Kim Kardashian, Kris Humphries Divorce: Raoul Felder Weighs In On Legal Aspects Of Split

The media has reported on every facet of Kim Kardashian's split -- everything from what went wrong to Kris Humphries' reported reaction to E!'s plans for the wedding footage to what Kardashian plans to do with her gifts, and more. But not much has been said about what really matters most when all the hype dies down -- the legal ramifications of her divorce.

For that, we asked "Duke of Divorce" Raoul Felder to weigh in. Felder has represented dozens of celebrities throughout his decades-long career including Martin Scorsese, David Gest, Rudy Giuliani, Robin Givens, and Larry Fortensky and others.

Note that Felder is not working with Kim Kardashian or Kris Humphries and has not advised on this case.

Kim Kardashian and Kris Humphries were married for 72 days before Kim filed for divorce. Could she have filed for an annulment instead? Why didn't she?

An annulment is based on fraud... it requires corroboration, witnesses to back it up. The average person with a 60-day marriage would be talking with their lawyer about an annulment. But there is a lot of exposure involved in it and I just don't think they want that. I think in this case it would hurt them; it's easier to get divorced.

From a legal perspective, what will happen with Kim's $2 million engagement ring? Does she get to keep it or will Kris get it back?

An engagement ring is a gift of contemplation, a contemplation of marriage. If the marriage takes place it a completed gift. If it doesn't take place, the prospective husband has an argument to get the ring back. But this marriage took place. I think there is also a question of who bought the ring? She's not wearing it now, I saw in a photograph. For all we know maybe this whole thing was for show.

What about the sponsors and vendors at their wedding -- are they affected by the divorce in any way, and do they have legal grounds to sue?

Presumably, when [Kim and Kris] got married they made a commitment that it was going to be forever. Well forever was two months. If the [sponsors] came to me I would investigate it. I would think they have a shot at a lawsuit. I would find out what their real intentions were, whether he intended to be married forever, when she made the airplane reservations to go to Australia, all kinds of questions like that. I’m sure that most of the people [who gave] products, anyone from jewelers to wedding gowns, to whatever, [thought it would be] very good exposure. Now it’s part of a joke, a national joke.

If it was $50 you write it off--I don't mean grandma giving a soup terrine. They gave expensive gifts. I think some of the stuff they received was in the hundreds of thousands of dollars. These are people that are giving for commercial reasons, I think. [I would need to] get a deposition to figure out what the true story is.

Kim requested the court bar Kris from requesting spousal support. Do you think they will uphold her request? Will Kris' current unemployment due to the NBA lockout be a factor in the spousal support award?

Spousal support was probably worked out in the prenuptial agreement. I would be shocked if it wasn't...It's not his fault he's unemployed. It's because of the strike that he's unemployed. If he's any kind of earner he may not get spousal support, because when he's working he's really making money and self supporting. The 800-pound gorilla in the room is that they were only married two months for all intents and purposes. What kind of spousal support can you get for two months' marriage? It's a long date, that's all it is. A 2-month date.

There is a prenuptial agreement in place that most likely protects Kim's assets prior to and during the marriage. What about profits the couple made from their wedding and during their marriage? How will it be divided?

That could be shared. If that's not covered in the prenuptial agreement, that's joint money they made. That would probably be something that would be divided. Or returned. Most people who have class return a lot of stuff.

She announced that she will be donating the value of her gifts to charity.

That would be the right thing to do, but I wouldn't hold my breath.

she ought to be made to return each and every gift back to its original giver along with a note apologizing for the mistake she made. Giving a donation is an easy way out. what about the people that went and spent the money for the gifts. They should get their money or gift back. nd her mother should be ashamed of herself for orchestrating all of this by exploiting her children for money. Good parenting!!!!!!!!!!!!

At the very least, the people who gave the gifts should get a tax receipt for the value of the gift, if she is giving them to 501.c.3 organizations.

She is a victim! The pressure of the show gave her no easy exit.

This is classic. Woman are pretty much tougher and smarter than men in many capacities, but in divorce they instantly play the cute and naive card to garner sympathy and not own up to their mistakes and responsibilities.

This could end badly for her.

This family advertised for a prof athlete to date Kim during the taping of her show .. the first athlete turned them down .. even after they told him if would further his career ... Poor Kris .. he should have been smart enough to turn them down also .

Believe it or not every single person on this earth is playing a game. Whether you call it life, monopoly, or phase 10 we are all playing. I have seen many people get caught up not once but several times in games they are not playing.

I don't think many were fooled as we could see right through everything and were just waiting to see when it would all fall down. It is mesmerizing to see all the fake drama and know it had to come to an end, but how long would it take? Way too long, yes?

That should be "soup TUREEN". "Terrine" is like a coarse pate or jellied meat loaf. "Tureen" is a serving dish for soups and stews.

The venders took a risk, a bad one it turns out, and do not deserve compensation. Are venders now too big to fail now? Suck it up and chase after some other celebrity.

If she was the one to end the marriage, and she had any class, she would return the ring. So, um, no, she probably isn't returning the ring.

I totally agree about the vendors. More to the point they profit from increased divorce rates, because that means multiple weddings. Their donations were about publicity, and publicity doesn't depend on a happy lasting union, just great photos and and lots of public interest, which they're getting in spades.

Why is everyone so hot and bothered about the ring? Had Kim been responsible for the breaking-up of the engagement then I agree propriety demands she return. But of the many many divorced women I know not one, no matter the circumstances of their split, has returned their engagement ring or been vilified for not doing so. Kris is a grown man who made his own choice, it's not as though his ability to feed/house himself depends on the return of the ring and we don't know that he wants to stay in the marriage anyway or that he isn't responsible for its dissolution.

Whether or not you approve of Kim generally there's no justification for vilifying her if she decides not to return the ring.

Man, I wouldn't want to keep the ring - it would remind me of the bad times, but that's just me. I told my x-boyfriend I would never marry him but he gave me a ring anyway, right in front of a bunch of friends at Christmas! I was so embarrassed. He thought I would have to say yes but I didn't. He wanted me to have the ring anyway and not break up. We didn't break up until a few years later and I gave the ring to him but he wouldn't take it. I sold it.......

Well, Kim hasn't been seen wearing the ring for awhile....maybe it's on Ebay.
I can just imagine Mama Kris watching the bids come in on her laptop...then when it's sold,
