PHOENIX — A federal judge Friday dismissed Arizona Gov. Jan Brewer's lawsuit that accused the Obama administration of failing to enforce immigration laws or maintain control of her state's border with Mexico.

The dismissal by U.S. District Judge Susan Bolton comes in a counter-lawsuit filed by Brewer as part of the Justice Department's challenge to Arizona's controversial immigration enforcement law.

The Republican governor was seeking a court order that would require the federal government to take extra steps, such as more border fencing, to protect Arizona until the border is controlled.

Bolton said Brewer's claim that Washington has failed to protect Arizona from an "invasion" of illegal immigrants was a political question that isn't appropriate for the court to decide.

The judge also barred some of Brewer's claims because the issues were dealt with in a 1994 case by Arizona and can't be litigated again. Court precedent also requires the dismissal of some claims, Bolton wrote.

"While Arizona may disagree with the established enforcement priorities, Arizona's allegations do not give rise to a claim that the counter-defendants (the federal government) have abdicated their statutory responsibilities," Bolton wrote.

Brewer said in a written statement that she wasn't surprised by Bolton's ruling.

"It is but the latest chapter in a story that Arizonans know all too well: The federal government ignores its constitutional and statutory duty to secure the border. Federal courts avert their eyes. American citizens pay the price," Brewer said.

The Department of Justice issued a one-sentence statement saying it was pleased by Bolton's decision.

The DOJ sued the state of Arizona last year in a bid to invalidate Arizona's immigration enforcement law. Bolton put key parts of the law on hold, such as a provision requiring police, while enforcing other laws, to question a person's immigration status if officers had "reasonable suspicion" the person was in the country illegally.

Brewer has asked the U.S. Supreme Court to hear her appeal of Bolton's ruling.

Brewer's attorneys had argued that her lawsuit was necessary to help bring relief to Arizona from the burdens of being a busy illegal entry point into the country.

The governor's lawsuit didn't seek a lump-sum award, but rather asked for policy changes in the way the federal government reimburses states for the costs of jailing illegal immigrants who are convicted of state crimes. Such changes would have given the state more money.

Justice Department lawyers, who asked the judge to throw out the lawsuit, argued successfully that federal court isn't the right place to consider the political questions raised by Brewer.

The judge also agreed with their contention that several claims by the governor should be thrown out because a court rejected similar legal claims in a 1994 case brought by Arizona, and an appeals court decision prohibits Brewer from moving forward with her case.

I am hispanic-American and I am sick of illegals coming to the US with their mess and lawlessness and force us to live in it at the tune of billions of dollars a year. I've been in it for over two decades and now finally the federal government is doing something to cleam up this mess. It's about time. LOVE IT OR LEAVE IT!!!!

In addition to Brewer hoping to be a VP Pick and Arpaio's "Joe PAC" wanting to influence national politics, just heard today (10-24) that Number 2 Mean Sheriff, Paul Babeau, wants to be elected to go to Washington. Wow! The Arizona Sun must do something to these people to make them seek Influence & Glory.

Big money and our "best government money can buy" are working hard to protect the flow of cheap labor. Sadly with 22 million citizens out of work, we don't need more people here to compete with for jobs. Only a small percent of the illegals work in agriculture. Others are day laborers, do construction or have their own businesses. The best hope is to pass E-Verify which is a simple tool for employers to verify if a SS number is being used by the correct person. This would dry up the jobs attracting the illegals.

I am so glad that the judge dismissed her case because it really didnt make any sense. Where does she get off trying to bring a lawsuit against the obama administration for not enforcing her immigration laws ?. The way she was doing things was very discriminatory against the hispanic community and i can see her asking for more security at the borders but she bascially wants to discriminate against all hispanics in arizona . This is something that should have been dealt with years ago so she should be angry with the former governors who never tried to enforce any immigration laws at that border not with obama . Once they learn how to secure the borders more than the problem will be less, if she can get the money to secure the borders without tax payers money then she should pay for more security but her lawsuit was completely out of line .

Her lawsuit was against the fed because they were not enforcing the federal immigration laws. It is the feds responsibility to protect our borders and through all administrations, they have not. The reason AZ made it's own laws was because the fed was doing nothing while AZ and the US are being invaded. I believe all incumbents that have allowed this invasion should be tried for treason. With 22 million citizens out of work, we don't need more people from other countries here to compete with for jobs.

Occupy Wall Street makes a correct point that all of our government leaders are owned by big money. Big money wants cheap labor. If it means destroying the USA they don't care.

I agree with some of your views but its says she was suing the obama administration and thats not obama's job because he is not assigned to that department that is the responsiblity of homeland security or immigration in general.Just because the feds were not doing anything it doesnt give her the right to discriminate a certain race because that makes it racial profiling and no one should be subject to that kind of discriminatory behavior she should find out why homeland security is not trying to fix the issue instead of taking it out on the hispanic community! Did you ever think maybe they are not enforcing the immigration laws or securing the borders the way they should because they are secretly leaving the opportunity there for illegals to enter the U.S because they want them here to work for companies like dogs for cheap labor? thats the way it seems.You are right big money wants cheap labor but the ceo's on wall st rather ship job overseas they dont give the jobs to illegals here so that is a totally different issue.The illegals are not nearly taking as many jobs as the jobs they ship overseas all if not most ceo's ship their jobs overseas so you should be angry with the gov for allowing that just like the protesters they know who the real problem is and its not necessarily the illegals here because the gov does not allow illegals to work here!
