NLRB Accuses Target Of Intimidating Workers Before Valley Stream Union Vote

More evidence has come to light indicating that Target might have threatened to close one its New York stores if workers decided to unionize, according to the National Labor Relations Board.

The change may convince a judge to invalidate the results of a June election in which workers at a Valley Stream, New York Target voted not to join the United Food and Commercial Workers Union, according to Crain's New York Business. The NLRB's claim comes after an earlier complaint alleging that Target implemented surveillance of its employees and threatened to close the store amongst other charges. The case is likely to head to an administrative law judge early next year and the NLRB will decide whether to overturn the June vote based in part on the judge's decision.

The Target dispute is indicative of the larger debate in the U.S. over unionization. The NLRB proposed new rules this summer that would streamline the union election process, eliminating some of the obstacles to unionization, drawing the ire of business interests. American opinion on organized labor is complicated; the vast majority of Americans say they believe unions improve working conditions and help boost wages, but a Gallup poll found union approval rating at almost record lows.

Labor historians and advocates closely watched the battle over the Valley Stream store this summer, seeing it as a testing ground for the ability of organized labor to make inroads in Target and the retail sector more generally. Workers at the Valley Stream store ultimately voted against joining the union. Immediately after the vote, the UCFW alleged that Target management intimidated workers illegally so that they would vote against unionizing.

Several weeks after the vote, Target fired one of the most outspoken advocates of unionizing the Valley Stream store, according to a separate report in Crain's. Tashawna Green was fired in August after management saw a union representative drop her off at the store, according to claims from a union lawyer. Target claims they let Green go because she was acting in an "overly hostile, disruptive manner that is inconsistent with Target's policies," Crain's reports.

But the Valley Stream store is likely not the only Target where union activity is viewed negatively. Target had made new employees watch a video that discourages workers from joining a union, The Consumerist reports.

Another worker claims Target fired him last month after he spoke out against the company's break policy. Jason Kellner, a former manager at an Oxford, Alabama Target, said the company let him go after he was caught working while not clocked in. Kellner claims he was regularly denied an uninterrupted break, while he worked at the store.

Target isn't the only mega-retailer facing accusations that it treats its workers unfairly. Half a dozen current and former Walmart employees argued in a presentation to a group of investors and analysts last month that the company's low-cost approach to labor is hurting sales. Walmart has resisted workers' attempts to unionize.

As a Target employee they Intimidate their employees i can honestly say that. If they do not intimidate they play favorites. The recession is the only reason target is in business jobs were available target will have to close stores down.

I pay a small percentage in union dues out of my check and bring home over 200 dollars more a week in my paycheck than the same non union worker. And oh yeah, my boss has been in business for about 20 years and is worth 100 million dollars. But union labor isn't working? Don't believe the lies you hear about unions not working...all working people need to stand together against these greedy business owners that want it all for themselves and want the people that make their money for them to live in poverty.

Unions have destroyed our ability to manufacture competitively in the US, so why not kill retail? Unions are riddled with corruption and only benefit the union officials. Unfortunately the workers are blinded by the idea that they have it better off somehow by being in the union. It actually costs the worker more to be in the union and there are no improved benefits than what they have today. In fact, one supermarket retail company we worked with on branding actually voted a union out when the associates realized that the non union staff had a better benefit package than the union negotiated.

the LAST thing we need is Target & Walmart employees to be part of ANY union ... they can then ALL be equally unfriendly and clueless but be assured of life-time employment !

Unions have a place but need some reforming. UAW has started to change, understanding that they can't just strike every time they don't get their way. There must be compromise and mutual respect between the companies and union reps.

Until Unions start focusing on ensuring they have the best possible members/workers rather then protecting ones that are worthless, I think you will continue to find people unwilling to buy into the idea.

The jobs belong to the company and the stock holdersteachers, firemen, retirees that have appointed the President of Target to do what is in the best interest of the teachers, firemen, retirees drawing money, that own Target........

Many like dollar General have 15 minute round offs on thier time clock and you are supposed to clock in and out.. you can be on break 3 minutes and it says 15.. Working off the clock is not only expected but the tricks retailers pull to MAKE you work off the clock is shocking! All the same time pretending that working off the clock is bad.

Union bashers are still looking at the worst of the union. They believe what they are told.

All of them should consider how their workplace is, is it improving? Mine isnt, its getting worse.

Ironically, my wife is a NJ teacher and same thing,..getting worse. Christie and the people took their voices. But do not seem to care that "non working politicans" grab and steal. Its ironic and a bit sad. The American people that do not respect their working neighbor get what they deserve.

Dear union bashers,

Unions are not the reason your life suxs. They're not the reason you're unemployed, you can't meet your mortgage or are struggling financially. They're not the reason your employer won't hire you full-time or offer medical insurance. Destroying other people's wages & benefits WILL NOT IMPROVE YOUR CONDITIONS AT ALL. Because YOUR employer will only give you the bare minimum that they have to. In this job market people are taking ANY job at ANY pay & employers are taking advantage of that.

Businesses have negotiated with unions & signed contracts of agreement & gone on to great business & financial success since the 1930's. Every union contract HAD the approval of the business or it wouldn't have been signed. The sudden suspicious group effort by local governments & large corporations to break unions & take away agreed upon benefits for the workers is not because of a sudden exodus of jobs to other countries. Nor will additional tax breaks bring jobs back.

As long as a business can pay $1-$10 a day for workers in another country & hide their profits off shore with no penalties or US taxes.. THEY WILL. NO US worker can compete with that. So, instead of concentrating your efforts on destroying what's left of the middle class, let's make it not so attractive & profitable for businesses that do this.

This seems to be an ongoing deal with wally world.On another note I have afriend thats a manager at our wal-mart and she told me on black friday they will be letting Acer laptops,good ones too for 90 dollars a piece,limit of 2 per person so I'm getting 2 and I have 3 friends that are going to go with me and each of them are gong to get 2 a piece for me and that just about takes care of my xmas shoping

Shoot! Target was my go-to place when I started boycotting Walmart years ago. Keep this up & I'll end up doing all my non-grocery shopping online. With so many sites offering free shipping it's certainly an option - though I prefer to patronize local businesses. Oh well, no more target for me. Ever!

the northeast is littered with the memories of retailers the unions pushed out of business... arcane work rules, silly non-sense has made unions obsolete. yeah maybe in 1930 they were helpful, but not anymore... now they are just a way to suck the life out of a company and eventually kill more jobs than they make.

I've worked union shops as both a 9-1-1 operator & in the telecommunication industry for over 20 years.. you're spewing cliches & lies.

Both Germany and Canada have very high union representation of retail employees... Does it look like either of those countries are going out of business? Actually, both are doing somewhat better than the US in this economy.
