Gaddafi Dead Family Sue Nato

Muammar Gaddafi's family may file a war crimes complaint against NATO with the International Criminal Court, AFP reports. Gaddafi's family has targeted the organization for its alleged role in the former Libyan leader's death.

"The willful killing (of someone protected by the Geneva Convention) is defined as a war crime by article 8 of the ICC's Rome Statute," Marcel Ceccaldi, a French lawyer for the family told AFP. "Gaddafi's homicide shows that the goal of (NATO) member states was not to protect civilians but to overthrow the regime."

Gaddafi died on October 20, 2011, after Libyan fighters took control of his hometown Sirte. Gaddafi's convoy out of Sirte was reportedly overrun by Libyan fighters after being hit by a NATO airstrike. Libya's National Transitional Council says the former leader died in a firefight between fighters and Gaddafi loyalists. Yet videos that show Gaddafi alive after his capture suggest the leader was killed in captivity.

Gaddafi's son Muatassim and former Libyan defense minister Abu Bakr Younis were also killed. All three were buried on Tuesday in an unmarked grave in the Libyan desert.

Libya's National Transitional Council has ordered an investigation into Gaddafi's death.

What war? ...There is no war? ...Really where the hell have you been.... Where did all of the dead bodies come from...I have yet to see a protest..where they use fighter bombers and military tanks and hardware to get their point across.. Get you're head out of you're A##. I spent 12 years in the Military...I know what war looks like..

I remember clearly that the UN Security Council Resolution stated that the goal was " to establish a no-fly zone and to use all means necessary short of foreign occupation to protect civilians".

How is attacking a transportation convoy by NATO airplanes protecting anyone? Isn't this a clear and outright violation of the Resolution? And why is it that we never hear the term "no-fly zone" anymore in the media? There has not been any further resolutions authorising additional actions from NATO. Is assasination now considered a way to "protect civilians"? Or was Gaddafi's convoy flying?

Sorry for the all too many rhetorical questions but this entire episode is absurd. More Libyans have died in this conflict than the number of Libyans killed directly or indirectly by Gaddafi throughout his rule.

Where would they get the witnesses to testify for them? Since the regime is dead I doubt that there is anyone left who feels the need to break a lance for the Gadafi family.

As soon as the book is opened, this case is closed The Gaddafi family shoud get every thing they ask for. Including the Country of France. Just move the Frogs into the desert and let the Libyan peope take over the entire Country. As for the rest of the NATO Terrorist Countries, they should be made to rebuild the Country of Libya, and pay them and their individual families for the murder and mayhem they committed.

Why don't they sue Libya? Ultimately, it was Libyan rebel soldiers who killed Qaddafi. Can NATO counter-sue the family for allowing Qaddafi to murder civilians?

Oh please give me a break. Like Gahdaffi and his family have a clean slate. What about all the horrible things Gahdaffi and his family did to there own people. How many deaths Gahdaffi responsible for during his 42 years of power. The way I see it his own people ended his life. No sympathy from me. You live by the sword you die by the sword.

You must come to the courts "with clean hands", not hands soaked in the blood of your people. The old colonel may have been executed by unauthorized hands but he was going to be executed anyway, so......a crime was committed to avenge a thousant crimes. A real quandary for most courts to deal with.

I think no one invited NATO to drop bombs on a sovereign state. So, you agreed that a crime is done. His misdeeds in his own country is not among the matters that matters NATO.What was going on in Libya was an all-Libyan affair. Why even NATO dared to poke its dirty nose there? The one crime is going to pay off soon. Libyans were enjoying all civil amenities that US can't afford to its citizen. The dictator has done a lot of crimes but not like the proportions of US led NATO's ones in Iraq, Afghanistan. NATO has a number of genocides in its credit that caused deaths in tens of thousands with crippling much more. NATO's hand is more bloody. And the actual crime Gaddafi did was the ousting of the puppet monarch of Libya and interfered with siphoning of oil revenues to US, UK and allies thereof. Expecting another puppet in Libya with an ATM. Libyan air is now perfumed with petroleum, which is the essential driving force to liberate Libya. LOLL (land, oil, liberation, Libya)

Thanks to bcinu2 for a well crafted post that deserves appreciation. Oil per se is very slippery to track record. Dick Cheney was a partry in destroying Iraq and reappeared there as Haliburton to reconstruct. This is the modern philosophy of 'armed reconstruction'. The reconstruction bill was paid by Iraq's oil. At that time oil sold cheap on market. It is just not a part, it is oil that is moving the juggernaut. All of the Western leaders had enjoyed warm relation with Gaddafi (Please, do not refer it to Rice.); had it not been true, how could he survive 42 yrs? You appear to support the bombing of Gaddafi's tent by US in 1982 where his daughter (Hannah) was killed. Then what is the difference between Obama and Osama (apart from only 'b' vs 's' )?
The killing of Saddam, OBL and Gaddafi has a number of things in common:
a) happened in US custody
b) abolished documents or witness (Angeles of Wikileaks ????)
c) confirmed the prolonged hegemony of US-Izril symbiotic duo
Regarding, peace, please open your strapped conscience; the 'cradle of civilization' is now cleansing dead bodies in bags. Killing, killing and killing everywhere in Iraq.
