Kimberly Zakrzewski, Virginia Dogwalker, Found Not Guilty In Pooper Scooper Trial

Posted: Updated:

FAIRFAX, Va. (Associated Press / The Huffington Post) -- A jury in northern Virginia has found a woman not guilty of violating a pooper scooper law in a well-watched case that highlights growing concern over dog waste left behind in suburban neighborhoods.

Kimberly Zakrzewski was walking her friend's dog, Baxter, in Fairfax County in April when neighbor Virginia Cornell called police claiming the 46-year-old failed to clean up after the Westie-bichon frise mix, The Washington Post reports.

"She was letting the dog poop on purpose because she knew it annoyed us," Cornell told paper before the trial. "This individual has no respect or regard for anyone else and views herself as above the law."

But Zakrzewski insists no pooper scooper violation occurred, noting she carries plastic bags on every walk.

After reviewing photos of the dog poop in question and hearing testimony from Baxter's owner, Michelle Berman, who testified that the contested stool was too large in scale for her pooch to produce, a jury deliberated for less than 20 minutes before finding Zakrzewski not guilty.

"This case wasn’t about whether I picked up after Baxter. It was about two women who wanted to harass me," Zakrzewski told The Washington Post following the verdict.

The newspaper says she had initially been found guilty of a misdemeanor after missing a lower court date, but was allowed this week's appeal to a circuit court.
