Sirhan Sirhan: Lawyers For Convicted Robert F. Kennedy Assassin Argue That New Forensic Details Show Client Is Innocent

LOS ANGELES (AP) -- Lawyers representing convicted assassin Sirhan Sirhan argue in newly filed court documents that a bullet was switched in evidence at his trial and new forensic details show he is innocent of the 1968 killing of Sen. Robert F. Kennedy.

In the latest of many appeals filed on behalf of Sirhan, the attorneys are seeking to overturn his conviction. They repeated a previous assertion and presented reports from experts who said Sirhan was programmed through hypnosis to fire shots as a diversion for the real killer.

Prosecutors had no comment, said Lynda Gledhill, a spokeswoman for the California attorney general's office, which is handling the appeal.

The lawyers, William F. Pepper and Laurie Dusek, also said sophisticated audio tests recently conducted on recordings from the assassination night show 13 shots from multiple guns were fired – five more than Sirhan could have fired from his small pistol.

Authorities have claimed eight bullets were fired, with three hitting Kennedy and the rest flying wildly around the kitchen and striking five other victims who survived.

Paul Schrade, who was struck by gunfire, refused to comment on the new filing, saying he is working on his own new analysis of the assassination.

Pepper and Dusek argue that before Sirhan's trial, someone switched a bullet before it was placed in evidence because the bullet taken from Kennedy's neck did not match Sirhan's gun. The lawyers suggest a second gun was involved in the assassination, but they do not know who fired it.

Pepper said the new evidence outlined in a 62-page federal court brief filed in Los Angeles is sufficient to prove Sirhan is innocent under the law.

"They put fabricated evidence into court before the judge and jury" Pepper told The Associated Press. "We are satisfied that for the first time in 43 years of this case we think we have the evidence to set this conviction aside,"

The motion was filed last week in federal court in Los Angeles

Whether it has any chance of success is questionable, said leading appellate lawyer Dennis Fischer of Santa Monica.

"It's a longshot in the longest way," he said, "but they certainly are raising intriguing questions."

He said the passage of time weighs against defense appeals, with courts tending to ask what took so long to raise the issues. However, he said federal courts frequently are willing to take a closer look at cases in which governmental misconduct is alleged, even if it is long after the fact.

"The current thinking by the U.S. Supreme Court is these things need to end," said Fischer. But he added in a case with such historical importance, "No one will ever be satisfied."

Sirhan, now 67, a Palestinian immigrant, was denied parole after a hearing last March where he denied any memory of shooting Kennedy on June 5, 1968, moments after he claimed victory in the California presidential primary.

Parole officials said he doesn't understand the enormity of his crime that changed U.S. history.

Pepper and Dusek are the latest attorneys to take up Sirhan's case after his conviction and argue on his behalf before parole boards and courts.. All of his appeals have been turned down. Pepper, who has taken on other unpopular cases including that of Martin Luther King assassin James Earl Ray, stepped in after Sirhan's previous lawyer died.

At trial, Sirhan took the witness stand and said he had killed Kennedy "with 20 years of malice aforethought." He later recanted the confession. Prosecutors introduced in evidence handwritten diaries in which he wrote: "RFK must die."

The latest filing by Pepper and Dusek relies heavily on a report by audio analyst Philip Van Praag who did tests on an audio recording made by a news reporter during the shooting. The expert concluded that 13 shots were fired and that none of the sounds on the recording were echoes or other anomalies.

The report also claims that the sounds of gunfire were not isolated to one spot in the room but came from different directions.

The lawyers also contend that Sirhan did not have adequate assistance of counsel at trial, noting that his chief attorney, Grant Cooper, decided Sirhan was guilty at the outset and never pursued available defenses.

The Sirhan defense team settled on a claim of diminished capacity and never denied that Sirhan was the shooter of Kennedy, the brief noted.

"Defense counsel did not pursue the issue of a possible substitution of another bullet," the brief said.

Acknowledging "the difficulty of retrying a case of this vintage," the lawyers asked that the sentence be set aside and Sirhan set free.

"Petitioner fully understands that he is likely to be deported to Jordan where he would hope to quietly live out the rest of his life with family and friends, but at long last he would, at least, have received long delayed justice," the filing states.

As an alternative, they asked that the judge set an evidentiary hearing to reexamine the case.

The public would like to keep this case closed, it is easier than facing the truth. Sirhan in all likelihood did not kill Senator Kennedy. The security risk of him telling the truth would put the national historic records in a tail spin. He was in Dallas, he saw the assassination of JFK, Jack Ruby shot him in Dallas with a pistol and he went down...Jack Ruby thought Sirhan was dead, he was not he ran away...I saw him. Then I met him again in the White House in 1966, he was going to slit Jackie's throat for her part in the assassination of JFK. But Sirhan is not a cold blooded killer and he cannot feel remorse for something he didn't do. Take a close look at the film of Jackie scrambling to get away from her husband right out of the car...she is not afraid even though shots were fired....three shots were fired that day...I heard them.

