Cuccinelli Now Supports GMU Gun Ban

Virginia Attorney General Ken Cuccinelli will address the membership meeting of the Virginia Citizens Defense League (VCDL) on November 17.

According to AmmoLand.com, "The Attorney General will be speaking about his support for the GMU gun ban, when he originally told VCDL members, as a candidate for Attorney General, that the ban wasn't valid."

In a video (included with this article), Cuccinelli tells a VCDL gathering, "I've heard the college question. They don't have the legal authority to pass the regulations they're passing that trump what the General Assembly has said."

He's doing the same thing McDonnell did. Trying to appear moderate to get elected to the governership, then his true colors will reappear.

In my home state of Oregon, only the state legislature has the power to regulate gun carry by concealed carry license holders. We have already had at least one good test case in court regarding college campuses, and the Port of Portland had to back down from their gun ban after being threatened with law suits. No locality may override state law. We are also allowed to carry in places where alcohol is served, if we are not drinking. This has been the law since 1994, and the predicted disasters (by the Brady Campaign and others) have not happened. Look it up yourself if you do not believe me-- that is all I need to say.

Sorry, but just as the First Amendment does not apply on private property the Second does not either. If you enter private property and they require you to check your concealed weapon, guess what, they are within their legal right to do so and you have no constitutional argument against it. So while you may be allowed to carry in an establishment that serves alcohol as long as you are not drinking, if that establishment decides it wants all weapons checked at the door...Sure, you don't have to patronize their establishment, but you do not have a right to carry a concealed weapon onto private property. So be very careful what you believe...if I can say no shoes, no shirt, no service I certainly can say no service if you're carrying a gun. And if you believe the State can tell me I have to allow you on my property while you carry a concealed weapon...well that will need to go to the Supremes and I would be very surprised if even this Court found your Second Amendment rights trump property rights.

How about psycological testing,similar to what police applicants take,before admission to spot potential problems that can be addressed whether guns are allowed or not.

Do You Really Think Its Ok For College Kids To Be Carrying Guns Around On Campus Anyways...I Remember My College Days, & That Was After 4 Years In The Marine Corps, Some Of The Students Were Still Drunk In Class From The Previous Evening's Party... Alcohol & Guns Are A Bad Combo...And We Know There Is LOTS Of Alcohol On College Campuses...

He has said only that the state can't ban weapons from campus but that the school can.

As usual, he's an idiot and an embarrassment to the state of Virginia. A public university is a government agency, and therefore, is unable to legally violate the Second Amendment.

Exactly...but a private school as any private establishment can have and enforce such a ban.

However, this isn't about a private university. George Mason University is a public university in Northern Virginia.

He IS an embarrassment, that's for sure. Starting from his first days in office when he gave out lapel pins to his staff with a different version of the state seal that didn't reveal Virtus' breast, then declared that any state university anti-discrimination policy that protects people of all sexual orientations violated state laws. Then lets see...suing UVA to get emails and records from former professor because Coochie didn't agree with his findings on climate change,suing the feds over the Affordable Care Act, and all-around douchebaggery.

But, he's finally right on this one, so I'll give him a pass. Educational institutions have long been afforded flexibility over 1st and 2nd amendment issues as they apply to safety and order.
