The administration of Wisconsin Gov. Scott Walker (R) unveiled a policy Thursday to hold protesters in the state Capitol liable for extra police or cleanup, in the aftermath of massive demonstrations earlier this year against anti-union legislation.

Under the policy, groups of four or more inside state buildings and 100 or more people outside the Capitol must obtain permits at least 72 hours in advance of protests. Groups could be charged $50 per hour per Capitol Police officer, while costs for other law enforcement agencies will vary. The police could also require advance payment and liability insurance or a bond. Cleanup could be charged to organizers.

The policy also makes it clear that spending the night in the Capitol, taping signs to Capitol walls not intended for signs, allowing the sale of food or other items in the Capitol and using sound equipment that would interfere with the building are all not allowed.

The policy is effective immediately. The administration says no one will be denied a permit based on the content of their event.

Edward Fallone, an associate professor at Marquette University Law School, told the Milwaukee Journal-Sentinel that the policy could be problematic since some groups might not be able to afford the costs. "I'm a little skeptical about charging people to express their First Amendment opinion," he said. "You can't really put a price tag on the First Amendment."

The Wisconsin Department of Administration estimated cleanup and overtime costs for the protests earlier this year were about $8 million, including $270,000 for Capitol building repairs. About $3.9 million of the $8 million was for local law enforcement costs.

Gov. Walker is facing a recall effort. Activists announced earlier this week that they had gathered over 300,000 signatures in 12 days. For a recall, organizers need to collect 540,208 valid signatures by Jan. 17. An election could occur as early as March 27, but will likely be later.

Walker drew a few dozen protesters supporting the recall effort against him Friday as he lit the state Christmas tree. The tree has been controversial since Walker declared it a Christmas tree and not a holiday tree, as it had been called since 1985.

I'd be willing to bet that those clean-up "costs" have been grossly inflated.
Typical of repub behaviour in recent years and especially in recent months -- do ANYTHING to squelch the voices of the regular, non-politically-connected, working and wishing there were jobs so they COULD work, genuine American people.

So just recently Hilary Clinton gives a speech about not discriminating on the basis of sexual orientation. In WI when legislation is written it has always included language to the effect about not discriminating on the basis of race, religion and sexual orientation.
Until you get to this most recent policy which requires permits for 4 or more protestors to obtain a permit 72 hours in advance. The language "sexual orientation", which was always included in other legislation, regarding discrimination was omitted.

This is NOT a Republican issue. This is a Governor Scott Walker issue. Hold him accountable, not his political affiliation with the Republican party.

Honestly, I believe laws should have to go through the Judicial branch before they become law. City laws would go through the City Court. State laws, like the one Governor Scott Walker upholds, would go through State Court. And, National laws, like the NDAA bill, would go through the Supreme Court.

We need our Judicial Branch to be more actively involved in the Legislative process. This would not prevent all unjust bills from becoming a law but it would lessen the herd.

Why is my local municipality allowed to charge me money if I want to hold an event that requires police dept. labor and cleanup? Maybe I should just hang an Occupy sign outside my daughter's birthday party at the public beach gazebo and claim my First Amendment rights are being violated if they charge me.

The Supreme Court long ago ruled that a municipality can license and charge nominal fees for parades and demonstrations on public fora to defray the costs as long as the fees are the same regardless of the speech content.

What every single Scott Walker opponent should be focusing on are the vague "liability bonds and insurance." The state is not, under any court case I've seen, allowed to charge a hefty bond or insurance simply because it expects the protest to be messy or violent.

A nominal fee for a license or permit is not the same as charging thousands of dollars to cover the all costs connected to a protest.
Walker should have thought of the costs before he started screwing people over. Of course the one thing I noticed is Republicans have never been good at looking forward.

After the protests last Feb., the Wisconsin Painters Union offered to come clean the Capitol for free and Walker said no. He paid minimal and no where near millions as they claimed, to have it cleaned, just so he could blame the protestors, for wasting Gov't money. Who wasted it? He wasted it in many other ways too, but will blame the poor and Dems.