I was six years old when I met you in the White House in 1966. I was there on a tour, I also saw Jackie Kennedy Onasis, her brother Bovier and John Jr. you promised me not to hurt them. Do you remember? Did you break your promise to me? Should I fear if they release you? Will you come after me or will you rescue me from them as I did you?

What happened in the White House the day they toured it, in 1966 is of historic significance. Snookie met Sirhan. He threatened her with his knife. He was wearing a white shirt and black pants so he would look like a servant. He told her his name was Sirhan and asked for hers, she told him so he knew she was not related to the Kennedy children. He said he was going to slit Jackie’s throat for what she did to JFK. There was somebody else he was going to get too. Snookie burst into tears, please don’t hurt them, I lost my daddy too, his kids have been hurt enough, just like me, don’t hurt their mommy, please. He asked how he could trust me that I wouldn’t tell anyone he was there, I promised because I wasn’t supposed to be there either.

I was only 15 at the time when Bobby died. It was a kind of - full stop in relation to political moral courage in my young mind. It is therefore not surprising that such an appeal should come about at a time in history where we appear to be cycling back to the 60/70s. We are facing the same moral bankruptcy of that time. The youth are starting to rattle their golden cages. In other words the First World values are like those of the tale of the 'Emperor New Clothes' in which it is a young boy (The Youth) who had the courage to call out that the Emperor had no clothes, even though the adults where going along with the spin doctors of that time. And haven't we all fallen for the spin of the Bankers? And so we are indeed naked of any sense of dignity and moral courage. As Bobby advocated; Moral courage is a more rare commodity than bravery in battle or great intelligence. Sirhan Sirhan, just like Oswald was a patsy. And indeed, we the citizens, have all become - a patsy, in some way or other, by being compliant to such inequality, just to prop up our own First World life styles.

This has got to be the strangest story ever. I was three years old when Bobby was asassinated - but still, just reading about this makes me feel filthy. Assasinations are the absolute worst...and always (with one exception) perpetrated by we all know which side of the aisle.

What took so long to raise the issues they ask ? With the reputation of governing agencies in question today along with the many cases of deception that have been brought to the public eye as well as the cover ups that have yet to be proven, I believe it is not beyond the probability that Sirhan is just another patsey.

This was originally a German research project given to the United States by German doctors after the defeat of Nazi Germany. The name MKUltra = Manchurian Kanidaten Ultra. Advanced mind control augmented by sleep and sensory deprivation was improved upon at Fort Detriech with the advent of LSD drug regiment and code word association to trigger altered mental states. If you convince a person that he is killing an alien or creature for example he would have no reservations about killing it. After the job was done the person would either forget he had done it or sound like a crazy person that would be put away and later retrieved by the Government at a later time for reuse or not depending on how well he did his job. There would also be field agent observers to guide him by telling him or her suggestions and or providing equipment needed and later gauge his performance.

My mother, a clinical psychologist, was on the Sirhan grand jury at the time. It was her suspicion then that he had been programmed.

Wow. THIS is useful and most appreciated. I have reviewed the books on the assassination of JFK and MLK, there is ZERO DOUBT now that elements of the US Government were engaged. I have no way of knowing the actual truth, but there is more than enough to over-turn all the "official" stories.

I was 4 years old when RFK was shot. I didn't see it. I don't remember it. Maybe that gives me an open mind. Hypnosis only needs suggestibility, not consent. All I ask is, "Cui Bono?" Who would benefit from the death of RFK? Who would lose if he became president?

The mob for one, and...well, not the Palestinians, that's for sure...

While I have no 'love' for the Kennedys, I do not believe any assassin, or attempted assassin should ever be set free. Why not try another ploy? Since some believe in the 'second shooter' notion - suggest to him that he can be released, if he reveals the name of his accomplice.

Shots were fired. Football pro Rosey Greer and track and field pro Rafer Johnson grabbed the shooter, Sirhan Sirhan, and pulled the gun from Sirhan's hand. Case closed. There is absolutely no question as to Sirhan's guilt. Sirhan was sentenced to death, but by the grace of the people of California, was allowed to live the rest of his life in prison.

Stop the testing, stop the lawyering, and let Sirhan Sirhan die die.

get with the tread, fred. i wasn't commenting on truthfulness of the story but the plausibility of it. your friends on this board appear to adopt the philosophy of intolerance prior to investigation. however, as a psychologist with a specialty in hypnosis, after reading the facts in the case i believe the story is plausible AND true.
