OREGON CITY, Ore. (RNS) An Oregon judge on Monday (Oct. 31) sentenced two members of a faith-healing church to more than six years in prison, saying the death of their newborn son was easily avoidable.

A jury in September unanimously found Dale and Shannon Hickman guilty of second-degree manslaughter after their son, David Hickman, died after less than nine hours. The boy was born approximately two months premature and weighed less than four pounds.

Close to 100 people packed Judge Robert Herndon's courtroom for the sentencing, nearly all of them fellow members of the Followers of Christ church, an Oregon City congregation that shuns medicine in favor of faith-healing.

Herndon gave the couple 75 months in prison, the mandatory minimum under state sentencing guidelines. The sentence also has three years of probation.

"As the evidence enfolded and the witnesses testified, it became evidence to me and certainly to the jury ... that this death just simply did not need to occur," Herndon said.

Before the sentencing, both parents tearfully asked Herndon for mercy, specifically for their 7-year-old child and new baby. Shannon Hickman mentioned she spent "24 hours a day" with her children, and Dale Hickman asked the court to specifically have mercy for his wife.

"We are willing to do anything that the court sees fit," Dale Hickman said.

Prosecutor Mike Regan took a hard line on the couple, saying a strong message needed to be sent to the church, which has a long history of child deaths due to lack of medical treatment.

"These generally are good, decent, law-abiding folks, except in this one narrow area of their lives," Regan said. "One (area) where they have told us stubbornly -- and arrogantly, if I may -- that 'We are not going to change."'

"The law of civil society demands that they change," Regan continued. "It demands that we sent a message to all of them that whether you believe this or not in Oregon, you cannot act upon that belief."

Dale Hickmans' defense attorney, Mark Cogan, pushed for probation, saying the Hickmans would be compliant with any court orders for medical care. The couple has already taken their two children -- a seven-year-old and a new baby -- to see a pediatrician, Cogan noted.

"These are not criminals," Cogan said.

The Hickmans are the fourth couple from the church to be convicted for refusing to get medicine for a sick child. Timothy and Rebecca Wyland, who were convicted of first-degree criminal mistreatment for failing to seek treatment for a growth that threatened their daughter's eyesight, supported the Hickmans at the courthouse on Monday.

Carl Brent Worthington, who was convicted of criminal mistreatment in the death of his 15-month-old daughter, also sat in the courtroom.

Shannon Hickman's attorney, John Neidig, asked the judge for special consideration for his client, noting that she did not have as many chances to call for help because in their church, all decisions are made by the husband.

"That is a function of their religion, a religious practice," Neidig insisted. "The husband is the head of the household, like Christ is the head of the church."

Good sign. This will send a strong message to the fundies who think biblical laws take precedence over the laws of the land.

If a drowning man refuses to get in a boat because he prayed to God, I conclude that he didn't know God sent the boat. He also gave us doctors: the apostle Luke was a doctor. Time to stop cherry picking scripture. and live by every word of God.

Think about what you said. "Every" word of God? Is the entire bible his Word? Then explain to me why the state would lock you away if you attempted to murder your only son because "God" told you to. Explain why it is illegal to own human beings as property and why children are not stoned to death when they disrespect their parents.
And think again about what it means to live by every word of God.

The Bible does not condone the murder of kids; the Bible condemns killing kid even before they are born. As for the state they would lock you away because of the separation of church and state, and murder violates state law. But you know that.

Slaves: Most slaves in the Bible were like the detainees in Gitmo today, enemy combatants captured in battle, with no rights. Children with respectful parents are respectful, less than perfect kids. Kids that would outright disrespect their parents learned that from their parents, and often find themselves the victim of child abuse, by their parents. (Haven't read in the Bible that a child was stoned).

Is the Bible partly man's words? Yes, especially english translations. That's why some Bibles have words in italics, letting us know that word is not in the original texts. Get a good Bible and it will tell you where man's words are.

To you point about killing kids: Adam didn't kill Cain, Issac didn't kill Esau, Eli didn't kill his sons, David didn't kill Absolom, and the list goes on: misbehaving kids kinda got away with it.

Jesus said 'if you have faith you can move mountains'. He also said, "Ask and you shall receive'. These people obviously didn't have enough faith.

These people have clearly been misled by someone. God gives us medical knowledge. He expects us to use our brains to help ourselves. He can and does heal, but he expects us to use the wisdom that comes from Him. This goes far beyond freedom of religion and moves into the criminal realm. What has happened to those who taught these people such a thing?

How many other churches have teachings that can be harmful to people. Still, in the 21st Century one would think that people would be thinking and reading and hearing enough to make some relatively sane decisions. Guess that is not the case.

Thanks to human beings, thanks to atoms, thanks to the sun rising, thanks to breakfast, thanks to the Constitution, thanks to the Magna Carta, thanks to the Great Schism, thanks to Jesus Christ, thanks to the Romans, thanks to the Greeks, thanks to Aristotle, thanks to the creator of the universe. We are all given choices and things also happen. You cannot blame all religions because of a few crazies. I don't blame all Muslims for Al Qaeda. Do you?

In other words,
Religion is an insult to human dignity.
With or without it you would have good people doing good things and evil people doing evil things.
But for good people to do evil things, that takes religion.

What an insenstive remark. do Christians blame every atheist because one commits murder or rape. Hardly. Shame on you.
02:10 AM on 11/11/2011
I wasn't blaming christians, I was blaming the dogmatic nature of their beliefs, which remains steadfastly primitive, no matter how much knowledge to the contrary we amass.

But since you bring it up, Shame On You! This was a senseless, completely unnecessary death! And that child died at the hand of parents who claim to be interpreting the word of YOUR god! Every sensible Christian out there ought to be denouncing these people and their perversion of your belief with the loudest voices. Who do you think they're going to listen to - me? You folks are the only ones that can get through to them and perhaps save the next poor child! How about you people start cleaning a little house. We're bound to save a few kids. Catholic priests would be a good place to start.

And by the way, there are fewer murders and rapes, per capita, by atheists than by any of the major religions. I suspect that has something to do with the direct correlation between education and atheism. Smart people are less likely to commit those types of crime, and they're less likely to believe in a god.
