Undocumented Immigrants Facing Deportation: Caught Up In Confusion, Lost Records, Inconsistent Policy Enforcement And Difficult Choices

PLANO, Texas -- The worst shock of Maria Navarro's life came, fittingly, on Halloween. Weeks later, she still is afraid, asking that her real name not be used, recounting her story over the phone and hiding out with her three U.S.-born children at the home of relatives.

In the pre-dawn, federal agents arrested Navaro's husband, Ramiro, as he made his way to his plumbing job. Within hours, he had been deported. He broke the news to his wife over the phone from his hometown in north-central Mexico's Guanajuato state.

"He is disillusioned," she said. "He spent the last 20 years in the United States. He made his life here. This is where his children were born."

Ramiro's is just one case in the record number of undocumented immigrants being deported by the Obama administration -- nearly 400,000 in the last fiscal year. Many are whisked quickly across the border. Increasingly, they're deported without speaking to a lawyer or having a proper hearing, according to a recent report from the National Immigration Law Center, a Los Angeles-based advocacy group.

An official at the Mexican Consulate and a spokesman for the U.S. Immigration and Customs Enforcement office in Dallas said they found no record of the immigration raid that netted Ramiro and seven other men on Oct. 31.

Roberto Nicolas, the consular official, said in an email it was "not a common practice for deportations to occur on the same day."

Carl Rusnok, an ICE spokesman in Dallas, also wrote in an email that he "did not find any information regarding these actions taken in that location that day."

Immigration attorney Kathleen Walker believes that Navarro may have been swept up in a little-known federal program called "stipulated removal."

Designed to speed up the deportation process, the controversial program has allowed immigration officials to deport more than 160,000 undocumented immigrants in the last decade "without ever giving them their day in court," according the NILC report.

"Generally, 'stipulated removals' happen when the undocumented immigrant willingly admits that he or she entered the country illegally," Walker said. "Then, they are given two options: either sign a consent form for removal or remain in a detention center and wait for a hearing with an immigration judge."

"Many times, immigrants opt to sign because they want to leave the detention centers," Walker said, adding that ICE is using "stipulated removals" more frequently than ever and disobeying President Obama's order that the deportation of immigrants with criminal histories be given priority.

The September NILC report, titled "Deportation Without Due Process," said stipulated removal was used primarily on undocumented immigrants without lawyers and facing deportation for minor immigration violations.

"These noncitizens were given a Hobson's choice: Accept a stipulated removal order and agree to your deportation, or stay in immigration detention to fight your case," the report said. "The stipulated removal program has been implemented across the U.S. at the expense of immigrants' due process rights."

Government documents showed that immigrant detainees were routinely provided "inaccurate, misleading and confusing information about the law and removal process," the report said. "Little has been known about the manner in which the government administers stipulated removals."

ICE spokesman Rusnok stated in an email that the "decision to accept a stipulated removal is strictly voluntary." ICE defends stipulated removals as "an efficient mechanism to remove aliens and reduce prolonged detention" that "relieves the Immigration Court of the need to have a hearing, saves ICE additional detention costs, and allows the alien to return to his/her country expeditiously."

Maria Navarro said her husband of 11 years called her from his hometown, San Jose de Iturbide, on the same day he was picked up by immigration agents as he headed to work in Texas. He had contacted her earlier from a U.S. detention center, she said.

Ramiro told his wife that he was not asked for identification at the time of his arrest. "It was a surprise that his deportation was so immediate," she said. "We did not even have time to get help."

"He is a hardworking man without a criminal record," she insisted.

Ramiro's wife and his boss said he was arriving for work when he and seven other workers who were off the clock were intercepted by several law enforcement vehicles. They were questioned about a young man who worked for the company. A few said they knew him. The men were arrested.

Sandra Martinez, the owner of the plumbing company where the men worked, asked that her name be changed for fear of reprisals. She insisted that none of the workers had criminal records.

"I have known them well for many years, we are all one family," Martinez said.

Martinez said she visited the men at the detention center and gave each man expense money for the return to Mexico.

"We are all suspect if we look Latino, and could be detained at any moment simply because we are perceived to be illegal immigrants," said Martinez, adding that she would provide temporary financial assistance to the families of the workers.

This month, a joint report from the American Immigration Lawyers Association and the American Immigration Council said that 33,400 people are detained by federal authorities at a cost of about $5 million per day.

In August, the Obama administration promised a case-by-case review of deportations, allowing many undocumented immigrants without criminal records to remain in the United States and potentially apply for work permits.

For months, the administration has pledged to balance its record-levels of detention and deportation with more targeted and humane enforcement.

In a speech in El Paso, Texas, last spring, Obama said: "[W]e are focusing our limited resources on violent offenders and people convicted of crimes; not families, not folks who are just looking to scrape together an income."

On Thursday, the Department of Homeland Security began a review of 300,000 pending deportation cases in an attempt to separate "high priority" and "low priority" individuals, the New York Times reported. The review is intended to hasten the trials of those who have committed crimes and halt proceedings against college graduates, those who have resided in the country from a young age and non-criminals.

"ICE should carry out that order," Martinez said, "not only because it is inhumane to tear families apart without consideration to the pain it causes communities, but also because of the direct harm that it causes our economy."

Due to President Obama's administration, over 46, 000 mothers and fathers of at least one U.S. citizen were part of massive ICE deportations in 2011.

This is exactly what should be happening to illegals without criminal records. I do not agree that we deport people that are convicted of crimes. Those violent offenders should not be given a free ride to freedom, they should be thrown in jail and be used as forced labor in the agriculture industry. You see movies and here about American criminals making a run for the border to escape justice but if you are an illegal that committs a crime the government gives you free ride to the border to escape justice. Makes no sense.

