Brad Gana's Texas Home, Destroyed By Hurricane Ike, Faces Foreclosure [WATCH]

Even those that continue to make payments on a house that no longer exists aren't immune to foreclosure.

Brad Gana, of Seabrook, Texas is being threatened with foreclosure over a home that hasn't existed since it was destroyed by Hurricane Ike in 2008, local Houston 2 News reports. Furthermore, after the hurricane, which cost the Texas shoreline an estimated $11 billion in damages, reduced the property to an empty slab of concrete, Gana alleges he continued to make payments.

In the meantime, Bank of America, the mortgage lender, took out a forced homeowner's policy on the property and raised monthly payments. Gana, however, says he was never notified of the change since his mailbox was destroyed by what's come to be known as the third-most destructive hurricane ever to hit the United States.

The story is only latest public relations mix-up for the company that recently lost its status as the largest bank in the country. It was reported earlier this month that one family, also living in the Houston area, faces foreclosure due to an untransferred title and in spite of making payments on time.

In another case, Bank of America foreclosed on an elderly couple in Pasco County, Florida, in part because they made a payment too early.

But it's not just foreclosures that has people angry at the bank. BofA made a $6.2 billion profit last quarter, after announcing in September that it would start charging customers a $5 fee to use debit cards next year.

The consequent backlash, led in part by the Occupy Wall Street movement, has been so widespread that the bank is among those reconsidering its position on the idea, CNN Money reports.

Despite repeated stories of allegedly wrongful foreclosures, it appears not everybody is so sympathetic to the affected homeowners. A New York Times op-ed by Joe Nocera, published last week, detailed an office Halloween party from last year at a "foreclosure mill" firm in which employees mockingly dressed as foreclosure victims. A section of the office also appears decorated as a row of foreclosed homes.

As for Gana, he says he can't understand why a bank would take out a homeowner's policy on a house that's no longer there, then threaten the homeowner with foreclosure.

"I was shocked when they said they were foreclosing on it," he told Houston 2 News. "Bank of America is ruthless in their incompetency."

I'd just give them the keys and go on my merry way, though why he had to continue paying on a house that was destroyed is pretty shady all by itself.

Typical. It took my bank three years to get around to changing the title after I refinanced with another bank. These major mortgage companies are really, really in over their heads when it comes to making transactions. Can you say "to big to know what the hell you are doing"?

We need democratic money management - desperately! I truly believe that the only right thing to do as a citizen of this country, the patriotic thing, is to take all our money out of these banks like B of A and put our hard won wages into local credit unions. When we as a group control our money we have control of our lives, and credit unions are controlled by the members! Putting our wages and our futures in the hands of these greedy monsters is self destructive and counter to our basic needs. These too big to fail banks have proven their motives and their destructiveness to us and to our country again and again. Putting our money there puts control of our lives into the hands of people who would as soon see us d e a d as anything.

BoA is just all kinds of fun. Whenever I see an article about something a bank has done I like to play "What did BoA do now?" They have been probably 75% of the articles lately, and they never seem to be good. Even the announcement that they weren't doing the debit fees made them look bad. Moynihan is a public relations genius.

These monster banks should be liquadated! banks were regional not so long ago & were not selling financials...they were BANKS...when deregulation tokk effect the larger banks simply absorbed all the smaller ones ...Liquadate these monsters and return the time when banks were regional & local.

It is a simple fact that a lender, be it a lawnmower to the neighbor or a few hundred thousand to a home buyer or millions to a company, is the one taking the risk that they won't get paid back. It is part of the lenders business to minimize the risks not the borrowers. Part of the risk mitigation is that the home is held as collateral to the loan. This is just business. If the home is destroyed it's the banks problem not the borrowers because the borrower really doesn't own the home the bank does. There is no "morality" here it's just business. It doesn't matter why the borrower doesn't pay the bank back it's still the banks business to deal with that risk.

A lawyer you are not. You own the house, the bank owns the note. In the paperwork you are required to insure it for at least the mortgage amount and to maintain the property. Where oh where did you get your information? I suggest you keep renting.

But precisely what did BofA take a policy out on? Did they take a policy out to insure the land? In Texas, you generally can't insure coastal-edge property (the actual land) because if the median tide encroaches on the property line, that then belongs to the state. Most insurers won't compensate you for something you don't own and for which they could not seek indemnity. And yeah, lawyer this gentlemen is not.

How the judicial system can continue to listen to any claims from this bank is beyond me. I am so glad I pulled my money out of this bank years ago when it was still Nations Bank. They were crooked then and apparently have not gotten any better.

BOA strikes again. However, this home should have been covered by insurance as required under the loan documents. What happened with the insurance proceeds. Typically, the insurance proceeds are remitted to the lender and then disbursed to the homeowner to make repairs or rebuild. Wondering if BOA actually screwed them out of the insurance proceeds as well.

Many insurers claimed that their policies didn't cover the type of damage done.

I don't know what the situation is here, but it could be the case.

True. However, it is my understanding that most lenders would have required both wind and flood coverage in coastal cities like Seabrook. I had hoped the story would have been more comprehensive on the insurance issue allowing us a clearer picture of the situation.

If you don't have flood insurance, you are correct, you lose. But the loan doesn't go away. Like if your car is totaled. if you didn't have collision, you still have to pay.

Please learn to use "there" and "their" properly. You also seem to have a problem using to and too correctly. When you get your own house in order then calling others "stupid" will have more validity. Now, I'm not saying Americans are not lazy, crooked and stupid for you may well have a point on that subject. When you fill your own comments with words that are misspelled and used incorrectly it smacks of the pot calling the kettle black. Just saying............
