Benita Veliz, DREAM Act Poster Child, Spared Deportation By Immigration Officials

Benita Veliz, a poster child for the DREAM Act, was spared deportation earlier this week under deportation guidelines established by the Morton Memo on Prosecutorial Discretion, issued by U.S. Immigration and Customs Enforcement this past June.

After her parents brought her to Texas from Mexico at the age eight, Veliz graduated from high school two years early as a National Merit Scholar and as her class valedictorian. She then graduated from St. Mary's University, which she attended on a full academic merit scholarship. But in 2009, she said a small driving error threatened her ability to stay in the only country she knows.

Veliz neglected to make a complete stop at a stop sign, prompting a police officer to pull her over. Deportation proceedings were then initiated when it was discovered she was undocumented.

In a video testimony on YouTube filmed in 2009, Veliz says that she has "absolutely no family in Mexico" and knows "absolutely no one" in her native country. Veliz says in the video that critics should take into account how young she was when her parents brought her to the U.S.

"A lot of people will take the argument, illegal is illegal is illegal and so if you're here illegally you did something wrong and you need to go back where you came from," she said in the video. "But put yourself in the shoes of an eight-year-old child, who has absolutely no concept of what legal is or illegal is ... who could barely write in cursive, much less understand the complexities of the immigration system."

Luckily for Veliz, U.S. Immigration and Customs Enforcement Director John Morton established new guidelines earlier this year that prioritized the deportation of undocumented immigrants who are dangerous criminals over that of individuals with no criminal record. Thanks to those guidelines, immigration authorities ended deportation proceedings against Veliz on Wednesday. Nancy Shivers, Veliz's lawyer, said in an interview with the San Antonio Express-News that she believes Veliz was spared because she's eligible for the DREAM Act.

However, Veliz's trouble are still "far from over," according to the San Antonio Express-News, because in order to obtain a work permit, she would have to leave the United States and face a 10-year ban before she could return.

While cases like Veliz's are not yet commonplace, she is not the first to avoid deportation thanks to the Morton memo. Luis Enrique Hernandez and Pedro Morales, two students from Georgia who were brought to the U.S. at a young age, both successfully filed petitions to drop their cases based on the memo's guidelines.

Despite the challenges she still faces, Veliz says she is happy to be able to stay in the country she calls home.

"When this started three years ago, I thought that was it. I'd lost hope," Veliz said to the San Antonio Express-News. "I'm definitely happy to still be here."

Are they in the process of deporting her parents? Lets be clear -- she was raised in her country of origin until the age of 8 -- so she knows her home country. Deport her -- even by her standards, a child of 8 doesn't understand, but you better believe she understood at the age of 10, 12, 16, 18 and 21 that she and her parents were criminals by being here illegally, getting free public education. Ship her and her family back to their country. This rewarding bad behavior needs to stop.

Children cannot commit the crime of illegal entry, their parents committed it. She should be entitled to get an H1B visa or a work permit without waiting ten years. This is a travesty of justice and speaks to why we need new leadership in Washington, not recycled leadership.

These children should be upset with their parents for puting them in this situation...not the U.S. for upholding it's laws.

Toatal lack of responsibility by their parents. And, if this person is such a gifted student, Mexico could use her to better her OWN country....That would be Mexico and not the U.S.

(R) Ronald Reagan granted Amnesty to all illegals in the USA, 25 years ago, on November 6, 1986

Ms. Veliz should NOT be The DREAM Act eligible, when Reagan granted "UnVetted" U.S. Citizenship to ALL Illegals 25 years ago.

Plus, Ms. Veliz already has her 2 college degrees ~ to become a successful recepient of The DREAM Act, she would have to return for 2 more years of college education ~ which she states, she does not have the money to pay for ~ or will she qualify for a 3rd full-ride scholarship to obtain a third degree?

Correct Cacey. The law Regan passed served to give a pathway to citizenship to those in the country prior to 1986. Everyone else after that was left out. That is why youth immigrants cannot change their status. There is no law that currently allows them to even try.

November 6, 1986, the date of Reagan's Amnesty should be the Cut-Off Date for maximum age allowance for illegals ~ 25 years, instead of the proposed U.S. Senate Bill S 952, allowing illegals up to 35yrs of age

"Double Dipping" isn't fair to the U.S. Taxpayer ~ no wonder The DREAM Act has failed passage 7 different occasions in the last 10 years

(a) In general
Notwithstanding any other provision of law, an alien who is not
lawfully present in the United States shall not be eligible on the
basis of residence within a State (or a political subdivision) for

As far as I'm aware, it is not possible for a non-citizen/non-permanent-resident to be named as a National Merit Scholar. Therefore, at least one of the following is true: the article is not accurate, she was on a path to permanent residency or she used false documentation to apply for this award.

Also, the fact that she finished high school so early (definitely considered an acheivement by her university) is questionable. There was no accurate way of documenting attendance to other schools prior to her enrollment in High School, her actual age or previously completed school work.

It is fine that she is allowed to stay, but there needs to be a civil penalty for each of the resources that was fraudelently acquired, including her public education, free lunch and any publicly awarded scholarships. It is highly likely that none of these financial gifts were included in tax returns. If all of those things check-out, then this decision is justifiable.

Allowing her to stay, gives each institution the ability to seek these civil damages and collect their losses.

I agree. She went to school in San Antonio, TEXAS and it was St. Mary's UNIVERSITY, also in San Antonio, TEXAS. Knowledge of Californian and whatever school you're referring to would be almost useless.

But, for more background I actually attended the same University as Ms. Veliz... in TEXAS...