Is the another business person knowingly hiring Illegal Immigrants? The fines she now faces should help to reduce the US Govermnet's budget deficit, caused in part by her hiring Illegal Immigrants while letting US Citizens languish on the rolls of the unemployed.

Note that Mrs. Ramiro has no plans to join her husband in Mexico, and is in fact hiding out to keep from being deported. Either Mr. Ramiro plans to sneak back into the country to re-join them, or it wasn't much of a marriage. We should deport entire families at the same time to discourage illegal re-entry.

I have news for you, if you deport the entire family they will come back as they probably have 5-6 jobs between the wife and husband, the kids born here have free schools, freed medical, free soc sec if the sneeze twice a day and those mexican borders are so easy to re-enter it is a joke. The mexican and latino illegals laugh at us and our feeble attempts to keep them out.

Since Arizona opened the flood gates to illegal immigration enforcement because Obama refused to get involved and help Arizona out because he wants to secure the millions of votes illegals will give him if he's successful in giving them amnesty as he promised when he was running for election and they, the hispanic interest groups, gave him $1 million dollars for his campaign, and because of the outrage from the American people alot of money has been alocated to ICE. You can see where the money is going and the updates in new procedures at the border by watching "Border Wars" on channel 66 the Discovery Channel on Sunday nights at 10:00 pm. Very educational! I also like "Border Town: Loredo" on channel 55 the A&E chanel on thursday night at 10:00 pm. For example a new pilot program between US and Mexico that when a large drug bust is made at the border US turns the people over for prosecution along with the eviidence, the US not carrying all the burden and when people are caught at the gate trying to enter with fake identification, they are now prosecuted and jailed as before the id was confiscated and they were simply returned so of course they kept trying because there were no risks, not anymore!

The way the term "Non-Criminal" is used in this opinion piece is incorrect. Crossing the US Border illegally is a criminal offense. Per Section 1325 – Immigration and Nationality Act “Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under Title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under Title 18, or imprisoned not more than 2 years, or both.”

Title 18 is the US Criminal Code. Calling the act of entered the USA by illegally crossing our border "Non-Criminal" is incorrect and if done on purpose, deceitful. Furthermore, obtaining a job using a Social Security Number that was either not legally issued or stolen is also a violation of the US Criminal Code. Therefore, it is incorrect and possibility deceitful to call anyone "Non-Criminal" who is working in the USA illegally using a fraudulent Social Security Number.

The language of Illegal Immigration is so corrupted it is now possible for some to hope "Non-Criminal Undocumented Immigrants" applies to more than just people who have only overstayed a Visa.

Texas did this. That state thinks they are their own country. They could care less what Obama and his policies for immigration is. They are deporting and profiling illegally. But the illegal immigrants have no rights if they never applied for a green card. So Texas and many states like mine are going to get away with it. They are working within gray areas of the laws so it is legal. Very sad for the families torn apart like this but they should have reported themselves for documentation a long time ago.

That is the Obama Administration at work......immediate deportations for Illegals caught up in a sweep - only - while he is campaigning for re-election.

The man is Obama's collateral damage - to give the appearance that he is deporting illegals.

But yet the criminals who have been deported numerous times - for crimes - return to the USofA to rape and murder - because Obama refuses to control, close and enforce our US borders -

to protect US citizens, to protect the sovereignty of our country - or as a matter of National SECURITY - as he is required to do as POTUS.

Obama is only interested in protecting Holder's Operation Fast and Furious - arming criminals, Narco-Terrorists and protecting their access in and out of the USA.

"A Hobson's choice is a free choice in which only one option is offered." Stipulated removal hardly offers only one option unless of course Ms. Gomez believes these illegal aliens should have been released on their own recognizance. The trouble with that options is that the overwhelming majority never appear for their hearing. Or maybe Ms. Gomez believes illegal aliens are such special people that the law simply doesn't apply to them, and they should be left to do whatever they want.

It seems to me that there are two rational responses Latino citizens can take. One, they can facilitate the lawless behavior of illegal aliens whose presence injures Latino citizens as much as all other citizens, and in the process exacerbates the disparate treatment they rightly abhor. Two, Latino citizens can join with other citizens to demand politicians from both political parties remove these law breakers from the country. Latinos must also speak out when Latino media spokespeople like Ms. Gomez spew disinformation and propaganda like this article.

It's human nature to respond negatively to people or groups of people who do things that hurt you or your family. The presence of illegal aliens in the US hurt virtually every American to some degree. Yelling racism or some other epitaph doesn't change the reality of damage illegal aliens do to our country.

On February 4, 2011, the deputy of director of intelligence at the US Immigration and Customs Enforcement (ICE) headquarters in Washington, DC - James M. Woosley - was escorted from his desk and the building by internal security officials.

Woosley was placed on administratve leave pending an investigation - that he helped an employee submit fake travel reports and received financial kickbacks from the employee for his efforts.

As Woosley was being escorted from ICE headquarters, FBI agents were raiding the El Paso, Texas home of Woosley subordinate = "ICE Supervisory Intelligence Analyst" - Ahmed Abdallat, 63, a naturalized US citizen born in Jordan and a devout Muslim.

Abdallat is also accused of using a diplomatic passport to make EIGHT unauthorized personal trips to Jordan. The trips are the center of the fictitious travel reimbursements.

The corporate media is reporting this story as a case of passport fraud or misuse by an official within the US Immigration and Customs Enforcement (ICE), but it is a much larger story that involves high-ranking officials, monetary kickbacks, blackmail, and potential money laundering for Middle Eastern TERRORISTS.

Even if true, (and your last paragraph is unsupported by any facts), this still involves only TWO employees. The actions of TWO employees do not make ICE a terrorist organization.
