablers is what she needs. Because of her addictions she is not taking any of this seriously. This is sad to see, she and Hillary Duff are about the same age, and Hillary Duff is doing very well, it seems that some (many) who are famous and rich at a young age grow up in a bubble Hollywood sub-culture where reality seems to be yet another television show where the problems are solved in 30-60 minutes.

Her family and friends better wake up and realize that they will be losing a sister, a daughter, a friend very, very soon...they all need to step up and help her.

All the help and encouragement for all the people involved with Lindsey is actually useless. God gave her the tools to help herself and the devil gave her to tools to destroy them. So, it's just Lindsey that can get herself healthy with help from God and people who have been there with all those temptations. I guess it's the lies that bother me most. We are not stupid, but it shows how she has been led to believe how she is so wonderful, talented, beautiful, etc. Sorry, if you are not all those things inside, you are just a hollow shell of a person. Take charge of your life. Spend the energy you have wasted on lieing and going to extremes to get away from your train wrecks on positive and things. One step at a time. It's a long road, but a happy and fulfilling road. It's your only way to a happy, productive life. You have all the tools......use them!!

of course, if she were just a regular "jane doe", she would have long been since put in jail and the keys thrown away--- BUT, since someone out there THINKS she's a celebrity and deserves all the chances in the world--- she will not change, she has no remorse and will not begin to accept responsibility for HER actions. If she lives another 10 years, I think we will ALL be surprised. Too bad her parents can't be sentenced for failure to take responsibility, fasilure to PROPERLY raise their children. It's a sad state all the way around. Hopefully, she will be jailed for a long time and we will not hear anymore about her.

I'm sure there is room in Cascade, Valley County, Idaho jail. Just ship her up here from a stay with us. We'd be glad to have her.

Come on Judge, if you let this person walk because of who she is, the next person that commits the same crimes this girl has committed should walk as well. So put her in jail to save her life, get her real help. If you (Judge) don't what the heck will the courts do THE NEXT TIME. Have her pick up trash in her own yard for hard labor. The system in CA is a total joke.

Aaaah come on folks I'm sure there are lots of people in the California prison system that could be released from jail/prison early for Good Behaviour in order for Lindsay to have a bed, she does not deserve another chance (she has long lost the celebrity status every one wants to bestow upon her) -and since the prison system is the #1 money maker in America the more people incarcerated the better! at least that's the way it works if you are an African American male i.e. African American Male(s) = $$$$$ for the prison; states won't educate but will probate!!

THE JAIL SYSTEM IN CALIFORNIA IS A JOKE!!!! WHEN YOU SERVE DAYS FOR A SENTENCE OF MONTHS AND CONTINUALLY GET EARLY RELEASE IT SHOWS HOW BACKWARD CALIFORNIA IS. THIS SHOULD NOT BE A SURPRISE, LOOK AT WHO THEIR GOVERNOR IS AND THE PEOPLE THEY SEND TO CONGRESS.

Hey Lindsay, love the new bracelets. Now that is what I call making a fashion statement.

This is a comment on Lindsay"s vapid arrogance. Lindsay, the purpose of community service is to serve others. YOUR needs are not the issue, you are there to fulfill OTHER"S needs.Your excuses show that you have learned nothing from your experience. The public needs to turn you off and set you free from the spotlight. Who are you that you feel that the court system is primarily concerned about your fulfillment?

I agree she needs help but the manner the court is doing it is not what is going to help her. Plus, I think the court is dogging her to make an example.

Whoever keeps allowing this girl out is not doing her any favors. This will go on until Lindsay is found dead! She needs help!
