Alabama Immigration Law Sparks Department Of Justice Investigation Into School Enrollment

The U.S. Department of Justice is further pressuring Alabama schools to abide by federal mandates that states cannot deny children equal access to public education based on immigration status.

Assistant U.S. Attorney General Thomas Perez issued a letter late Monday to Alabama school superintendents requesting information on enrollment practices, saying the state's new immigration law "may chill or discourage" young people from taking part in public education. The letter notes that the information and data determining whether the law has affected enrollment will be used to determine whether Alabama school districts are complying with federal law and "whether further action is warranted." Perez writes:

It has come to our attention that the requirements of Alabama's H.B. 56 may chill or discourage student participation in, or lead to the exclusion of school-age children from, public education programs based on their or their parents' race, national origin, or actual or perceived immigration status, or based on their homeless or foster care status and consequent lack of documentation.

Federal law states that no child may be denied schooling on the basis of race, color and national origin, Perez writes, and that the Supreme Court has "concluded that denying innocent children the benefit of schooling provided to other students within the district was unconstitutional."

Each school district is asked to submit nine sets of data, including a list of all enrolled students, identifying their race, national origin and immigration status as well as a list of all students who have withdrawn from school since the start of the academic year, identifying their race, national origin, immigration status and including their date of withdrawal and the reason for withdrawal.

But Alabama Director of School Superintendents Eric Mackey says districts don't collect information on students' countries of origin, nor do they record specific reasons for absences -- which are just noted as "excused" or "unexcused," the Montgomery Advertiser reports.

"[Superintendents] want to know if this is a part of collection of data for the Justice Department's case against the state, or if the Justice Department is collecting information to develop actions against school systems," Mackey told the Montgomery Advertiser.

Some school officials said the request also places a large burden on school districts.

"I hate that school systems are getting stuck in the middle of a disagreement between our federal and state governments," Enterprise City Schools Superintendent Aaron Milner told the Dothan Eagle.

And state officials like Attorney General Luther Strange told CBS42 that the move indicates that the federal government is taking a heavy hand in the issue.

"I think it is a sign that the Justice Department is being very aggressive," Strange said. "South Carolina was just sued yesterday on a bill very similar to Alabama's. I have not had a chance to review the DOJ letter in detail, but I can assure you that we're not going to deny any child an education."

The letter comes after the Justice Department sued Alabama over a statute in the state's H.B. 56 -- signed by Republican Gov. Robert Bentley in June -- that requires schools to collect information on the immigration status of students who seek enrollment, though it does not block undocumented students from enrolling in the public school system. A federal appeals court last month blocked the state from implementing the statute, but ruled to stay parts of the law.

Still, there have been widespread reports of Hispanic students vanishing from Alabama's public schools in the wake of the state's immigration crackdown. And amid claims that the law is creating a fearful and distrusting climate in the state, Hispanic students still in school are reporting instances of bullying.

The Justice Department has set a data submission deadline for school districts for Nov. 14, and districts are expected to continue to submit the information requested in the letter every month thereafter.

After public education, most of these students don’t have the money to continue with school, and even if they did their immigration status would stop them from getting a job. There is no good reason to just knowing if the student has papers or not and the truth is that it really isn’t their fault that they were brought to this country illegally, so why is the focus on them. They are innocent children that do not deserve to be punished for their parents actions. Many people just hate on illegals because they don't know anything about them or their stories. In reality these people will never really understand until they experience something similar, but just imagine yourself in their situation. If you were born in a country were you didn't have much to look forward to and you wanted to give your family a better life, what would you do?

Are these children not simply children? Their parents brought them to the US to get an education because going to school in Mexico costs too much money (Thank NAFTA). They are young children who deserve to be educated as dignified human beings.

And their parents? You say a person who comes to this country in order to work because their own country can't provide enough jobs is hiding behind their children? What about courageous for taking a risk for the future of their children's lives? Would you not do anything in your power in order to secure a bright future for your own children?

A drain on the medical system? If you legalized the immigrants who are here currently and made hospitals a more friendly place to be for people of different cultures, preventative care could be administered for all and then there wouldn't be such outstanding effects on the medical system.

Immigration is not a hard topic. Simply put, immigrants are humans that are looking to do the same things in life you are trying to do. To ignore the humanity of the people who live amongst you is rotten and undignified. Shame on you and the state of Alabama.

I am getting a slight confusioned - headache.. someone please enlighten me. I am not referring to the issue of Native in america here, it is just the immigration procedure that has been working for the last 50 - 100 years. I just saw a report of 125 immigrants becoming u.s. of america citizens on the birthday of the statue of liberty. What am I missing? Why are we having discussions and issues with this. For now, deport all illegals and if they want to come in, knock on the door as a neighbor, not sneaking in under the fence through the night and then hate on united states of america. one step at a time...

The FEDs need to leave us in Alabama alone. If they dont like the new law then the Federal Goverment needs to start enforcing it at the borders so the states dont have to fend for themselves.

The children may have a "right" to our educational system however their ilegal parents do not. So if the parents move along and take their children with them it is their own demise and to those illegal immigrants i say

Personally I would love to see an ammendment to the Constitution that would consider children born to "ilegal immigrants" to be "ilegal Immigrants" themselves. I also would love to see it state that only "legal" children are entitled to our educational benefits. Give a thief a dollar and they will continue to steal!

Our illustrious and courageous governor has backed away from this law saying that he really doesn't want to be identified with it. Of course he's not going to denounce the law either since it reflects those "Alabama values" that he ran on; those values being meaness, bigotry and a celebration of the kind of stupidity that leads to the passage of dumb laws like this one. Even though the law has been detrimental to the state both economically and from the standpoint of our already less than flattering image, it proves to the nation and to the world that the Republican party here is really ticked off by just about everything and everyone who ain't from 'round here unless they can build us a factory here with our own money.

I am half Anglo-American and half Mexican-American, proud of both my cultures. My family never taught me to hate or blame others for my station (for lack of a better word). It takes some petty, heartless people to take their grievance out on children. Those who support the frightening of children and use those children to frighten parents, should be ashamed of themselves.

And let me remind everyone that the only people who were not originally immigrants in this country were the Native Americans. I'm pretty sure I never read in any history books that the Native Americans put up for sale signs, "Will sell land for beads" or sent out advertisements to English, Irish, Spanish, etc.

Native Americans are no more native to America than members of other American racial or ethnic groups. They are descended from Asiatic people who immimgrated to the Americas from Asia.

It costs approx.half a million dollars to put a typical uninvited migrant family
thru' school. EACH FAMILY!

A federal court has temporarily blocked the part of the Alabama law that would require schools to ask students about their citizenship. (The schools were to begin complying at the beginning of the next school year.) So, it difficult to see how the schools could furnish "nine sets of data, including a list of all enrolled students, identifying their race, national origin and immigration status as well as a list of all students who have withdrawn from school since the start of the academic year, identifying their race, national origin, immigration status and including their date of withdrawal and the reason for withdrawal." The Department of Justice appears to be asking Alabama school district for data that it argues can not be collected witrhout violating the constitution.

Hospitals the cost. People are somehow under the mistaken impression that when an uninsured person goes to the ER that the taxpayer picks up that tab - they don't - we eat the cost - and no we can't just pass on the cost to the paying patients either.

Hospital staff helps the patients to get Medicaid. So in the end the taxpayers do pay.
