Only months after being released from prison for the shooting death of Oscar Grant, Johannes Mehserle is headed to court in a civil case alleging that the former BART police officer used excessive force during the 2008 arrest of Kenneth Carrethers at the Coliseum/Oakland Airport Station.

In a case expected to hear opening arguments as early as this Tuesday, Carrethers has accused Mehserle, along with three other BART officers, of police brutality.

The charges stem from an incident that occurred only two months prior to the Grant shooting, the latter of which drew widespread condemnation and sparked a destructive riot in Downtown Oakland immediately following a jury's conviction of Mehserle for involuntary manslaughter--a decision many found excessively lenient.

On the evening of November 15, 2008, Carrethers, who had recently had his car broken into outside of a BART station, alleges he was heard by a group of BART officers verbally deriding the agency's police force as "useless."

The San Francisco Chronicle reports what followed:

In court filings, attorneys for Carrethers said Mehserle grabbed their client from behind and took him to the ground with a leg sweep. The officers then punched and kicked Carrethers before fastening his arms and legs together and carrying him off "by the strap of the hog tie," wrote attorney Christopher Dolan.

Carrethers said Mehserle and another officer drove him to the hospital to be seen for facial bruises and a sore shoulder. During the ride, Carrethers said Mehserle turned around and said, "Well, have you learned not to mess with police officers?"

Carrethers, who is African American, was initially charged with resisting arrest, but those charges were later dropped after Mehserle's subsequent arrest.

For their part, BART officials tell a much different story. Police attest Carrethers accosted them with a string of profanities and they only attacked him out fear that he was about to physically assault them first.

"Any damages or injuries suffered by [the] plaintiff were occasioned by his own wrongful acts," attorney Dale Allen, who is representing both the defendants and BART, wrote in an statement to the San Jose Mercury News.

This civil case was initially filed in February 2009 but put on hold while Mehserle was arrested, and subsequently jailed, for shooting Grant.

Carrethers filed a claim with the transit agency for half a million dollars; however, it was rejected, prompting the 44-year old substance abuse counselor to file suit.

NBC Bay Area reports that Mehserle is expected to testify in his own defense.

"My client wants this trial so the public can see and hear the facts they didn't get to see in the Oscar Grant case," Carruthers's attorney Christopher Dolan told the San Francisco Examiner. "He wants to show that what happened to Grant could have and should have been prevented."

The BART police department has been under intense scrutiny since Mehserle shot the unarmed Grant at the Fruitvale BART station on New Year's Day in 2009. This attention flared into a series of protests after BART officers shot and killed Charles Hill at the Civic Center BART station earlier this year.

I am not a lawyer but if this is the defense of the bart officers:

"Accosted with a string of profanities", his car was stolen, he was furious and venting, maybe even misplacing his anger on Bart security but they were just words, angry words but they posed no physical harm to anyone.
"attacked him out fear that he was about to physically assault them first." So you struck him first? That is assault plain and simple. Attacked him out of fear? There were three of you and one of him. What were you afraid of? His words? His size? The color of his skin?
Is this part of the Bart security training that if you are "fearful" you can initiate violence against the object of your fears?
I hope that justice is done and that Bart pays for it.

I think this victim is looking at a few million dollars from Bart

So...he shoots an un-armed man in the back who is lying on the ground face down, already subdued. Now he's already out of prison? Are we fools?!?!
This man is dangerous to the general population and should be locked away forever.
Oh...I forgot, this is Oakland - the Police State.

If you're a wuss, maybe law enforcement isn't you're bag.

hes a piece of s**T this man is evil, another person victimized by police brutality. yes oscar had a shady past and was acting like punk but he did not deserve to die. that was F**cked up

I wish there was a violent offenders database for people specifical­ly convicted of abuse in the profession­s of: police, security guards, transit, childcare, caretaker in an old folk's home, mall guard, etc. People like this who abuse their position and use their job to partake in violence and intimidati­on of the people under their care should be banned for LIFE from having any job where they are in any position of physical authority whatsoever­.

Police science has known for decades that anti-social personalities are attracted to their ranks. Its a classic "reaction formation" defense. They attempt to exclude individuals who make bad cops but no screen is perfect. After they have invested valuable resources in training they are reluctant to discharge or fire an officer. However, the public pays the price either way.

When a cop gets "run out of town" because of brutish behavior, there is an instant job waiting in any other town. Shuffling bad cops around is the standard procedure.

You've gotta love California. You have to have a license, issued by a state board, which can be revoked at a hearing, just to apply toenail polish to a woman's toes, but you don't have anything anywhere near that kind of oversight for our own law enforcement officers. Yeah, sure, what a liberal place.

Wow, why wasn't this case tried before the the murder trial. I think it would have materially affected the amount of time Mehserle would have been sentenced to. It puts a very different face on Oscar Grant's death.

Well if you have uncovered something that adds important information regarding this case please share it with the rest of and if you don't please refrain from attacking a victim of abuse.
What we do know is that one of the officers in this case has a history of unnecessary violence and the power of the state and its fortune to hide behind. Mr Carrethers and the late Mr Grant have no such advantage.

You're right about that. I'm in favor of firing them, then suing them, then leaving them to find a job as a security guard or WalMart clerk or whatever it is that former cops with no other work experience can find.
